What a shameful incident for Canada. :rofl: First accused India, now trying to run away from the incident with 'damage control'. Thats the real power, India is rising, all these are sings of that. People will be more and more jealous but take a stick, everything is good again. :lol:

In an attempt to control damage caused by stinging remarks by one of its diplomats against BSF, Canada on Saturday said it has "great respect" for India's armed forces and that it was "reviewing the situation" that has arisen.

Canada's Foreign Ministry spokesperson Catherine Loubier said in an e-mail statement that "vibrant people-to-people" connections are one of the "greatest strengths" of India-Canada relations which continue to be strengthened.

"I would like to stress that Canada has the highest regard for India's democratic institutions and processes.

Canada has great respect for India's armed forces and related institutions," she said in the statement mailed to PTI.

The statement came in the wake of revelation of remarks of a First Secretary of the Canadian High Commission in New Delhi that BSF was a "notoriously violent" force which indulged in "systematic attack" and "systematic torture" of suspected criminals.

The diplomat had made the comments while rejecting the visa application of a retired BSF constable.

The External Affairs Ministry has already taken up the issue with the Canadian government. "We are reviewing the situation," the Canadian spokesperson said but did not elaborate citing "privacy reasons"

Loubier said India is a country with growing influence on the global stage and "our past has been marked by friendship and by strong ties that bind us closer than ever. We are also democratic nations that are ethnically, spiritually and linguistically diverse."

She noted that the Indo-Canadian community is approximately one million strong and makes significant contributions to the strength of Canada's economy as well as to people-to-people links between our two countries.

The Canada-India ties continue to strengthen following the very successful visit to India by a strong delegation led by Prime Minister Stephen Harper last November, she said.

With regard to visas, Loubier said decisions are made by public servants following an independent process governed by the Immigration and Refugee Protection Act.

I don't see Canadians backing off yet.

According to the letter they ban people that falls under certain classes. I do agree with the spirit of the letter, BSF is essentially bunch of murderous thugs unleashed by Delhi.
 
BSF has been killing Bangladeshi civilians almost every other day So did in other borders in india. Not only that BSF has been proven to torture and kill indians as well. Canadians are only recognizing that fact and should provided with all brutality and killing by BSF.

Just beacuse indian can make loud voice about this does change the real facts in the ground. Rather screaming at Canadians and talking about doing this and that india should correct itself.

All of the Bangladeshis killed by the BSF are smugglers. BDR killed more people during the coup but it seems like Canada don't even recognize them as a force. :confused:
 
I read the news story , them are accusing BSF of human rights violations in Kashmir. Certainly there are some human rights violations in kashmir , but almost all of them are committed by the CRPF. BSF , as to my knowledge is only based in border areas and kills militants and smugglers that truly deserve to be killed. If it was a CRPF personnel that was refused a visa , i wouldn't be surprised , but BSF has a fairly clean record and has done great things for the nation.

The Asian Human Rights Commission (AHRC) has received information from its local partner in India, MASUM about yet another brutal killing by the Border Security Forces (BSF) at the Indo-Bangladesh border. According to the information received Mr. Saifuddin, a farmer was forcefully taken into custody by the BSF officers on 1 June 2006, beaten brutally and later shot at close range with a light machine gun for protesting against the officers engaging and aiding cross-border smuggling. It is also alleged that the BSF later filed a false case against Saifuddin at the Raninagar police station, where Saifuddin was charged with several offences including preventing the BSF officers from discharging their duty.

On 1 June 2006 at about 8 p.m., Saifuddin was going to his paddy fields. On his way he witnessed officers from the BSF helping cross-border smugglers. Saifuddin raised his voice against the officers and the smugglers protesting against the officers and them helping the criminals. Hearing Saifuddin’s protest Mr. Sukhen Kumar Mondal a BSF officer took Saifuddin into custody and started beating him with sticks. It is alleged that there were also other officers of the BSF who joined Mondal in the assault against Saifuddin. The officers pinned Saifuddin to the ground and continued assaulting him. When Saifuddin was unable to move, Mondal shot Saifuddin with a light machine gun killing Saifuddin immediately. It is alleged that the officers were from BSF out-post number three and four of Kaharpara BSF camp, serving with 136-BSF battalion, stationed at the Indo-Bangladesh border in Murshidabad district, West Bengal.

