It only took him about 2 and half years but it seems Modi is finally getting his Pakistan policy right. This is what I was expecting from him right from the beginning and not shaadi and b'day parties in Pakistan or inviting Pakistanis to an IAF base. Now I hope there is consistency in this position. There can be no friendship with Pakistan as long as PA controls the country because their rozi-roti depends on enmity with India. The sooner we realized that the better. I am fine with people to people contact and all that but at government level we should have a clear, consistent and strong policy.

The time has come to expose Pakistan’s brutalities on the people of Balochistan and Pak-occupied Kashmir (Azad Kashmir), Prime Minister Narendra Modi said on Friday as the government launched a fresh offensive against Islamabad for fuelling the latest unrest in Kashmir.

The government found support from all major parties at a meeting called to discuss the violence in Kashmir that has left at least 59 people dead, most of them civilians, in the valley since July 9.

Modi said the government will reach out to the alley but added that Jammu, Ladakh and Azad Kashmir should also be said in the same breath when talking about Kashmir, endorsing the views of Congress leader Karan Singh.

All parties unequivocally supported the government’s decision to aggressively expose Pakistan in international forums.

Modi and foreign minister Sushma Swaraj said the government will also get in touch with people who have fled Azad Kashmir.

“Pakistan has forgotten that it bombards its own citizens from fighter planes. Time has come for Pakistan to give answer before the world on the atrocities committed against people in Balochistan and Pak-occupied Kashmir,” the PM said.

The government said an all-party delegation to the valley may be considered after the situation normalises.

“Political outreach is already happening. There will be no lowering of guard as far as security is concerned. Forces will act with restraint but terrorism and violence will be dealt with. We will try and ensure normalcy returns as fast as possible,” finance minister Arun Jaitley said after the meeting.

During the consultations, former Prime Minister Manmohan Singh said the Centre “must do everything to defuse the present tension and it should also be seen as a caring government.”

Leader of Opposition in Rajya Sabha Ghulam Nabi Azad talked about the “brain drain” in Kashmir since 1990. “Not only Kashmiri Pandits left, but Muslim intelligentsia also fled, leaving a vaccum,” he said.

Trinamool’s Sudip Bandopadhyay felt that Kashmiri youth are in search of a new leadership.

BJD’s Lok Sabha leader Bhartuhari Mahtab said that political leadership should be more active and local parties should speak in one voice. Samajwadi Party leader Ramgopal Yadav also demanded a common voice in all parties and said, “China is actually the main culprit.”

JD(U)’s Sharad yadav insisted that the government should talk to Kashmiri youth as “they are our children” and sought a ban on use of pellet guns by security forces, blamed for eye injuries to a large number of people including minors.

The Shiv Sena, however, favoured continuation of pellet guns.

CPI(M) chief Sitaram Yechury said a National Human Rights Commission team should go to Kashmir.

“Mr. Prime Minister, you have a hotline with the Pakistan PM. Why don’t you talk to him on this issue?”

Satish Mishra of BSP asked for regulation of electronic media in Kashmir coverage, Asauddin Owaisi of MIM demanded people-centric solutions and a ban on visits by human rights bodies to the Valley.

DMK’s Kanimozhi said there should be no engagement with other countries and PDP’s Muzaffar Hussain beg pleased for no use of pellet gun. “This unrest is different from 2010. People from rural areas coming to streets,” he said.

TDP’s YS Chowdhury, a new minister, came out with the idea of using drones to keep a tab on Kashmiris and identify the trouble-makers.

Balochistan: 'Hundreds of people abducted and murdered by Pakistan army' activists warn

Baloch activists are urging rights groups and the international community to pay attention to the situation of people living in the Balochistan province, western Pakistan.

According to some members of the Baloch Republican Party (BRP) – a democratic and secular organisation that aims to repel Pakistani occupation and regain sovereignty in Balochistan –Balcoh people are persecuted, abducted and systematically killed by Pakistani security agencies and the Pakistani Army.

