RAWALPINDI: Army Chief General Ashfaq Pervez Kayani on Monday said that any effort to create a divide between the people and Armed Forces undermines Pakistan’s larger national interest.

“The Armed Forces draw their strength from the bedrock of the public support. National security is meaningless without it. Therefore, any effort which wittingly or unwittingly draws a wedge between the people and Armed Forces of Pakistan undermines the larger national interest,” said the military chief according to a press release by the army’s PR wing, the Inter-Services Public Relations (ISPR).

“While constructive criticism is well understood, conspiracy theories based on rumours which create doubts about the very intent, are unacceptable.”

Speaking to officers at the Army’s General Headquarters (GHQ) in the garrison town of Rawalpindi, Kayani said that the country’s national interest could emerge only through a consensus between the people and institutions.

“No individual or institution has the monopoly to decide what is right or wrong in defining the ultimate national interest,” said the military chief according to a press release by the army’s PR wing, the Inter-Services Public Relations (ISPR).

“It [National interest] should emerge only through a consensus, and all Pakistanis have a right to express their opinions. The constitution provides a clear mechanism for it.”

“As a nation, we are passing through a defining phase. We are critically looking at the mistakes made in the past and trying to set the course for a better future,” said the Army chief.

He added: “While individual mistakes might have been made by all of us in the country, these should be best left to the due process of law.

Kayani added that, while individual mistakes may have been made in the past, that no one is guilty until proven otherwise.

“Let us not pre judge anyone, be it a civilian or a military person and extend it, unnecessarily, to undermine respective institutions.

“All systems in Pakistan appear to be in a haste to achieve something, which can have both positive and negative implications,” he said.

“Let us take a pause and examine the two fundamental questions; One, are we promoting the rule of law and the constitution? Two, are we strengthening or weakening the institutions?”

ISLAMABAD: Chief Justice Iftikhar Muhammad Chaudhry on Monday said the Supreme Court holds absolute authority when it comes to matters of national interests, adding the concepts of national security and stability are changed as arsenal strength can not assure it anymore, DawnNews reported.

Speaking to audience of the National Management Course in Islamabad, he said that giving judgments according to correct rules and regulations was a liability of judges of the apex court.

The CJ said that today, the concept of national security are evolving as states are now bound to provide its citizens with social security and to protect their civil rights at all costs. “Gone are the days when stability and security of the country was defined in terms of number of missiles, tanks and armory as a manifestation of hard power available at the disposal of the state,” said the chief justice.

Justice Chaudhry said that progress of the state is impossible without eliminating anarchy from the system. “Failure of administration and implementation structure is visible everywhere,” he said.

Emphasizing on importance of judiciary’s role, the chief justice said that as protectors of the constitution, heavy responsibility lies upon the judges of the Supreme Court to uphold the constitutional supremacy over all other institutions and authorities.

He said the courts are facing matters of social problems at multiple fronts, adding steps taken against the law and the constitution will push the society and the environment towards turmoil and unrest.

Justice Chaudhry then put forward following questions:

1- Do we reward merit and hard work? 2- Are the twin principles of rule of law and supremacy of the constitution being strictly enforced? 3- Do the citizens of the country trust the system and think it provides them fair opportunity to realize their dreams in a transparent manner? 4- Does the present system have the capacity to discourage the corrupt? 5- Do we have a system where civil and property rights are protected and contracts are fully enforced?

“Unfortunately, answer to the above questions is no…….the system is distorted and does not provide level playing field for the people to achieve in life whatever they are capable of,” remarked the CJ.

When pak army consider civilian as par ?they think they are superior and above law
All current problems faced by pakistan are because of these generals who mismanaged country and resources
I think army should provide fair audit and remove corruption
Gen(expire) Kayani sab should respect law and consitution or after their another expiry he will follow his predecessor to steal and run away
 
CJ is corrupt to teeth, and every one knows it.
CJ knows that after his retirement security agencies are going to pull evidence against him and thus he is playing his cards.
He is saved so far due to activists of IK.

