Triple-Talaq provision was enforced by Caliph Omar R.A to curb the misuse of original divorce law (which I quoted) and abuse of wives. So, in India if Muslim men are abusing that provision than Indian government must make laws to stop practice like Caliph Omar R.A did.

Firstly India has absurd Civil laws based on religion. There should be a Universal Civil Code. Only state in India with the Universal Code is Goa and it is doing just fine. In any State, the rights to men and women have to be equal. Your faith should not be a business of the Govt.

I was told by the State Secretary of the CPI-M ( Communist Party of India ) branch in my state that his party wants to work within the confines of the Constitution.

And then there is the AAP ( Aam Aadmi Party ) which intends to bring Direct Democracy to the country. Direct Democracy is a truer form of Democracy than the Representative Democracy of the Anglo-Saxon sort that most of the world follows.

So the CPI-M and the AAP must work together even with a status quo party like Congress under a progressive umbrella.

NEW DELHI:

The Congress will strike down the proposed law against the "triple talaq" instant divorce practice if it wins the upcoming national elections, party leader Sushmita Dev said on Thursday, drawing sharp reactions from the ruling BJP.

"I promise you that Congress will form government in 2019 and we will repeal this triple talaq law. This is a promise," Congress leader Sushmita Dev said at the party's minority department national convention in Delhi.

"Many people told us that this law is for the empowerment of Muslim women but we opposed it because it is a weapon used by BJP against Muslim men so that he could be harassed by the police," Ms Dev said.

The revised bill to make instant triple talaq - a practice among Muslim men to instantly divorce their wives by uttering "talaq" or divorce thrice - a punishable offence was passed in the Lok Sabha late last year.

The Congress, however, has said it will not allow the passage of the proposed legislation in its present form in the Rajya Sabha where the government does not have a majority. The Congress opposes stringent provisions like the jail term for those convicted under the law.


The BJP lashed out at the Congress calling it the "height of appeasement". "The Congress says it will repeal the triple talaq law. What a regressive thought! They have no regard for the Supreme Court," BJP leader Sambit Patra said.

Calling instant divorce unconstitutional in August last year, the Supreme Court had asked the government to frame a new divorce legislation.

The Congress and other opposition parties have criticised the new law proposed by the government, saying that it is against the bill's provision for a three-year-jail term for the husband.

There's no concept of triple-talaq in Qur'an to begin with, Rules of divorce have been laid out clearly. Here is what Qur'an say
1. Pre-condition
For those who swear not to have sexual relations with their wives is a waiting time of four months, but if they return [to normal relations] - then indeed, Allah is Forgiving and Merciful. And if they decide on divorce - then indeed, Allah is Hearing and Knowing. (2:226-227)

2. After divorce (Doesn't matter how many time one say Talaq word, it's one)

Divorced women remain in waiting for three periods, and it is not lawful for them to conceal what Allah has created in their wombs if they believe in Allah and the Last Day. And their husbands have more right to take them back in this [period] if they want reconciliation. And due to the wives is similar to what is expected of them, according to what is reasonable. But the men have a degree over them [in responsibility and authority]. And Allah is Exalted in Might and Wise.
Divorce is twice. Then, either keep [her] in an acceptable manner or release [her] with good treatment. And it is not lawful for you to take anything of what you have given them unless both fear that they will not be able to keep [within] the limits of Allah . But if you fear that they will not keep [within] the limits of Allah, then there is no blame upon either of them concerning that by which she ransoms herself. These are the limits of Allah, so do not transgress them. And whoever transgresses the limits of Allah - it is those who are the wrongdoers. And if he has divorced her [for the third time], then she is not lawful to him afterward until [after] she marries a husband other than him. And if the latter husband divorces her [or dies], there is no blame upon the woman and her former husband for returning to each other if they think that they can keep [within] the limits of Allah . These are the limits of Allah, which He makes clear to a people who know. And when you divorce women and they have [nearly] fulfilled their term, either retain them according to acceptable terms or release them according to acceptable terms, and do not keep them, intending harm, to transgress [against them]. And whoever does that has certainly wronged himself. And do not take the verses of Allah in jest. And remember the favor of Allah upon you and what has been revealed to you of the Book and wisdom by which He instructs you. And fear Allah and know that Allah is Knowing of all things.
And when you divorce women and they have fulfilled their term, do not prevent them from remarrying their [former] husbands if they agree among themselves on an acceptable basis. That is instructed to whoever of you believes in Allah and the Last Day. That is better for you and purer, and Allah knows and you know not.
(2:228-232)

The problem of some mullahs of hanafi madhab ( specially Deobandi fanatics) pretend that they are more muslim than prophet muhammad (pbuh) himself .

Such tripple talaq at once actually came from some foul mullahs who used to perform niqah halala aka one night marriage ( I call it as one night stand for a married woman because of the sin of her husband and call those fanatic mullahs as groom) that is basically haram in Islam.


Ahle hadeeths ( and also Shias too ) do not practice this tripple talaq at once and even do not consider even it a single talaq if someone say talaq to his wife in anger ( in anger its still confrontable though as it's a disgrace to wife), as in anger peoples lose sense and became actually sort of insane.

So I have no idea why the heck they even consider it as talaq!

Later Umar regreted as far I know. However still some lewd mullahs inherently speak for it because for this tradition they had the opportunity to one night stand with those women in Halal way ( by niqah halala; self proclaimed halal as actually it's haram in Islam ) , such hypocrite these mullahs are.

This effect is under-appreciated by lutyens media again I suspect. Heck in Rajasthan they were clearly chanting they are voting Raje out, but they are going to vote Modi for national level.
