From criminal record perspective, if you have been actually convicted in a crime, you can not contest election. If there are any cases pending, but not proven yet, you can. Advani, modi etc just have cases against them, no court has convicted them yet.
Personally, this does not make sense to me. The rules have to be re-written. If a person has 2 more more grave cases against them, they should be barred until they are acquitted. Given the slowness of Indian Judicial system, some cases run for years and criminals end up contesting elections.
I disagree sir, the answer is to improve the law and order, law enforcement and conviction rates. police reforms is a must. This is the issue, not the principle of 'Presumed innocent until proven guilty'.
