Nope Sir.What I wanted to show (as you claimed) that even the Indian Independence act 1947 does not consider India as an exclusively Hindu state (irrespective of whatever reason behind the creation of the state of Pakistan might be) , neither it instructs its refugee policy on religious grounds. The foreigner's act still holds the ground with a number of amendments after 1947.

While I agree with your general point, I think the logic here will be to claim persecution on religious grounds. That option will not be available to Muslims, specifically the dominant sects. That would be similar in most countries in the world. While Europe & the U.S. may entertain claims by Pakistani Christians (just an example, could be other minorities also) on similar grounds, they are unlikely to accept the same (at face value) from, say, a Sunni Muslim from Pakistan.

Indian foreigner's act 1946 does not discriminate its subjects on the basis of religion.However rights of any foreigners in India are protected by article 21 of Indian constitution which again does not patronize any foreigner on the basis of religion.