The officers later took Saifuddin’s body to the nearest BSF camp. From the camp they collected four cows, one pair of sandals and a towel and produced them along with the body of Saifuddin at Raninagar police station. It is alleged that the cows, sandals and the towel were seized from some cross-border smugglers earlier. The officers also lodged a complaint against Saifuddin at the police station alleging offences under Sections 147, 148, 149, 353 and 307 of the Indian Penal Code, which the Raninagar police registered as case number 112/2006.

The AHRC is informed that BSF officers often aid cross-border smugglers activities at the Indo-Bangladesh border and share profits from the illegal trade with them. The most common commodities smuggled from India to Bangladesh are cattle, medicines and food grains. The BSF is posted at the border to prevent this illegal trade. However, the officers connive with the smugglers and help them transit their commodities in the cover of darkness. The BSF also keep a few cattle and other articles commonly smuggled across the border in their camp to produce them once in a while as seized articles from the smugglers for their record. The local farmers like Saifuddin suffer huge damage from this trade since the movement of cattle destroys their crop.

Coming to know about Saifuddin’s death, his wife Mrs. Mursida Bewa filed a written complaint at the Raninagar police station against the BSF officers. It is alleged that even though the complaint was filed on 3 June 2006, the police are yet to take any action on the complaint. Before releasing Saifuddin’s body to his family, an autopsy examination was conducted at Lalbagh Sub-Divisional hospital on June 2. Other relevant facts:

The AHRC in the recent past has been calling upon the authorities in India, particularly the Commanding officers of the BSF and the West Bengal State Government authorities to intervene in cases of killings reported from the Indo-Bangladesh border. The AHRC has reported many cases in the recent past where similar incidents of murder were reported from West Bengal. For further information please see UA-244-2006, UA-225-2006, UA-184-2006, UA-174-2006, UA-146-2006, UA-217-2005, UA-79-2005, FA-04-2005 and UA-18-2005. In at least four cases the incident happened within the jurisdiction of Raninagar police station.

MASUM, after their investigation into these cases and also after interviewing local persons, is of the opinion that the police officers posted at Raninagar police station are at fault for not taking any action in any of the cases reported at this police station. The local persons allege that the police officers stationed at Raninagar police station also connive with the criminals engaged in cross-border smuggling and the BSF officers who protect them.

In all of the above cases a consistent pattern of the chain of events could be noted. In each of these cases, the deceased, often a farmer is taken into custody, beaten up and then shot at point blank range by the BSF. The body is later produced at the same police station – the Raninagar police station – and a case registered against the deceased. In most cases the charges are under a few select sections of the Indian Penal Code. The police never initiate any action in these cases.

The AHRC has also observed that in many cases the victims fail to report the case with the police fearing repercussions from the BSF. It is also evident that since the local police are not initiating any action upon the complaints filed by the relatives of the victims, in cases where they dared to lodge complaints, the victims’ families failed to report cases.

The Asian Human Rights Commission (AHRC) has received information from our local partner organization Manabadhikar Suraksha Mancha (Masum) in West Bengal, India, regarding the gang rape of a woman, the attempted murder of her and one of her daughters, the murder of her husband and other daughter, the complete break-down of the rule of law and the callous and inhuman attitude of the Indian judicial system that has seen the victim and her surviving daughter placed in jail for the past two years.

Joyeeta Bala Das and her family were taken captive in January 2003 by Border Security Forces (BSF) near the India/Bangladesh border. After gang raping Joyeeta Bala Das, the BSF then forced her and her family onto a damaged boat, which upon sinking led to the death of Joyeeta Bala Das’s husband and eldest daughter. Joyeeta Bala Das and her youngest daughter survived and then attempted to seek justice for their perpetrators crimes. However, BSF authorities have continued to maintain that the actions of BSF personnel are an entirely internal matter and therefore they cannot be charged by the police or taken before a court of law. When Joyeeta Bala Das attempted to do so, it was she who was sent to jail, supposedly for ‘safe custody’, while the perpetrators were allowed to remain free.

Joyeeta Bala Das and her four-year-old daughter have now served two and a half years in the Presidency Jail in Kolkata and therefore it is only they who are being punished for the BSF personnel’s actions. That a victim of gang rape and attempted murder who has also lost her husband and daughter can be jailed while the perpetrators remain at large, is a situation that is entirely incomprehensible. That a four-year-old girl could also be imprisoned for this same amount of time, only adds to the tragedy of this case.

