Pakistani man arrested for buying land in India

A Pakistani national in his 70s who has been extending his Indian visa for decades has been arrested here on charges of buying land in violation of law, police said Thursday.

Mohammad Idrees was taken into custody in Nahal village where he had been living with his wife and where his family possessed movable and immovable assets including land.

And although a foreigner, he managed to get for himself an Indian voter identity card. His two daughters, born in India, are married to Indian citizens in Delhi.

Idrees told police that he was born in undivided India in the 1940s. He was five or six years old when his father, Nazar Mohammad, took him to newly-formed Pakistan in 1947.

Idrees returned to India on a Pakistani passport when he was 18 years old, he told police.

His relatives returned to him his ancestral farmland which he began cultivating unaware of laws as he was uneducated, police quoted him as saying.

About 30 years ago, he was deported to Pakistan but returned on a valid visa. He kept getting regular extensions to stay in India.

His latest application for extension of visa was pending with the home department, Idrees told police.

"Being a Pakistani he can't buy property but he bought agricultural land. When he came to know about the law, he transferred the property in the name of his children. He obtained a voter ID during his nearly 60 years of stay in India. So he has been arrested," said police officer Shiv Singh.

"He is entitled to stay but his fault is he bought property in violation of rules," the officer added.

Well that was an age old mentality .We should abstain from harassing that man .He did an unlawful act ,but I dont think this old man is a threat to our national security
Well he may not be a threat ,but i guess they will have to take the legal course of action,let the court decide.i guess its better if the court let's him go.but still sad part is how can someone easily accuire a land in India.

I guess you have never been to a registrar office. If you throw some money they will create a sale deed for Taj Mahal.:D

While I agree with you that this old man should not be harassed but at the same time we have to remember that law must be equal for all. This man, being a Pakistani has violated Indian law by buying Indian property and if law applied to him can not be made lenient on the basis of his age.

I dont meant that .Law should take its own course .
But heavy handed style should avoided means, dont handle him like a spy .That man consciously violated our laws being aware about his own Pakistani passport ,he might thought that our agencies would ignore that.And that is backfired.

That is not the really funny part, the fact that this dawned on them at his ripe age of 70 considering he has been in India since 1954.. and with a valid visa since 1980. Kind of late to the party is it not. He has lived his life anyway and perhaps was only consolidating his retirement abode.

The man should be regarded as a naturalized Indian. He is 70 years old having lived most of his life in India. His kids are married to Indian citizens. His life is practically India. And he gets arrested by India at the age of 70 for returning to his roots, living there for dozens of years without causing any trouble and building up India by engaging in constructive enterprise ? I cannot imagine a more unjust and inhumane manner of treating a senior citizen than this

Agreed what you said. A little familiarization to typical Indian system of bad governance, loop holes in the laws and a little bit bribery can get you everything you want. Unfortunately the poor man have to bear all the heat at this age.

Unless he has officially applied for Indian citizenship he still remains as a violator of the law,Isn't it? On humanitarian ground no body can accept his punishment as justified but at the end of the day it is the law that has the last words.

may be it is our mistake but it is too late now to take action.. He is uneducated. . not aware of rules..

Well, the illegalities have a habit of catching up with you at the most inappropriate times. Unfortunately, there is no statute of limitations on this illegality so the tenure of this wont help him much. Its times like these, when the statement "ignorance about the law is not a valid excuse for breaking it" seems a little unfair.
