India reject gilead hepatitis c drug patent from US base science Gilead drug company

Indian courts in past have clearly mentioned in their similar verdicts earlier that they won't allow such practices as far as healthcare goes bcz saving lives and proper treatment shouldn't be limited to ultra-rich and rightly so. To hell with those companies, in India play by our rules or one could just buzz off !!

Patent violation by India drug industry, just because India couldn't afford the drug from the US, India can't just stole from the US to produce the generic drug to sell to the Indian. I thought India high court protect the copyright law. They should force India to pay the patent fee to the US drug compay.

India drug company didn't spend a penny in on the drug research, stop your bullshit about India do the world a favorite by stole the patent from the US company to lower the price of the India generic drug to sell to the 3rd world nation, India didn't spend 100 of millions dollars in search for the drug therefore India still rack in 100 of millions dollar profit at the knock off price. Since India didn't invest in the drug any sell from the drug already 100 percent profit. Stop acting like a Robbin hood stole from the rich to help the poor. A law should never be partial or bias, when a court enforce any patent law the court should apply to all on the equal basis, can just pick and choose to which patent product India court to decide to enforce. A farce justice system pick and choose to be impartial to benefit it own people.

The issue is applying for new patent rights on current drugs where the drug in used today is shown as the active ingredient of a new drug ( it is essentially the same drug but packaged differently ).

There is no innovation here, but just clever moves to hold onto the patent and stop generics from entering the market.

There was no violation idiot. And the scientist did not hail the decision because it was good for 3rd world nations but because it was just plain evergreening. An advanced panel sat and came to the decision that the '"minor changes in the molecule" did not improve efficacy of the drug.' and so the patent would not be reviewed. Courts in many countries have come under fire for allowing this evergreening due do the funding and pressure by big pharma company.

The idea of a patent is to help the company which invested millions on a research to take advantage of their research by having a monopoly for a limited period of time. But after that period of time it becomes an open market. What these pharma companies does is that they file for a renewal of their patent just before they expire claiming that they have changed the formula and increased the efficacy of the drug. This way the pharma companies keep on making unfair profits. This process is called evergreening. Do you think evergreening is fair?