We call for your urgent intervention in this matter. Please write immediately to the Governor of West Bengal, Mr. Gopal Krishna Gandhi and other relevant authorities listed below demanding them to take genuine and direct steps to have Joyeeta Bala Das and her daughter removed from jail and their personal security ensured. A full and thorough investigation should be conducted into this matter and charges laid against persons found to have had involvement in the alleged crimes. If found guilty in court, such persons should be fully punished according to law. The investigation should also look into the claim that the Basirhat police never filed charges against the perpetrators, and as to why proper legal representation was never afforded to Joyeeta Bala Das.

Case details:

In January 2003 (actual date not known), Joyeeta Bala Das was returning to her village from Bangladesh, along with her family members, when they were stopped by a Border Security Force (BSF) patrol at the border and taken to the office of the Assistant Battalion Commandant at 122 Battalion Outpost under the jurisdiction of the Basirhat police station, 24 Parganas (North) District, West Bengal. There, in the room of the said officer, Joyeeta Bala Das was allegedly gang raped by the above mentioned perpetrators, as her husband and daughters were forced to watch.

According to the law, Joyeeta Bala Das and her family should have been handed over by the BSF to the local police. The BSF however, did not do this. Instead, Joyeeta Bala Das and her family were held captive by the BSF for several days. They were not charged with any crime, nor were they able to submit their own complaint regarding the gang rape against Joyeeta Bala Das.

The BSF then forced the entire family onto a severely damaged boat and sent them off on the Ichamati river, back in the direction of Bangladesh. However, the boat had not gone far before it began to sink. As each family member had been tied to the boat, with the obvious intention of having them drown, as the boat began to sink the victim’s husband and one daughter could not free themselves and therefore drowned as the boat went down. Joyeeta Bala Das and another of her daughters however, were able to free themselves and swam to the bank of the river.

The following morning local villagers came across the bodies of Joyeeta Bala Das and her youngest daughter. Though they were still alive, both were unconscious. The villagers took the two to a local hospital for medical attention and Joyeeta Bala Das was further examined to medically confirm the rape.

The Basirhat police then apparently attempted to investigate the matter by confronting the five accused BSF personnel. However, the BSF authorities did not allow the police to do this, stating that it was not within their jurisdiction to do so. The matter, they said, would be dealt with by the BSF.

The Criminal Court then ordered the arrest of the accused BSF personnel. But the BSF personnel appealed this decision in the High Court of Calcutta and the appellate court passed an order of stay, which is still in effect today. Likewise, the appeal pending in the High Court has yet to be heard. As a result of this failure by the High Court to properly pursue the matter, the alleged perpetrators remain free and have yet to be formally charged.

Meanwhile Joyeeta Bala Das, immediately following this incident, filed a First Information Report (FIR) with the police. The matter went before the Sub Divisional Judicial Magistrate in Bashirhat where the case was to be heard. However, as the BSF maintain that they are their own authority to investigate such matters, the five accused did not appear before the court. Only Joyeeta Bala Das and her daughter showed, and then, in an absurd change of events, it was they who were sent to the Presidency Jail, supposedly for ‘safe custody’, not the perpetrators. Joyeeta Bala Das and her four-year-old daughter have now been imprisoned in the Presidency Jail since 14 January 2003. In the past two and a half years, she has appeared before the Basirhat Court only twice. Though aware that she and her daughter have been imprisoned unfairly, Joyeeta Bala Das is also too afraid to leave the prison for fear of what the perpetrators may do to them. For this reason, it would seem that Joyeeta Bala Das and her daughter may remain in the Presidency Jail indefinitely.

It has since been discovered that the Bashirhat police station made no charge sheet against the perpetrators. Masum also asked Mr. S.K. Das, the Duty Officer of the Presidency Jail if they could meet with him and the victim, but this request was rejected.

At no point throughout this ordeal was a lawyer assigned to Joyeeta Bala Das. However, the jail department apparently now intends to request the law department to assign a government lawyer to her. Mrs. Bharati Mutsuddi, a member of the West Bengal State Commission for Women has promised that she will look into the matter as it is a gross violation of human rights.

This incident highlights the complete failure of the rule of law in the state of West Bengal and the complete lack of competence and willingness to assist by those authorities invested with the power to protect and seek justice for Joyeeta Bala Das and her family.
