True Crime - Case 3 - Hit and Run Murder

There are a few things which cannot be explained.

1) The sheet: It makes the crime look pre planned an not a crime of opportunity which it would have been, had the three boys done it. They had no means of arranging a sheet as they were coming from the beach in their car, they were also hi on crack which means they wouldn't have had the sense to take forensic countermeasures. The sheet makes me think that it was not a rape at all because such measures are taken only to safeguard knees, elbows or back against harsh ground.

2) The shoe: How did one shoe find its way to the place where it was found, one mile in the opposite direction to where she was taken after the accident? Does this mean the shoe was found very near her house?? Because she was attacked 1 KM from her house?

3) The old Lady's account: Even if we ignore the lapses in timeline, the girl was in no position to scream so unless the place of the rape was right next to her house and in absolute silence, she would never have heard her calls. And if it was so near and so silent, why didn't she hear the commotion which happened a few minutes earlier?

Here's what i think happened, the three boys, under the influence of drugs, saw a very pretty girl riding a bike and when after her. Riding along her they passed remarks to which the girl must have replied with some words or gestures which would have enraged the boys. Angry, they rammed the car into the girl's bike, she fell and hit the road hard which caused the injuries including the head bump. They must have tried to stop her bleeding with a spare shirt but she must have fainted which must have given an impression to them that she had died. Realizing what they had done and remembering their tainted past, the boys panicked and thought of disposing her body. They parked their car quite far and carried her body to the place where they it the jungle (they might have been looking to throw her in the lake but saw someone, panicked and dropped her at the nearest secluded place.

After they left, someone who was related (possibly son) to the lady (who found her) was passing by going back to his house after fishing, girl who had come to and had started moaning, was heard by him. Seeing her lying there provocatively aroused his sick mind, he undressed and raped her furiously ripping open her shirt and tossing her bra, he must have placed the sheet which he was using to sit while fishing, to protect his elbows and knees from getting scratched by the ground, leaves and twigs. While he was in the act, his mother (or whatever relation she had with him) must have found him. Dumbfound, he must have forgotten to take the sheet, the lady could not turn him in obviously, they must have spent time arguing after which she asked him to leave and hailed over a passing by car and reported the girl.

Police must have investigated if the old women had a man in her house and where he was that day, matched his DNA and denture and found their man.

The shoe that want found 1 mile further held no significance, it must have been picked up by a dog and dropped later.

Gone to work for the afternoon and turns out a few post I have to reply :)

I have studied the case (the thread) again, this revisiting the questions and op has made me realise I haven't paid much attention to the details. After reading everything again I have selected few excerpts of interest and would like your input and answers to my questions and observations listed below ........

Again and again every detail points to a gang rape at some point, the victim has been violated brutally and it is not possible for one person to overcome an athletic healthy girl and at the same time subject her to such lust and bestiality. And the gang rape means there is more than one suspect involved .......... so the three suspects cannot and shouldn't be let go scot-free ...... they are a confirm party to this case ........ for me its only to understand was it a rape case only or these three were assisting someone 4th.

  1. Diana's watch left on the collision scene
  2. 1 of Diana's Shoe left on above a mile away from the collision scene
  3. Pool of blood on the side of the road, belong to Diana near the collision scene
  4. 1 strand of hair (blond) found near the shoe belong to Diana
  5. Wreckage for Diana's bicycle was found on the collision scene. Shown mark of vehicle collision.
  6. Diana's bra was found on a tree near where Diana was found.
  7. Diana's another shoes (Matching the shoe found on the collision scene) on the trail leading to Diana
  8. A Large men shirt was found beside Diana with Diana Blood on it.
  9. DNA (Semen Sample) was found on Diana's Vagina and her panty and a sheet .

Yes Beside the Hair is found near the blood puddle and near the bicycle and away form the first shoe

VW Beetle is a small car for four people to fit in (this has already been discussed) .......... My questions

1. The tire mark found on the collision scene ......... has it been matched with suspected vehicle VW beetle? Is it possible to know to which car these marks belong to?

