Right, there is a clear distinction. Even if he swore allegiance to west pakistan he had no business with civilians.
This trial will ensure and put fear in ppl with power holding high ranks that their deeds will not go unpunished. This will also serve as a deterrence to ppl from taking such actions in future. Bangladesh has faced coups in the past for this very reason where generals think they can simply walk away after coming to power. This will ensure they abide by the constitution and decisions of elected institutions.
Its more for internal consumption of the BAL party types (hence why its dug up now after all these years of SHW targetting and hanging the big fish first). I don't hold much regard for these politically motivated BD courts (often kangaroo courts). Its not a credible court like Nuremberg (which had many countries represented judicially and for observation and strong defense lawyers present all throughout).
Sure India gains in short and maybe mid term by just sitting back and letting this run its course given BAL is somewhat of our lackey in that country.....and in theory I do support trial of war criminals which my previous (theoretical) post was about (under a solid independent judicial system)...but BD is fast turning into a BAL-controlled thugocracy. Their election commission and courts are rigged (esp when it comes to sensitive topics BAL can make domestic political capital out of). There is a reason why their corruption perception index score has stagnated since 2012 largely from their institutional indices declining in rating.
That means the blowback is going to be nasty one potentially.....because they (BAL) have gone all in like this (and the BD institutions were this weak to let it happen). Hope Indian deep state knows how to handle that in the long term.
