U.S. seeks to defuse spat with India

This should bring the people of India and the US closer...we now all realize idiot politicians in both countries would sell their moms for political points!

.
The State department can (and will) pull the rug out from under the investigation by giving her retroactive immunity.

There will be domestic finger pointing and recriminations (mostly for the media and chest puffing) and maybe the prosecutor will resign in protest. But national interests will be salvaged.

If USA does that, it will only embarrass itself and let it be ridiculed by other countries since they have already made a point! The world is watching!

UN posting doesn't give Devyani Khobragade permanent immunity: US - Financial Express

.
US government will find help India persuaded UN not to reject the application from India deputy diplomat to transfer to UN mission for a full immunity, this is the only way only if US justice department don't pursue their case to the US office and provide the reasons of rejection the application of India deputy on the ground of human trafficking or exploitation of slave labor law.

The State department wants the case to go away, but they can't say it in public because it would undermine the DOJ and NY prosecutors. All their talk (State) is for the domestic media, but they will find a way once the media spotlight goes away.

It has happened in the past; it will happen again.

The only guy hopping mad will be Preet Bharara, and he is expendable.

It is up to the US State Dept to allow the US judiciary be handled like a clown!

Though, I think, US will have to compromise finally even if its judicial system loses its credibility!

In India, it is getting more complicated day by day!

The US judicial branch is above even the executive branch, the Supreme court have the final say on the legal issue.

The Juridical branch hold the power to define and implement the law of the US not the executive branch of the government.

When you allow the media played up to the population, everything blow out of proportion and room to wiggle out of trouble. India must not anger US population because if US population anger they can push this case beyond control of the US government and demand US supreme court to decide this case.

I know and this is why I am saying that any interference from the State Dept would make a negative precedent of the US legal system out of this whole drama, if immunity is given now after all their claims.

The citizens of US as well as other countries and their embassies will take note and realize that it is not impossible to get away with the US legal system.

US [...] judicial system loses its credibility!

Not really.
This is a case about money, not murder or terrorism or national security.

In six months, the only people who will remember this case would be college students doing a paper on international relations.

US legal system, I believe, takes cases of Visa fraud very seriously since it was directly linked to the issues of US homeland security and since this was a high profile case, their federal agents must have been behind all the prima facie investigations. Hence, it is more than the crimes you mentioned.

Any federal relate crime carry maximum of 10 yrs imprisonment, it's a serious crime, human trafficking is a very serious crime under US law.

Unlikely. The State Department issued a clarification yesterday.

No retroactive immunity for Devyani, says U.S - The Hindu

And even if they do somehow go back on their word, it would still be up to the judge presiding over the case to acknowledge said diplomatic immunity of Devyani.

Visa fraud can be linked to terrorism.

The State department will weight the actual damage done by this visa fraud v/s the potential damage to national interests, and act accordingly.

It will be a miscarriage of justice, but life goes on...

The chest thumping is for the domestic media and not to undermine the DOJ. Once the spotlight is off, some deal will be made.

As for deciding immunity, I'm not sure the judge has any say. The decision lies with the State dept.

Either she will be allowed to leave US or be tried in a US court. Both moves have their own pros and cons.

Last night, I was reading this news article of the WP.
