That company is no angel either. It worked hand in hand with Zardari and co. There were most likely kickbacks involved. Pakistan should do everything in its power to make sure this company doesn't get paid...not to be dishonest about payments...but to send out a message to any company willing to act as an enabler for some corrupt asshole.

Imagine if such a precedent had been set already...where a company's millions of dollars worth of payment was withheld...then during Zardari era no company would have agreed to provide rental power plants despite Raja rental's plans. They would've been forced to actually build dams, or solar/coal/gas power plants rather than this joke of rental power plants.

In case if Pakistan loses and has to pay...then seize all assets of everyone that was part of the Zardari government(Zardari/Raja Pervaiz/Rehman Malik/etc.)...take everything away from them...every single penny...and if it's still not enough then hang these mofos as punishment for the nation having to pay.

This is the fault of the Supreme Court too! On what ground did they restrict the ship from generating and supplying energy even if it was at a rate higher than norm, did they not have common sense? The ship is fueling itself on air or what? The restriction caused the ship to stay there for months, not doing anything, not earning anything and so in turn causing heavy costs for company due to fuel and maintenance. Even if the rate was higher at norm, Supreme Court should have some common sense and realize that there is a contract between the Government and the company, we MUST fulfill the contract otherwise we will risk getting sued by the company and in the long run be having a loss of many folds! But alas, courts of Pakistan are useless, they only know how to think short term, find fault everywhere except their own courts which are the most dysfunctional and corrupt, and are only there to place unrealistic measures and to attain quick fame.

Also, Pakistan was at fault here due to breach of contract for which the company had suffered. Pakistan should have right at the moment tried to negotiate and strike a deal with the company outside of court, I don't understand why they didn't do this even when the company sued Pakistan, this arrogance and ignorance by the state has to stop, they need to start taking contracts and commitments seriously otherwise you can't expect any foreign investment.

Pretty sure Judiciary is at major fault here for disallowing the fulfilling of contract. Lets hope nothing too bad comes out of Reko Diq case that's also thanks to Judiciary, otherwise we can be looking at greater than $11 billion in fines.

Though I haven't read a copy of the full statement of the court's decision I assume that being the Supreme Court...they didn't just stop the company from generating power and having their ship just chill...all just bcuz they felt like it. Even if we consider it a dumb decision...it must have stood on some legal footing...like as the article says...that they didn't generate as much electricity as per the contract...and sold it more expensively...etc.

This is where the governments of Turkey/Pakistan and the other governments this company is trying to rally(Germany and others) to seize Pak's assets...all these gov need to band together and realize that this company together with another corrupt person(with his whole group) planned a sham together. A sham with which to siphon a sovereign country's money. Yes Pak is responsible for electing these fucks...and yes these traitorous scums are responsible for making such corrupt decisions...but companies like these share the blame equally.

If these governments don't band together and show such companies the door...then today it might be Pak that'll bear the brunt...but tomorrow it can be them. It will set a precedence where a private company can sue a government and win and seize its assets.

What's legal isn't always right. There are multimillion dollar companies that are known as "patent trolls"...all they do is create vague obvious patents...and when they find the slightest of similarities(due to their patents being so broad in nature) with any company's products...they go after them and sue them. That's literally all there is to their business model. They've gone after companies as big as Apple, which actually spends quite a bit of money on its R&D. It's insanely obvious that Apple most likely developed(or bought) the tech its using(including its patents) as compared to a patent troll...but legally speaking...the patent trolls can and have gone after actual companies doing the actual work.

Laws are made to keep humans in check...to set boundaries...but the ever crafty humans find ways to abuse these laws to their advantage. If "lakeer k faqeer" courts/judges/legal systems keep following those laws that someone is using for their advantage then it allows for abuse and defeats the entire purpose for which laws are enacted. This is why laws require constant change and sometimes whole new laws must come into existence for situations that have never presented themselves before.

IMO allowing a private company to go on equal footing with a government is setting urself up for eventual abuse. There are endless examples from the colonial era of this...blood diamonds, East India company, etc.

There should be laws passed that allow only for government to government deal to be valid and recognized internationally. Private companies can choose to still not involve their own country's government and do business directly abroad...but if shit hits the fan then they are all on their own...any contract they have will only hold weight in the said country's(not the company's own country) courts. In that case if it's a big contract it will have to be between two governments...which will make it slightly less prone to abuse since governments are usually giant behemoths of bureaucracy. It will also allow more ways than one to solve any issues like this. Money is just one way(which is the only way for a private company to settle things)...with countries, diplomacy, trade and other dealings can be made to compensate the party that was done wrong.

And if you don't have such a clause, then sue the company in international court, the contract is between an international company and the Government of Pakistan, the breach of contract cannot be dealt with under Supreme Court of Pakistan.

There is a reason for this which is far from your thick head. The government did not do anything because it was going to hurt Pakistan and then the government could say it was the courts fault, for stepping in between two parties even if the cost very high they were still less than what the court got with litigation (Only small minded uneducated people do such petty things and these are the type of politicians that we have). This is the same with Reko Diq case which the Zardari government refuse to bear the risk of. In that case some guy in the caretaker government sold the mines for a small stake and royalty. There was no transparency and collusion was involved with Antofagasta and the Chilean government. So far the government has done nothing, the claims could be upto 11 billion even though only a feasibility was done and a shell company exists on top of that the company is not willing to go it wants to take the gold out of Pakistan.

Did you read the other parts of the reports? The company has went to UK, US, TUrkey and Germany to have this ruling implemented. That mean Pakistan govt assets in those companies can be confiscated and returned to that company. It will even go to IMF. Credit rating agencies will make hell for Pakistan making loans very very costlier for companies trying to get loans to invest in Pakistan and for Pakistani companies.
