One accusing the partner of marital rape means the marriage has already failed and should get separated.

As I said, if there are accusations of marital rape, then there it means marriage has already failed and there is no point in keeping it alive.

This truly has been discussed to death here. I remember asking the person, presumably lady who was passionately arguing in favor of such laws to provide objective criteria for establish marital rape.

So I ask the same of you, please provide the way to determine this. Consider the scenario, where a married couple who regularly engage in intercourse and one fine day the wife accuses of marital rape. How does one go about establishing whether in fact there was rape or the act consensual?