No it does not match, the car was repainted and repaired so no mark can be traced to the accident. The tire has also been changed.

2. The location of strand of hair and shoe point to involvement of another car, Diana may have been hit by VW beetle and then transported a mile towards the fishing spot and there shifted to another car to carry her to fishing spot.

Maybe, but there are no evidence (Physical or Otherwise) for it.

3. Pool of blood near the collision seen ......... if Diana was bleeding profusely (which doesn't make any sense at all, what is meant by pool of blood in quantitative measures? ...... and which part of the body?) from start then the VW beetle's trunk or seats should have her blood (depending on if VW beetle was involved) ......... here is what I want to do about confirmation of this VW beetle involvement ............ approach the auto store or car mechanic who repaired this beetle (it has been mentioned that this car got repaired and repainted) ...... that mechanic should be able to share the nature and details of damage to the car ........... the time when it was brought to him and who brought it to him.
The blood puddle is not a big puddle, it consistence with blood loss due to head trauma (That is the only thing I can say at this point) but it was not like you get shot and loss a lot of blood.

Again, the car have been repaint and repaired within 2 months of the murder, which include a strip down mop up, it removal all trace of evidence. And the brother did the repair job themselves.

4. Have the suspects been medically examined (I guess they have been, to confirm the bite marks and match the DNA) ........... to confirm if there were any fresh bruises, nail marks etc on their bodies? The watch, the shoe, the strand of hair all suggest Diana did struggle to free her of the clutches of the perpetrators ......... this struggle should have resulted in at least some bruised etc.

The Police did not think the shoe, hair and watch is a result of struggle, judging of the impact point, Diana would have been seriously concussed if not unconscious upon impact (The speed of the car was determined but was never released) According to Fred "Confession", the brothers drag Diana lifeless body into the car.

5. Is it possible to track who was the buyer of that sheet and shirt from the stores they were bought from?

No/Not sure.

6. The involvement of sheet is making me feel uncomfortable towards the boyfriend ..... don't know why but no rapist would carry a sheet to hide all the evidence unless they already had planned the rape and knew when and where to commit it .......... otherwise the sheet points to someone who wanted it to be all romantic and bit comfortable given the place where he wished to have the sexual interaction with the girl. Her boyfriends thoughts (quoted below in one of the excerpts) are pretty weird last thoughts you know ........ thinking about her body deprived of any emotional attachment and he hasn't been her boyfriend for too long (two weeks?) ..... I have my reasons to believe that he hasn't been able to lay his hands on Diana during all this time and he is finding it hard to resist now.

Again, all I can say is the BF is cleared and he has a very solid alibi and the BF was never considered as a suspects

So all three of them cannot deny that they know each other. Which one of them (I guess Fred) tried saying that he doesn't know the brothers.

The brothers claim they don't know Fred.

Again the auto store or the mechanic who did the repair and repaint job needs to be questioned as I stated above.

The brothers fix the car themselves, it is not at all rare in this part of world, people generally fix their own ride

Sheet, last weird thoughts and Diana's BF ............. who is the alibi of her BF?

Her BF alibi is very solid, cannot reveal it because it will be connect to where this crime was located, but there are no way the BF did it.

I think we won't have any access to information on people who visited that fishing spot that day?

Nobody knows, and nobody step forward, so there are no information on those.

All I can say is some other pervert was fishing that day ......... someone who found Diana there with all her clothes removed laying there ........ and that may be the point when she screamed and attracted attention of the woman.

Before that I don't know I have this feeling that she knew one of the guys present on rape scene.

