2) the court order specifically rules 3 judges to constitute special bench alias order implementation bench. .

No.. Order of court was signed by 5 judges... It was on behalf of full bench..but reflected opinion of 3 judges.. This was also said by Justice Khosa while announcing the verdict.. I will try and find out..if i get find tht audio link of Justice Khosa announcing panama verdict

Anyways.. Even i take your argument as true..tht these judges are to give final verdict.. Then it means..final verdict is to be given by implementation bench.. In order of court..it was requested to the CJ to constituite a special bench.. Nowhere it was said tht these three judges will form the implementation bench., it was upto the CJ..

Even ..if final verdict is to be given by implementation bench (and nothing is to be done by original bench..lets assume ) and whatever has to be done further..will be done by impenentation bench only.. But same question arises..how can these 3judges take up the original petition? A most what can happen is..we say..tht implementtion bench is the final verdict giving bench...and the original bench standa dissolved..now..
But my concern is..how can implementation bench takenup ..original petition..on their own..without including Justice Khosa and Gulzar? Even if the verdict of those two judges isnt to be counted..and only implementation bench verdict is to be counted in the end...but how can these 3 judges..only take up original petition? Because original petition has Justice Khosa and Gulzar too.... Are u getting..what i am trying to say?
