Parliament is Supreme but still under Constitution

That is the recent discussion yet it is not.

Infact the nature of the constitution of 1973 was based on the principle of trichotomy of powers whereunder all the three organs of state, namely the judiciary, executive and the legislative are required to perform their functions and exercise their powers within their allotted sphere.

Although article 238 and 239.5 and 239.6 does grant parliament the power to amend the constitution however the cases of PLD 2015 SC 401 as well as the restriction of article 8 as well as the restriction of islamic nature of laws brings to question the supreme authority that the parliament propagates. Infact if you read the constitution it seems the only being supreme is GOD and the only thing supreme is the constitution.

Supreme means something that has top authority.

Black's LAW dictionary defines supreme power as "the highest authority in a state, all other powers in it being inferior" yet the constitution by its nature is trichotomy of powers under the supremacy of the constitution and the restrictions of judiciary, both supreme and federal shariah court, brings to question if the parliament truly is supreme or is it an illusion....


This decision is lending aid to the point that parliament is not supreme and is not sacrosanct.

All of this is not a bad thing. The evolution and the defining of the constitution is a good thing and a much necessary process in the democratic history of state of pakistan.