Could be, but bear in mind, someone did a recreation of the crime and it needed approximately 15 to 20 minutes for a 4 wheel drive to get from where Diana was hit and where Diana was found, it would have take longer if they are driving the VW Beetle. Bear in mind this 4th unrelated person raping and assaulting Diana within the window of 4:40 to 5:47, 20 or more minutes of those would be spend on driving Diana to the spot, which leave the window for anyone capable of doing this after the brothers and Fred allegedly dump Diana body in the fishing trail to the woman discover her will give the 4th guy 10 to 15 minutes rape and assaulting Diana.

There is another theory where Diana was sexually assaulted inside the car, but then the 4th person theory would not be possible, because It's next to impossible to rape a girl inside a VW Beetle with 4 people sitting inside the car with Diana.

J this is confusing man ............. was she hit at the rape spot or was she hit at the collision spot? If she was brought to rape spot bleeding then the trail surrounding leading to rape spot must have her blood .......... and if she was not bleeding that profusely then what it means by pool of blood near the collision spot?

The tire iron ........ which car? I think they don't come in standard size fit for all?

This happened sometime after the murder, when Fred's brother notify the Police about Fred's alleged "confession" when the Police obtained a search warrant and located a tire iron outside Fred's house just like, so I would have imagine in Fred's alleged confession, he probably claim he hit Diana on the head with a tire iron and throw it outside his house. But as said the tire iron is forensically clean and cannot be link to the crime scenes beside it matches the wound on Diana head.

He hits her after the rape to put her out of her misery.

Do the tyre marks match VW beetle?

No, new tires were on the VW Beetle when they have located it.

Not before the real rapist was done with her ........... and its surprising that the three of them (if all them raped her) used condoms and the fourth one wanted to impregnate Diana ......... unless he practiced coitus interruptus .......

I don't think that is the case........it does not looks like if there are a 4th guy, he wold not be playing tricks and it will be a straight up rape.

There is lot of information missing J

Finger nails scraping
Saliva, Vaginal and anal
Bruises
Body fluids

Come on man there must be something to start with?

unfortunately, this crime happens in 1991 and it was not really advance era in forensic science and every aspect has been discussed. So.........there are nothing more I can update.

We don't have Fred's DNA and Semen detection in database? He has been there before.

Fred's DNA was on file, but did not match the DNA left on the sheet and the panty and vagina swap was too degraded to test.

Nonsense ......... VW beetle may have been there but there was another car involved. VW beetle and four people including three big ones ...... the space is not enough to fit all four (including the victim)

Well, that's what Fred allegedly told his brother.

We have witness who saw all three of them going after a girl on a bike in a beetle.

Refer my points above.

In my view he is the key to this case.

Is it only me who finds this statement deprived of any emotional attachment? I get it the guy wants her to be safe and everything but it hints at as if he is thoroughly possessed by the girl's body .......... and I don't think he has been able to take her to his bed at all.
-------------------------------------------------------------------------------------------------------

At the end after typing all this I am left confused myself :cheesy: ....... the BF, Fred, or another totally irrelevant pervert. Sheet, tire iron, pool of blood, watch, strand of hair ...... timing and distance and on top of everything VW beetle and four people to fit in.

Well, there *COULD* be a 4th vehicle, but there are no forensic evidence supporting this facts,

I don't know whether or not the BF statement is "Objective" and overtly sexist, chances are he didn't know Diana that long and he could have been a weirdo but still, he has a very solid alibi, one that would have the police take him off the suspect list, this is all I can say at the moment.

Hope I answer your query... :)

I would have! But now with a confession and a DNA sample that do not matches any of the suspects (who have confessed, i will want to close it swiftly as i am not sure if i can find any more evidence and my own understanding, my sixth sense and the confession all indicate that the three kids are guilty.

Cool :) Truth will be revealed in just 48 hours :)

Pretty much agree.
The three or four guys were in the car when it knocked her off the bike. The girls ends up dead. They never turned themselves in. So they all are accessories to a crime even if it was Irving driving. There's evidence she was abducted. They all go to jail. Then there is proven assault and blugeoning evidence. So now one of more of them has an even longer prison sentence.