Ashraf Sherjan, president of the BRP Germany Chapter, has warned that Balochs are haunted by what he calls "Pakistani kill-and-dump-policy intelligence agencies and armed forces."

Speaking to IBTimes UK, he said: "Since Balochistan was forcefully occupied by Pakistan, Baloch people have been living as guests of death.

"It has never been considered, even outside Pakistan, that Balochistan belongs to the Baloch people who are now haunted. Baloch leaders are being deliberately assassinated by the occupying state of Pakistan for demanding rights to their own land.

Sherjan then cited the case of Baloch leader Shaheed Nawab Akbar Bugti, who was attacked and killed along with his tribesmen in 2006.

Balochistan history

Balochistan, a large area bordering with Afghanistan to the north and Iran and the Arabian Sea to the south, is inhabited mainly by Baloch, Pashtuns and Brahuis, and smaller communities and tribes such as Iranian Baloch, Hazaras, Marri and Bugti.

Balochistan was invaded by Britain in 1839. As a result of the invasion hundreds of people, along with the then Baloch ruler Mir Mehrab Khan, died.

Balochistan was then divided into three parts: Northern Balochistan and Western Balochistan were given to Persia and Afghanistan respectively, and Eastern Balochistan was under British rule until 1947.

After the British left, Balochistan was annexed to Pakistan. According to some, the then ruler Khan of Kalat was forced to sign accession documents despite a previous document recognising the independence of the Baloch people which had been signed by the British, Balochistan and the upcoming Pakistan administration.

Since then, separatist groups demanding independence have engaged in armed struggles with the Pakistani government.

During an armed struggle erupted in 2004, Balochistan's leader Nawab Akbar Bugti was killed by the Pakistani government, which accused him of being a warlord and using the Balochistan Liberation Army as a facade to run his own militia.

His murder prompted unrest in the area with thousands of students from Balochistan University and other locals rioting, sparking fears that the then Pakistani President Pervez Musharraf would be targeted with attacks in retaliation.

"It would take days to mention the names of the thousands of Baloch political activists, leaders and students who were killed," Sherjan said.

Black month

Baloch activists refer to March as a "black month" for Balochistan history as in two separate occasions during the month, Balochistan was first invaded and then bombarded.

"On 27 March 1948 Pakistan invaded Balochistan and coerced the Baloch ruler to sign a so-called 'accession treaty' after the Baloch Parliament had rejected the offer to join Pakistan on the basis of shared religion," Sherjan said.

"On 17 March 2005, Pakistani paramilitary forces bombarded the entire city of Dera Bugti. More than 70 people, the majority of whom were women and children, were killed and nearly 200 were injured."

People abducted and killed

In 2011, Human Rights Watch released a report documenting rights abuses committed by the Pakistani government against people in Balochistan.

The group urged Pakistan to end "widespread disappearances of suspected militants and activists by the military, intelligence agencies, and the paramilitary Frontier Corps in the south-western province of Balochistan".

The report detailed 45 alleged cases of enforced disappearances – the majority occurred in 2009 and 2010 – and warned that some of the people who were abducted were also executed.

According to Sherjan, the policy of abducting and killing Baloch people still continues today.

"Many bodies have been found with amputated limbs in various areas across Balochistan and in Karachi. This inhumane practice continues to date and families of enforced-disappeared Balochs report that more than 20,000 Balochs have disappeared since current Pakistani President Pervez Musharraf took power in 1999," he said.

"In January 2014 three mass graves were discovered in the Tootak area of Khuzdar district in Balochistan. The graves contained at least 169 bodies. Only three of the persons have been identified as previously abducted persons who were picked up from their homes by Pakistani paramilitary forces.

"The rest of the bodies could not be identified because they were mutilated beyond recognition. The military quickly cut off all access to the graves and took control of the remaining bodies so no further forensic identification work was possible."

Sherjan also urged the Norway government and the international community to shed light on the fate of Ehsan Arjemandi, a Norway national allegedly abducted in 2009, while he was on his way to Karachi from Balochistan.

