Do you support the notion of bringing the culprits to justice?

Some thing is better not to stir for greater good. This has been a dead issue and no need to bring it to the surface for political purpose. The nation has been divided on this issues since the separation thus it's not interest of the country to take this task at present time. Awami doesn't have the moral authority to this as their hand is full of blood. I am not worry about the dead as they already went to after life. Let all mighty Allah take care of them. I am more interested to take care of the living and needy who desperately need help to get better life. Only way we can do this is leave this stained past behind and move forward toward better future for generation to come. As old generation on the way to go to next life thereby let new generation of BD and Pak worry about this issue and India should stay away from this to safe distance.

Freedom fighter sues 13 for 1971 killings

Dhaka, Apr 30 (bdnews24.com)—A freedom fighter filed a case Thursday against 13 people including a lawyer and a former Union Parishad chairman on charge of killing over 500 people during 1971 war.

Sheikh Alauddin, who fought during Bangladesh's war of independence from Pakistan, filed the case with the Natore chief judicial magistrate's court.

Magistrate Md Sharif Uddin ordered Natore Sadar police chief to take proper steps after investigation.

The accused are lawyer Abdul Kader, Mokshed Ali, former chairman of Lalor Union Parishad, Hafiz Abdur Rahman, Shamsu Bihari, Zaman Sikdar, Mukta Sikdar, Sajjad Hossain, Abul Hossain, Monsur Rahman, Abul Hossain Sheikh, and deceased Janu, Montu, and Akkas Ali.

Alauddin alleged the accused killed the then Chhatra League town unit publicity secretary Amirul Islam Babul and his father Abdur Rashid, a traffic policeman, in April, 1971

He also said they abetted the Pakistan army in killing over 500 people including women and children at Chatni, Matiapara, and Fulbagan villages

Natore Sadar police chief Imtiaj Hossain said he would take steps after receiving the necessary papers from the court.

While it is true that some regrettable acts did occur, our bengali brothers need to accept the fact that a lot of atrocities were perpetrated by the those seeking independence from Pakistan. These were done, not just on the military of the state of Pakistan, but also on the civilian population - both bengali and non-bengali - with the intention of coercing them into joining the movement. Many of these actions were done with the deliberate intention of provoking the state forces to react to the atrocities. If justice is being sought then the bengali elements who are responsible for these actions should also be brought to justice.
I am not arguing for not doing justice - rather I would like it to be done for all - because partial justice (i.e. convicting only one side) is no justice at all.
Also, our bengali brothers, and perhaps the people of the remaining Pakistani state, need to realize that we should not condemn institutions rather the individuals and groups who used and abused the institutions. It is not the Pakistan Army that did these acts as such - rather it is the individuals who ran it at the time. These men were not motivated by patriotism - rather by greed, vanity and delusions of grandeur. They thought themselves omnipotent to make decisions about the fate of the populace to satisfy their whims. They were not serving Pakistan - they just sought to retain their power and privileges - especially the latter....and since privileges were derived from their usurpation of power, they clung to it as thier lives depended on it!
Our bengali brothers, and those of the remaining areas of Pakistan, also need to realize that these actions resulted in their being the tools in the hands of agencies like RAW etc. who seek to destroy the state of Pakistan and subjugate its people. This does not mean that do not condemn and seek to stop the abuse - we need to strongly oppose such actions. However, the opposition should be to the individuals and groups that are involved rather than provincial or ethnic basis. These individuals and groups are generally based on personal,family or, at most clan basis - not on institution or ethnic basis.

what evidence and documents Bangladesh want from USA ?

Well USA does have a lot of information,witnesses and intellegence which were clasified at the time of War. We already have a whole bunch of them as they are declassified now and we may seek supporting documents in this regard. Also we need moral support from USA as well which they are actively providing.

most of the supporting documents are in the form of latters which the US officials wrote back to then US administration., will that be of any use and accptable in court ?

there are few old vedio footages , most of them are already disclosed and are in public domain , you can find many of them on websites like YOUTUBE....

Yes all of them will be very usefull as the war crime tribunal will take all of the into consideration. Also as the documents are from PK ally at that time will bear significance.

Summons on Nizami, Mojaheed, 34 withdrawn

Dhaka May 13 (bdnews24.com)— A Dhaka court on Wednesday withdrew summons on appeal by plaintiffs on former Jamaat-e-Islami chief Golam Azam, incumbent chief Matiur Rahman Nizami, secretary general Ali Ahsan Mohammed Mojaheed, BNP leader Salahuddin Quader Chowdhury and 32 others to appear in court on July 20.

Dhaka ninth additional district judge Iftekhar Ahmed retracted the summons he had served on Monday over a civil suit filed last year seeking court orders declaring them 'war criminals' and barring them from running elections.

The plaintiffs in the appeal said since the government was initiating the process to try war crimes in 1971 so they were withdrawing the charges.

The 36 were to explain why they should not be declared "war criminals" for the crimes they had committed during Bangladesh's war of independence from Pakistan in 1971.

State minister for law Kamrul Islam said on Monday the process of forming a tribunal, appointing investigating agency and lawyers in line with International Crime (Tribunal) Act 1973 was finalised.

"At this moment, cases should not be filed against them (alleged perpetrators) sporadically."

The minister had said that there was no need to file cases in court. "The government's decision to hold the trial will be considered as the first information report."

Salahuddin Quadet Chowdhury is the parliamentary affairs adviser to main opposition BNP chief Khaleda Zia.

Advocates Liton Mia, Safayet Hossain Sajib and Rajib Ahmed filed the petition with Dhaka District Judge's Court on Nov 13, 2008, a month before the general elections. .

The chief election commissioner, Election Commission secretary and Dhaka deputy commissioner were also made defendants in the case.

The litigants in the petition said the 36 were 'war criminals' according to International Crimes (Tribunals) Act 1973, the relevant law on 1949 Geneva Convention and the Representation of People Order (Amendment) 2008.

They said the 36 were identified as war criminals after the war though they were yet to be brought to justice.

Azam, Nizami, Mojahid were among those who had formed militia outfits such Al Badr, Al Shams and Rajakar, and aided and abetted the Pakistan army in the killing of around 30 lakh people and rape of nearly 3 lakh women, the suit said.

The complaint added they had also killed scores of intellectuals on Dec 14, 1971, two days before the final victory.

The others who had been summoned are AKM Yousuf, Delwar Hossain Saeedi, Md Kamaruzzaman, Abdul Qader Molla, Mir Kashem Ali, Abul Kalam Azad, Khawaza Khairuddin, Mahmud Ali, Md Abdul Alim, ASM Solaiman, Zulmat Ali Khan, Kazi Quader, Shah Mohammad Azizur Rahman, ABM Khaleque Majumder, ANM Yousuf, AQA Shafiul Islam, Abdul Matin, advocate Md Ainuddin, Golam Sarowar, Maulana Abdus Sobahan, retired captain Abdur Based, Abdul Matin Bhuyian, Md Abdul Kashem, Obaidullah Majumder, engineer Abdul Zabbar, barrister Korban Ali, Ashraf Hossain, advocate Ansar Ali, Md Kaisar, Abdul Mazid Talukder and AK Mosharef Hossain.

I heard that the Saudis gave Hasina a blasting over this war crimes issue and for criticism of madrassah education so the government is now telling everyone to withdraw cases and shut up about Islamic education.
