But we do know that the list of 'capital' offenses, meaning of 'sins' that turned out to be 'crimes' that so offend us that the sense of justice overrode the deterrence desire, is not consistent. In the old days, the 'sin' of adultery was such a moral outrage. Now, even though some countries still has adultery as a 'crime', its prosecution is neglected and that contribute to the tolerance of adultery in those countries, at least as a distaste, anyway. But there are at least three 'sins' that became morally outrageous 'crimes' for all societies: murder, rape, and treason, no matter how tolerant they may became for other 'sins'.And there we have the rudimentary roots of all law. A countries legal code is an imperfect reflects of that countries moral values and a sense of what is right is often what keeps a country together as an entity.