Not only he is croupt but he is a traitor, his job is to create preasure & defame our forces time to time to keep them away from saving pakistan in any case they could hve been required !
It all strated when he went to NY to recive the best judge awards in USA , thts the time when things were rolling against musharaf , same time many of us been feuled by this traitor with venom.
 
The CJ has made the last statement correctly. But he is ABSOLUTELY wrong in terms of allotting his institution the sole role of protector and solicitor of national interest.
The Supreme Court has NO decision where it comes to the decision of going to war or otherwise.
Its primary facade is an opinion-giver , an interpreter of the law.. IT IS NOT THE LAW.
It tells the other institutions the right action based on the law, it is then up to the other institutions to carry it out as per constitutional responsibility.

The Chief has actually made a very balanced statement.

As to the current CJ, his role has also become overbloated.. much like AQ Khan. He was simply there at the right time.
He is no angel, infact the whole process with the Dictator Musharraf started due to their ego's clashing.
Because he turned out to be a symbol of resistance against dictatorship.. people followed him.

The govt & media was brought by army & thus this judiciary was installed by govt & media so yes army hve every right to give them all a shutup call tobe remain in their pants!

But Cj was made a symbol of resistance by CIA , which peoples strted following!
 
Gen. Kayani finally came out & spoke in the right time, I will not say it is to late but it is the right time to speak & that to against the corrupt system. People of Pakistan needed to hear this & that to from the man himself. Many people say why he is not taking over Pakistan & etc. today he answered all those calls.

The day when this corrupt & evil CJ retires or die is the day Pak Army will be free from one end & this window which they will get is enough for them to take over Pakistan or save Pakistan anytime they want.

Currently what this corrupt & evil CJ is doing is reading the US script well & protecting the corrupt & evil politicians from the Army take over.

You don't know anything about what's going on in Pakistan, so keep your nose out of Pakistan issues. We are here to handle our issues well, we don't need your advice.

General saab surely has great patience but he should not threaten other institutions just to cover corruption of a few generals This will damage image of army more than by anything else.So he should show some more patience and help to clean the Army off corrupt marks and let the people prays Army as they used to do in past.Otherwise a time will come when people will abuse Army as the use to abuse the polititions so oftenly

Both were right in their own scenerio but General Saab was a bit harsh and political which he was never before

Well, Pakistani are waiting for the CJ son's verdict . Seems CJ compromise with PPP to save the son. Pak army has all reason to screw CJ, because army jawan put life in danger and hand over hardcore terrorist and sweet heart CJ release all of them. PPP has all reasons to hate Army . In these tough time Qadir Khan statement about Benazir statement add fuel in the fire.

That is the best post on this issue I have seen.

Let's all be clear on one thing, the COAS made his speech to a group of officers, of his own institution. While the CJ made a statement for his own institution's members. So we should not be trying to make this like a Shikwa, jawab-e-shikwa situation. That COAS gave the first blow and then the CJ.

Now coming here, the best part of COAS statement was that trying to move this process quickly will have adverse and good effects, both. And he is not far from the truth. CJ might get over-zealous sometimes and make some weird decisions (the CNG prices seemingly the latest one).

SC does not have the right to be the sole decision maker of the country or paint a target on someones back, atleast not now. Then his statement that missiles and tanks don't define stability of the state. While he maybe true to some extent, but a state is still seen through a military scope by other nations. Economy and military sure are inter-linked.

COAS has tried to take a middle line through his statements, saying that we should be following law, no one person or entity has the right to formulate all the decisions, but the CJ is taking a bit bullish position, trying to be the sole representative and saviour of the country.
 
Cj regulating cng price ,price of samosa all these things are funny and clear cut case of judicial overreach but coas has no stand to give statement against judiciary ..its govt duty ..
He may be better than cj and may have all good intensions but as a system for long term it is not in best interest of the country ..enthusiasts here will certainly repent one day for mocking the system but pakistan as a country would have paid heavy price till then ..