"He has not been heard from or seen in public since then. The Pakistani intelligence service, the ISI, is believed to be responsible for the abduction. I urge the human rights organisation including the European Union and United Nations to take notice of Balochistan's situation and play their moral role in ending human rights violations before it's too late."

Asian Human Rights 2016 report on the police prosecution In Gilgit Baltistan Pakistan

Police excesses and torture are not a new phenomenon in urban and remote regions of the country. A relatively peaceful and serene Chalat Bala District, Nagar Gilgit Baltistan region, has been chaotic since the establishment of the Chalat Police station. Instead of maintaining peace and order, the police officers have reportedly been extorting bribes from local residents.

Recently a case of police torture was reported in the vernacular press. The victim, Mr. Shabbir Hussain Son of Jaffer Ali, resident of Chalat Bala district Nagar, was beaten with severe bruising for refusing to heed a Jirga verdict. Mr. Hussain had a dispute with his cousin Fida Ali on the use of common space between their houses. While Mr. Shabir was in Dubai, the dispute was presented before a Jirga of local elders who ruled against him.

Because of the Jirga verdict, Mr. Shabbir was required to make major changes inside his house. This took time, infuriating Fida, so he lodged a complaint at the Chalat police station. According to the police account, Mr. Shabir was asked to visit the police station a number of times. He refused to oblige. On 26th June 2016, the police invaded his house. He was arrested without a warrant, taken to the police station, illegally detained and beaten with long sticks by Constable Iftikhar and Station House Officer (SHO) Iqbal.

At the intervention of local notables, he was released after being in remand for a day. No FIR has been lodged against Mr. Shabbir, yet he was tortured and detained for interrogation at the Chalat police station.

In the Gilgit Baltistan region, performance of law enforcement agencies is said to be very poor. There are no adequate checks and balances on society on the part of the government. As a result, police officers do not follow the rule of “no torture” during an investigation. Both police officers and/or magistrates do not follow the rules for remand. Most officers are not capable, having insufficient background in the law.

The police are entirely handling the prosecution department in Gilgit Baltistan. This means, that not only is torture not reported, it is never prosecuted. As police officers prosecuting cases in court are ignorant of the law, many criminals are acquitted. A number of District Magistrates of the Chilas district lament that the police have complete impunity and are not answerable to anyone. “The magistrates cannot prosecute or even order actions against an officer who transcends his duty during an investigation.”

Torture is not considered a crime--even victims think it is a routine matter and do not report it.

It is a sad reality, that under the archaic colonial system of policing, police stations have become bastions of crime and criminals. A region, which had been peaceful, becomes crime infested as soon as a police station is established. Harsh incidents of police torture are still a rarity yet the trend is increasing.

Baba Jan, a prominent frontline activist from Gilgit Batistan had been tortured continuously for two years while in Gilgit Baltistan police custody. The AHRC has raised the issue of torture in several Urgent Appeals. ( AHRC-UAC-070-2012 and AHRC-UAU-026-2014 )


Article 14 of the constitution recognizes and protects the dignity of the citizen, prohibiting the use of torture by law enforcement agencies. The police who are duty bound to protect citizens cannot be allowed to perpetuate acts of torture upon persons in their custody. Their primary duty is to detect crime, bring the criminals before a court of law and not to punish them.

The Gilgit Batistan region is not represented in the constitution of Pakistan. The state asserts its power through law enforcement agencies to subjugate the populace who do not have any fundamental rights under the de facto administration. The victims of torture have no right of reprisal and thus suffer in silence.

Due to the lack of legislative apparatus and non-representation at the national assemblies the people of Gilgit Baltistan are left without a voice. Their demands for justice are unheard and unheeded. The local administration is not unable to rein in the law enforcement agencies who have been allowed unbridled power by the state under the guise of law and order.

The Asian Human Rights Commission urges the state to take stern actions against the erring police officers for exceeding their authority and torturing an innocent man. The state must establish and implement accountability and a checks and balance mechanism to ensure, that incidents of police excess do not occur. Investigations and prosecutions of crimes must be conducted under the aegis of the rule of law.
