A reading of Article 4 of the Constitution would reveal that no person shall be compelled to do that which the law does not require him to do. While a reading of Articles 62 and 63 of the Constitution and Section 99 of the ROPA would reveal that none of them requires any member of Parliament to account for his assets or those of his dependents even if they are disproportionate to his known means of income. Section 12(2)(f) of the ROPA requires him to disclose his assets and those of his spouse and dependents and not the means whereby such assets are acquired. Where none of the provisions of the Constitution or the Act dealing with disqualifications requires a member of Parliament to account for his assets and those of his dependents, even if they are disproportionate to his known means of income, how could this Court on its own or on a petition of any person under Article 184(3) of the Constitution require him to do that......

Big twist about to happen - PMLN starting a new episode of making lawyers sacrificial lamb. Lets see if SCP falls for it - CJP will surely fall for it and indications are to "try" to split the case in two phases, composition of JIT bench will tell the pitch Sharifs have requested to be prepared and if it worked.

Sharifs have upped the ante and they have decided to go all out and fight it themselves hence absence of a lot of Khawajas and Co. (or GG Brigade as Aitzaz calls it).

SA is not only funding, its local (Pakistani) financiers as well; and one of them (we all know who he is) has even claimed to have people with guns and tanks in his pocket and now his latest claim is people with pen (qalum).

Too much going on - and I hope PA plays its neutral but strong role of keeping discipline - at present a lot of chaos.

As we discussed yesterday - spin doctoring didn't go well and it's discussed today in almost every program in Pakistan.

Yesterday I became aware that lawyers will be tried to make sacrificial lamb by PMLN as one of the options like how it's done in Dawn leaks as well and today all media is talking about this. More of a smoke screen!

This idea was floated by a business tycoon and media godfather and seconded by land mafia tycoon in a recent meeting.

Huge money is at stake - if this case comes to fruitition then some bank accounts in Luxembourg can be exposed as well - as BOA (Bank of America) has already investigated certain transactions when Dar gave that statement of money laundering. All PTI has to do is to request reopening of two cases.

Recently, a notification was issued stating “With the approval of competent authority, Dr. Muhammad Irshad shall stand re-employed as Chairman FBR in BS-22 after his retirement, on standard terms and conditions, for the period from April 24, 2017 to June 30, 2017”.


Who is this person and why was he so indispensable for the Nawaz government to re-employ him? Because by doing so, it has blatantly violated two explicit orders of the Supreme Court – the first against re-employment of retired persons, and the second passed on 15-03-2017, directing the High Powered Board to reconsider its meeting of August 2016 within one month.


This gentleman joined civil service in Income Tax Group with the 13th CTP. His batchmates and colleagues describe him as “pleasant but untrustworthy” and “having no technical competence but great expertise in sycophancy”. In some manner yet unclear, he managed to add the three years of his pre-CSS service as army doctor to his seniority - a feat so far unmatched by any other officer. Then, through his obsequiousness and charm, he managed to obtain the most lucrative positions in the field service, and later, without having any prior experience in FBR headquarters, landed the most-sought after position as Member IR Operations FBR.


His ambition did not stop there. Being quite low in the seniority in BS-21 officers of Inland Revenue Service, he was shrewd enough to realize that he wouldn’t get promoted before his retirement in April 2017. His golden chance came with the breaking Panama scandal, when the assets of the Prime Minister’s family came under question. Seizing the moment, he volunteered to extricate the Prime Minister from the mess. With the help of his friend, the Chief Commissioner Inland Revenue Lahore Choudhry Safdar and some trusted staff members, the actual income tax returns of Mian Sharif and his family were replaced by fabricated ones. Since the tax returns in the 1980s and early 90s were filed manually, this exercise did not present much of a problem. For this service to the Sharif family, in August 2016, Choudhry Safdar and Dr. Muhammad Irshad, standing at serial number 10 and 16 of the seniority list respectively, were promoted out of turn to BS-22, by a mis-constituted High Powered Board, ignoring more senior, qualified, honest and competent officers. Later Irshad was also gifted with the position of Chairman FBR by a grateful Prime Minister.


However, this is not the end of the story. In a petition filed by Ms. Raana Ahmed against being passed over for promotion for no valid reason, the Supreme Court passed order on 15-03-2017, directing the High Powered Board to properly reconsider all the officers within one month. However, this order has been starkly ignored by the government, who instead went on to re-employ Dr. Irshad for a further period of almost three months, in sheer violation of another Supreme Court order against re-employment of retired officers.


The reasons for this disobedience to Supreme Court orders are not too far to find. In the Panama case judgment, the Supreme Court directed to form a JIT comprising of different agencies. Conspicuously no member from FBR was included in the JIT. Apparently, this was deliberate, in order to enable FBR to independently present the fabricated returns of Mian Sharif showing he had huge assets and investments abroad even in the 1980s and 90s, thus creating the first part of the money trail in favour of Nawaz Sharif. Against this backdrop, it is therefore understandably that government wants to continue the services of Dr. Muhammad Irshad even at the risk of violating two clear orders of the Supreme Court." Panamagate case: Civil, military agencies submit names for JIT

As the deadline for the formation of the joint investigation team (JIT) which will investigate the Panamagate case approaches, the civilian and military agencies concerned have submitted the names of candidates to represent them on the panel to the Supreme Court.

Complying with the Panamagate verdict announced last Thursday by the five-judge bench hearing the case, the Supreme Court office had sent letters to the Federal Investigation Agency (FIA), the National Accountability Bureau (NAB), the State Bank of Pakistan (SBP), the Securities and Exchange Commission of Pakistan (SECP), the Inter-Services Intelligence (ISI) and the Military Intelligence (MI), asking each of them to recommend three names, one of whom would be picked to represent his or her respective department on the JIT.

Each agency has sent the three names to the Supreme Court registrar, sources told The Express Tribune on Wednesday. They said the ISI and MI have both proposed the names of three brigadiers each to represent them on the JIT. They added that the top court has started examining the credentials of recommended officials and may notify the composition of the JIT next week.

According to sources, FIA has recommended the names of additional directors general Wajid Zia, Ahmad Latif and Dr Shafiq, SECP has proposed the names of Muzaffar Mirza, Yasir Manzoor and Tariq Bakhtawar and NAB submitted the names of SM Husnain, Muhammad Rizwan and Nauman Aslam.

Interestingly, all departments sent the names a day before the deadline ends.

Meanwhile, the Sharif family has asked members of its legal team to give their opinion in the next few days on whether they should file a review petition against the Panamagate verdict or not, sources said. According to them, senior lawyer Khawaja Haris has already given his legal advice to the Sharifs on the issue.

The sources said the Sharifs are divided on whether to file a review petition. One section of legal team believes that they should approach the Supreme Court to issue directives that the JIT should investigate the case ‘independently’, without being influenced by the larger bench’s observations about Sharif family members. However, the family’s other lawyers fear the judges may make more observations or pass more adverse remarks about them while hearing the review petition.
