Cj regulating cng price ,price of samosa all these things are funny and clear cut case of judicial overreach but coas has no stand to give statement against judiciary ..its govt duty ..
He may be better than cj and may have all good intensions but as a system for long term it is not in best interest of the country ..enthusiasts here will certainly repent one day for mocking the system but pakistan as a country would have paid heavy price till then ..

He didn't say Judiciary.

It was a much more broader and vague statement.

^^there is nothing wrong with that statement .. But if it is directed at cj then it is an issue ..govt has got all rights not coas ..he is getting his salary only to dedicate his time and energy on armed force not to regulate internal affairs of the country ,however good he may be in that role ..

Kiyani Sahab's The Most Professional General, probably on par with Late General Asif Nawaz. His patience is being mistaken for his weakness. Make no Mistake, Chaudhary PCO, he's still COAS.

If another COAS goes against this CJ, he should know the country won't take another tantrum. In Pakistan Supreme Court is the final and ultimate arbitrator of all legal/judicial issues.

Technically agar CJ din ko raat keh de toh woh legally raat hojayegi. That is the power yours, mine and COASs constitution gives the CJ - disobedience to it, is treason.

If a matter becomes sub-judice, then the Court HAS to pass a decision.

That is incorrect. The Supreme Court is NOT a trier of FACTS, it is the final INTERPRETER of matters of LAW. Huge difference.

constitution gives him certain power so that no one goes against the constitution and constitution can be amended ..if he served under musharraf(who was coas) without thinking about constitution and now developed enough muscle to find the fault even in samosa price !!
But two wrongs wont make it look good

If that decision of whether it is day or night comes up as a matter of LAW, then it is a different thing, which it cannot, by definition.

The Supreme Court has to be very careful in what it tries and how, otherwise it goes astray. For example, can it accept a petition where it is asked to judge whether the sky is blue? No, for it is established fact. It can however accept a petition about a law passed by parliament that declares the color of the sky to be red.

It can, its a timing issue it can come up - or some variant of it.

If the matter gets sub judice - its all up to the Supreme Court. If the question is risen whether or not the COAS should go to jail - then whatever the Supreme Court decides is for all intents and purposes the word of god (in a manner of speaking) for all adherents to the constitution of Pakistan.

Its brinkmanship. Traditionally COAS ne jab jab Zardari ko ghoori maari hai, woh chup hogaya hai. This time around COAS thought he'd do the same but got a ghoori back.

Thats what's causing the stir.

At the end of the day there is only one thing that is more supreme than the supreme court - the public. COAS and CJ must remember that it is the only final arbitrator that can trump them all. I always disagree with the notion that COAS is over-reaching. He won't be this popular, this liked, if the final arbitrators were not happy with his decision making.

That is exactly why the SC must be very careful in selecting the grounds upon which any case is brought before it. The standards are exacting, and the results binding. Right now, the esteemed Court is losing its way on the first part, which makes the second part dangerous.

I think someone should advise this Moron CJ that the people who supported him and brought him to forefront are the same people who love their Armed Forces. I think the CJ's mouth is writing checks his body cannot cash. If he keeps badmouthing the Pak Army, the same people whose support saved his skin will hang him by his neck. Forewarned is forearmed.

That is what you are saying - but look at the reaction from the people. The biggest decision making this court has done has been on the NRO/Gillani issue and I don't see the people finding any fault with the Supreme Court.

Usually naysayers are also people in disbelief who think just because too much is happening it must be wrong. The courts MUST listen to all competent petitions. The courts have thrown out a whole lot of petitions as non-maintainable as I'm following it. Its not always actively seeking out cases. Its being having to prioritize them. But you have to admit, the people of Pakistan presenting their cases to the Supreme Court have various beefs with the institutions they are petitioning against. Whether these beefs are legitimate or not is the job of the Supreme Court to decide.

Sir, CJ is just one, the trend is in, his entire team is well worthy of praise and please don't blame our esteemed armed services for a cowardly, inhuman and pathetic terrorist attack.

I'm sure COAS is not in the business of terrorism - he is a professional and the product of one of Pakistan's finest institutions.

But two wrongs wont make it look good

Constitutional amendment requires 2/3 majority from a constituent assembly. An amendment to move against the CJ would find very few voters and we don't have a constituent assembly. Without such a constituent assembly any amendment can be thrown out by the Supreme Court too.
