"The government is moving a review petition in the Supreme Court on fundamental issues of law arising from the assassination of the late Shri Rajiv Gandhi.

"We have also informed the Tamil Nadu Government that their proposed course of action to release the killers of Shri Rajiv Gandhi is not legally tenable and should not be proceeded with. The assassination of Shri Rajiv Gandhi was an attack on the soul of India.

"The release of the killers of a former Prime Minister of India and our great leader, as well as several other innocent Indians, would be contrary to all principles of justice. No government or party should be soft in our fight against terrorism."

Unlike Delhi Parliament or Mumbai attacks, Rajiv Gandhi assassination was not a terrorist act.

According to the Indian Supreme court verdict, “It is the revenge for atrocities said to be committed by Indian Peace Keeping Force (IPKF) on Tamils in Sri Lanka”

Indian Supreme Court verdict presided by 3 judges in 1999, upheld that no offence was committed under under TADA (Terrorists and Disruptive activities prevention Act, 1987)

I don't understand why everyone blaming Jaya for this? I'm not supporter of Jaya

SC commuted their death penalty to life entence and they are in prison for last 23 years so life sentence became invalid here. So according to law one can be released.

People should blame central government and others who took 11 years to decide on mercy petition.

Supreme Court stays Tamil Nadu government’s move to release convicts in Rajiv Gandhi assassination case - The Economic Times

NEW DELHI: The Supreme Court on Thursday restrained the Tamil Nadu government from releasing the seven convicts in the Rajiv Gandhi assassination case. The apex court directed the state government to maintain status quo.

"Maintain status quo on all prisoners," a bench headed by the CJI said. "There have been procedural lapses by the Tamil Nadu government in its decision to release seven convicts in Rajiv Gandhi assassination case," the court said.

The Centre had sought a stay on Tamil Nadu government's decision to release all seven convicts in Rajiv Gandhi assassination case. Appearing before a bench headed by Chief Justice P Sathasivam, Solicitor General Mohan Parasaran pleaded for a stay saying the state government should not be allowed to release the prisoners till the apex court decided its review petition challenging commutation of death sentence of three condemned prisoners to life imprisonment on ground of delay in deciding mercy petitions.

Tamil Nadu took a cue from that and invoked its remission powers under section 432, 433 and 435 of the criminal procedure code to write to the centre about its proposal to release seven convicts in the case. Following an emotional reaction by congress Vice President Rahul Gandhi, the government on Thursday opposed the move in the top court. CJI sathasivam agreed that in a case in which a court had commuted death to life remission can only be made after giving special reasons.

"We have to see whether these were followed," the CJI said, listing the case for further hearing on March 6, 2014.

The government also indicated that it would seek a review of the commutation order of the three prisoners.
Besides Santhan, Murugan and Perarivalan, who earned a major reprieve on February 18 from the apex court which spared them from gallows, Nalini, Robert Pious, Jayakumar and Ravichandran are the other four convicts whose release was decided by the Tamil Nadu government.

Santhan, Murugan and Perarivalan are currently lodged in the Central Prison, Vellore, in Tamil Nadu and they are in incarceration since 1991.

Nalini, Robert Pious, Jayakumar and Ravichandran, are undergoing life sentence for their role in the assassination of Gandhi on May 21, 1991 in Sriperumbudur.

The Tamil Nadu government has set a three-day deadline for itself and also to the Centre over the release of the seven convicts.

The Supreme Court had commuted the death sentence of Murugan, Santhan (both Sri Lankan Tamils) and A G Perarivalan on the ground of 11 years delay in deciding their mercy pleas by the Centre.

It had also rejected the Centre's submission that there was no unreasonable delay in deciding their mercy plea and the condemned prisoners did not go through agonising experience as they were enjoying life behind the bars.

Gandhi's assassins were convicted by a TADA court in January 1998 and were awarded death sentence, which was confirmed by the apex court May 11, 1999.

23 years in prison, can't imagine that, its almost my age... Now again death penalty or imprisonment is bullsh!t, otherwise they should have been hanged them immediately after judgement...

Seeks President’s rule if Jayalalithaa does not listen
Stating that any move to release former prime minister Rajiv Gandhi’s killers would be “illegal”, senior BJP leader Subramanian Swamy on Thursday said that President’s rule should be imposed in Tamil Nadu if Chief Minister J Jayalalithaa did not “desist” from proceeding with the decision.

“I demand that the Centre issue a direction under Article 256 of the Constitution to the TN CM to desist from pursuing (the) illegal resolution on Rajiv’s killers,” Mr Swamy said.

“If she (Jayalalithaa) does not listen, then the state should be brought under President’s rule immediately,” he added.

The Supreme Court has stayed the release of those convicted in the Rajiv Gandhi assassination case saying there have been procedural lapses on the part of the Tamil Nadu government in the matter.

After the apex court commuted the death sentences of three of the convicts in the said case, the Tamil Nadu Cabinet had decided to release them and other convicts following due consultations with the Centre.

Ranganath was arrested on August 18, 1991, for sheltering Sivarasan and Shubha. Ironically, it was Ranganath who informed the police about the fugitives in his house and is the only witness to the CBI's break-in operation. And he and his estranged wife are the only ones to have heard Sivarasan and Shubha speak about the crime.

Did Sivarasan and Shubha tell you about their connections with Chandraswami and an AICC functionary?

They did speak about their connections with Chandraswami and also with a Congress leader from Karnataka who was a member of Rajiv Gandhi's cabinet. They used to say that it was through this leader that they got the details of Rajiv Gandhi's election tour programme. They talked about the AICC functionary as their close associate. During his stay with me.

(In his affidavit submitted to the Jain Commission on November 4, Ranganath speaks of Sivarasan and Shubha naming Aswath Narayan, a local Congress leader, as one of their friends. Both Shubha and Sivarasan pointed out that Narayan was close to the AICC functionary in Delhi who helped them with Rajiv's tour programme.)

What are the truths the CBI refused to record or act upon?

Then CBI chief Karthikeyan warned me not to speak anything about the AICC functionary or any other Congress people, and Chandraswami. Karthikeyan seemed to know the facts about the assassination and also the powers behind Rajiv's killing. He warned me of serious consequences if I gave the information to a magistrate or others. From what he told me it was clear that he was shielding Chandraswami and some key Congress people. Even after my request, CBI (SIT) failed to record my statement.

I took DCP Kempiah (Karnataka police) to the Bangalore hideout where Sivarasan and Shubha were hiding. But his statement has not been produced before the designated court.
