That is pure speculation.

It was deceit, but that does not mean its not consensual. For e.g. Most victims of Con artists give them their money voluntarily. Its cheating, but not theft.

You can claim IPC 420, but how are you going to prove it ? Its just your word against his. The court will throw such case out due to lack of evidence.
