سپریم کورٹ نے23فروری کو پاناما گیٹ پرفیصلہ محفوظ کیا تھا۔ بینچ کے مرکزی جج جسٹس آصف سعید کھوسہ نے کہاتھا کہ معاملے کی حساسیت کی وجہ سے مختصرفیصلہ نہیں سنایاجاسکتا۔ گزشتہ چندہفتوں سے بے چینی مسلسل بڑھ رہی ہے کہ اس اہم نوعیت کے کیس کافیصلہ کب سنایاجائے گا، حتیٰ کہ بڑی سیاسی جماعتیں شدت سے فیصلے کا انتظارکررہی ہیں تاکہ وہ سیاست کے حوالے سے اپنامستقل کالائحہ عمل وضع کرسکیں۔

سپریم کورٹ میں ذرائع نے ایکسپریس ٹریبیون کو بتایاکیس سننے والے تمام ججز سپریم کورٹ کی مختلف رجسٹریز میں ہیں، تاخیرکی اصل وجہ یہ ہے کہ ان جج صاحبان کی گزشتہ ہفتے میٹنگ نہیں ہوسکی۔ تاخیرکی ایک وجہ یہ بھی ہے کہ بینچ کا ہرجج کیس کی اہمیت کے پیش نظرلکھے جانے والے فیصلے میں ذاتی دلچسپی لے رہاہے۔

ذرائع نے بتایا عموماً ایک جج فیصلہ لکھتاہے اوردوسرے اس کی توثیق کرتے ہیں، لیکن اس کیس میں لارجربینچ کاہرممبراپناذاتی نوٹ لکھ رہاہے۔ 5 رکنی لارجر بینچ میں سے 3 جج جسٹس آصف کھوسہ، جسٹس عظمت سعید شیخ اور جسٹس اعجازالاحسن نے گزشتہ ہفتے لاہور رجسٹری میں کیس سنے۔ جسٹس گلزاراحمد کراچی رجسٹری جبکہ جسٹس اعجازافضل خان اسلام آبادرجسٹری میں بیٹھے ہوئے تھے تاہم لارجربینچ کے تمام ممبران آئندہ ہفتے اجلاس کریں گے۔​

Atleast i am expecting ke Sharif family ki honesty/dishonesty par kuch na kuch remarks zuroor honay chahyein....to pave way for disqualification of PM through election commission... And after Chairman NAB's statement, atleast there must be immediate suspension of PM..... Agar PM ke under hi commission ne kaam kiya..tu us se tu kuch bhi nahi hoga..

Iss tarha kafi faislon main hota hai, lekin yeh uss waqt hota hai jab sirf aik judge verdict ki kisi statement ko dena chahta ho, baqi nahi dena chahtay hon woh statement, tou woh judge phir apnay naam se statement deta hai... Normally, it happens when a particular judge wants to be too soft or too hard, and wants the statement to impact future decisions.

Iss ka aik matlab yeh bhi hai ke 3-2 ya 4-1 ka judgement hai, aur har judge apnay dissenting note ko justify kar raha hai..

Lekin I know for a fact ke abhi tak kisi ko kuchh nahi maloom ke judgement kia aarahi hai, phir iss article main judgement ke notes ka zikar kuch sach baat nahi lagti..

By the way, next week ka suna hai ke bench ke saaray judges ikhattay horahay hain Islamabad Registry main.. I think between Tuesday to Friday anytime, verdict aaraha hai..

ISLAMABAD: All five judges of the Supreme Court who adjudicated the Panamagate case will be back in Islamabad this coming week, raising expectations about the announcement of the much-awaited judgment reserved last month.

The top court reserved the verdict on February 23 with lead judge Asif Saeed Khosa observing that a short order was not possible due to the sensitivity of the case.

The past few weeks have made everyone, particularly politicians, very anxious as they are on tenterhooks waiting for the judgment to be announced. Politicians’ future course of action depends on the outcome of the judgment.

Lifting the lid on secret deals

All judges who heard the case were in different registries of the apex court. “[The] main reason for the delay is that these judges could not hold a huddle last week,” sources in the Supreme Court told The Express Tribune.

Another reason for the delay is that every judge on the bench is giving his individual input in writing, keeping in view the importance of the case. “Normally, one judge writes [a] judgment and his fellow judges endorse it. Here, every member of the larger bench is writing his own note,” the sources said. They told The Express Tribune that all members of the larger bench would hold a meeting in the coming week.

Last week, three of the five judges – Justice Khosa, Justice Azmat Saeed Sheikh and Justice Ijazul Ahsan – heard cases in the Lahore registry. Justice Gulzar Ahmad was sitting in the Karachi registry while Justice Ejaz Afzal Khan was in the Islamabad registry.

PTI to push for electoral reforms

Meanwhile, the Pakistan Tehreek-e- Insaaf has started showing concern over the delay in the announcement of the judgment. PTI spokesperson Fawad Chaudhry said that although they are aware that it’s not an easy task for the judges to give a verdict in a short period, the party believes that the verdict should be announced without further delay.

However, a senior PTI leader disagreed with the party’s reaction regarding the delay in the verdict.

Moreover, former Pakistan Bar Council vice-chairman Barrister Dr Mohammad Farogh Naseem rejected the PTI’s concern in this regard and said: “There is no delay in the verdict. Legally, the Supreme Court is not bound by any time duration regarding announcement of a judgment. However, the SC itself asked high courts to give ruling within three months after reserving it.”

“I have full confidence in every judge of the larger bench, as all are competent, and there is no doubt about their integrity,” he added.

Naseem said the judges write additional or dissenting notes in high-profile cases.The petitioners were unable to submit any document to establish that the London properties were directly owned by the prime minister.

For PM, offence is the best defence

However, the judges may raise a question about ‘conflict of interest’ in their judgment. “[The] chances of dissenting opinions on some points in the judgment cannot be ruled out.”

A senior official told The Express Tribune that the government has already devised different strategies to deal with any situation arising out after the judgment. Several senior members of the PML-N are admitting shortcomings in the legal strategy in the Panamagate case.

“I think the Sharif family did a big mistake by delaying the matter and not deciding on the Panama leaks controversy last year. Since April 2016, they had enough time to sort out the issue through various means but they unnecessarily delayed it,” says a member of the PML-N legal team.

I think unhon ne pehlay pakka karwalia hoga aur agar aisa hai tou buhat hi achi khabar hai hum sab ke liey..

@bold i am surprised why is he liked in GCC countries? I thought tht GCC would be pissed at him, for refusing to send troops in Yemen..because tht was the first time tht we refused Saudis... Although it was a parliamentary decision..but i think GCC would have known ke agar army chahti tu yeh issue parliament main jaata hi na...is liye i thought ke GCC main shayad Gen Raheel sharif ko pasand nahi kiya jaata hoga.. Esp...after there was coldness in relations between Pak and Saudis, after yemen fiasco..and UAE se tu bhtt ziada asar para relations par... So initially i was surprised when Saudis offered him the role..

But once this offer came, i was almost very sure ke kuch na kuch hoga..and eventually ye offer accept zuroor hogi....esp..after India was trying to forger closer alliance with GCC countries..
I also hope ke TORs accept hogayi hongi..Gen Raheel Sharif ki..and also i hope ye kuch aisi bhi deal /arrangement hui ho..Saudis se ...for financial help for Pak...for expensive military equipment
