Awami dhoti lovers has been rejected once more and supreme court of Bangladesh clearly told them dhoti lovers to leave Bangladesh to their cow mata land with their Hindu Bengali identity. Bangladesh is for Muslim majority and we shall roam over the land no matter how the Awami munafiq and it's Hindu master try.

Dhaka, July 27 (bdnews24.com)—The Appellate Division of the Supreme Court in an amended ruling on the High Court verdict, which had declared illegal the Fifth Amendment to the constitution, has commented that the nationalism will be 'Bangladeshi' instead of 'Bengali'.

The highest appeals court's verdict on two petitions challenging the repeal of the Fifth Amendment was published on Tuesday.

The six-member full bench of the Appellate Division, headed by former chief justice Mohammed Tafazzul Islam, published the verdict after a long meeting.

Attorney general Mahbubey Alam told journalists after getting a copy of the verdict: "The Appellate Division has upheld the High Court verdict terming illegal the usurping of power by Khandaker Mushtaque Ahmed, Abu Sa'dat Mohammad Sayem and Ziaur Rahman."

"However, the Appellate Division has commented that despite the mention of Bengali nationalism in the High Court verdict, nationalism should be Bangladeshi," he pointed out.

The attorney general also said that the main portion of the latest verdict did not make any reference to the four foundations of the constitution. It strongly criticised unconstitutional takeover of power and expressed the resolve that such power grab needs to be stopped once for all.

Responding to a query, Alam said, "The main portion of the verdict makes no reference to secularism and use of religion for political purposes."

"The Appellate Division has amended the High Court verdict on transition period. The Appellate Division also expressed its support for administrative works carried out from 1975 to 1979 that did not infringe on citizen's rights. The Supreme Court has declared completely illegal martial law," he added.

On Feb 2, the bench dismissed the petitions after six days of hearings that began on Jan 19.

It said in the rejection, "Petitions are dismissed with modification and observation."

Law minister Shafique Ahmed told reporters after that ruling that the order laid the foundation for reviving the spirit of the independence war which was at the core of the country's constitution.

Regarding the amendment to the constitution, he had said they would take measures after receiving the copy of the order.

The Fifth Amendment was meant to provide constitutional legitimacy to the governments in power — military or otherwise — following the 1975 assassination of the founding president Sheikh Mujibur Rahman.

But the High Court gave a ruling in August 2005, declaring the Fifth Amendment illegal, in response to a petition challenging the legality of the Martial Law Regulation of 1977.

In its ruling, the High Court declared illegal three regimes between August 15, 1975 and February 1979, headed by Khandaker Mushtaque Ahmed, Abu Sa'dat Mohammad Sayem and Ziaur Rahman.

The ruling exempted certain measures of those regimes initiated for public welfare. But the court in its judgment said all the changes in government from August 15, 1975 right up to the national elections of 1991 were unconstitutional.

The present Awami League-led government's withdrawal from a petition made by the previous BNP-led regime, against the High Court ruling, prompted the two petitions by BNP secretary general Khandaker Delwar Hossain and three pro-Jamaat-e-Islami lawyers last month.

The court said that by rejecting the two leave petitions, "We are completely disapproving of military rule and stay of constitution. Those involved in these illegal acts should be trialled and criticised so that in the future, no over-eager or illegal power usurper can show the impudence to remove the people's constitution and the government they have elected.

It also said in the verdict, "Even though the parliament can implement a law for this, we are saying goodbye forever to all actions outside the constitution."

I think the SC decision goes in India's favour also. The Indians do not fear Bangladeshi nationalism but are terrified of Bengali nationalism which could destabilize West Bengal and especially the North East. If Bangladeshi nationalism was an expansionist concept like Akhand Bharat then India would oppose this. Bengali nationalism on the other hand could have expansionist tendencies like promoting a Brihot Bangladesh.

What India and the AL is doing is to empathize our Bangladeshi nationalism while at the same time undermining our Islamic heritage. A very clever game India and the AL is playing.

Please hold your excitation a bit to realize that such slap in AWAMY hands is very calculable just to trade it off with Jamaati leader's unjust punishment at future. When Amardesh's second coming was getting rejoiced by many here, I suspected that the victory was awarded to legalize Jamaati leader's trial through unjust means. So, there came the rejection verdict against JI's objection about controversial judges.

Now, here comes another one to keep people in foolish paradise as the triumphed of Bangladeshi nationalism over Bengali one doesn't change the Geo-strategical dynamics a bit since Indians are in complete control of BD's affairs, infect it erects a wall in between people of similar looking and practice. Also its impact goes to India's favor as it doesn't want to nurture but exploit us. Furthermore, we get boxed up more tightly by it in the realm of globalization bogus boo. But the most degrading trade off of such 'GIVEN VICTORY' would be lowering 'Moral Bar' in a nation state of 160 million people, which would open the pandora box for further exploitation like giving up family, social and religious values.

I am happy to see Bangladeshi Muslim's stance for Islam rather then ethnicity.

Bengali and Bangladeshi are the synonyms of two. This is worthless thread and govt is not there to change Bangladesh to Bengali. They will be changing the basic principle of the state. secularism and separation of state and religion is the prime goal to it.

As BNP and Mullahs got big kick on the back, they are now trying to pick up the pieces. Good luck.

At least I cant agree any less than that. Bengali nationalism came in being taking in consideration of West Bengal and Assam. But we moved a long way from pre 1971 era to 21st century. Bangladeshi nationalism is the best thing to do now.
 
Bangladeshi nationalism makes way more sense. It takes into account non-Bengali citizens like Chakmas and other tribal ethnicities.

Yeah it should be that way, there should be room for everyone in your country. Like I call myself Indian Bengali, nationalism shouldn't be limited to only majorities. Other communities, tiny they might be, should able to identify themselves with the nation.

Look at the situation of Muslims today, we declare countries as "Islamic" and then do everything that is unIslamic. Its the people who should be changed from withing so that they start following the moral values of Islam like honesty tolerance, compassion e.t.c. that is more important.

Another layer of indian deception is unfolded. Muslim country is reflection of muslim majority population in Bangladesh regardless who is how much devoted Muslim. But its just sheer decption by india that has been desperate to setup Hindu dominance in Bangladesh using "secularism" disguise.

And that if we have majority practicing Muslims with a secular constitution (i.e. equal rights to all faiths--not special privilege to Hinduism) then country will lose its Muslim majority character?

When indian deception are spotted nothing else make sense to indians. Your post is reflction of that.