All you do is cut a deal with one of them (probably Steven) to rat out the killer. This is either Fred (likely) or the 4th guy.

One thing a policeman friend of mine said once that always stuck in my head was "most criminals are stupid...that's why they are criminals..they don't have the intellect to hold a 9 to 5 job. I'd walk up to somebody and before I had a chance to ask a question they'd reply 'hey if you are here to question me about John Smith who got shot twice in the head and 3 times in the stomach about a half hour ago infront of no witnesses then I have no idea about it'. My friend would reply "wow..hands up ...you are under arrest!"

That confession says it all.

Well, I will have to agree, most case are solved because either the prep is too stupid to hold down what they do, or they slip up, and believe it or not, most case close basically because of the criminal confession, whether or not they know what they were doing.

So what is fred and the rest of the lot doing outside? should n't they be held up?
again as you said DNA will prove the guilt,, but look at the timeline, it had been a while till she reached hospital & am sure doctors priority was to save the girl rather than swabbing her pelvic for dna ---- also with so many people present and assisting her, the dna would be gone by then or as they say crime scene is contaminated ----

The bedsheet, the anger, it all points to two things, either the person involved in rape was already familiar with the proceedings, hence the bed sheet ----
Fred has a rape prior right?, hes the adult too? so he must have brought the bed sheet and later to be removed for clean up ---- they left the bed sheet because they left in haste ---- the woman who discovered Diana, they must have heard her coming so they did a runner ----

Well, while these people were out, they had committed other crime and by the time the Fred's confession come along, both Fred and Irving was in jail for other charge (both were charged with Sexual Assault).

It's not that why we cannot arrest these people, you can of course arrest these people, but the constitution given the right of a speedy trial so if you arrest the person, you will start the speed trial process and you cannot apply leave to investigate further, that mean you have to wrap up your investigation and put a case with what you got to try and win a case.

You can of course arrest these people if you think you have enough to charge, @Arsalan and @Hamartia Antidote both choose to arrest the suspect and end their investigation, you can too :) Just that once you did that, it mean you are satisfy with the case and no more information is needed.

Was there a 2nd car??

Well, it can be, but nothing point to another car involved in the crime, but also, one important question you need to ask yourselves is that, would the 4th person or 2nd car matter? Sure if we can find the 4th person (have a suspect to go with that DNA profile) but if he is unknown, would that be impacting the case regarding the 3 suspect we had at this moment?

The 4th Guy or 2nd car could have been anything, but that may or may not contribute to the guilt of the 3 suspects we have at the moment.

You will need to expect, however, if you choose to arrest the 3 suspects without explaining fully on the 4th, they can simply shift the blame on the 4th and say (You got nothing on me and you got a profile on a 4th person, go find that person and don't charge me)

Which mean if you feel the case is secure enough to be sure the 3 are involved, you can basically ignore the 4th person's DNA exist or the 2nd Car Exist. That is the question you need to ask yourself

We don't know ..... my guess is there was another car.........

Read the above comment :)[/quote]

There are a few things which cannot be explained.

1) The sheet: It makes the crime look pre planned an not a crime of opportunity which it would have been, had the three boys done it. The sheet makes me think that it was not a rape at all because such measures are taken only to safeguard knees, elbows or back against harsh ground.

But the 3 suspects were coming form the beach, they were spotted in the surf spot before heading the direction where the girl on the bike is heading. That surf spot is a beach, because you can only surf at a beach....

2) The shoe: How did one shoe find its way to the place where it was found, one mile in the opposite direction to where she was taken after the accident? Does this mean the shoe was found very near her house?? Because she was attacked 1 KM from her house?

No, the other direction, the shoe found on the collision scene is further away from her house, which the bike is between her house and where the shoe was.

There can be numerous explanation on that.

Diana might be unconscious when she was dump and raped, she might not have been raped in that fishing trail where she was found, or the old lady happened to just hear her scream.

The location is not far from the old lady home, but as the old lady said it take her a while to find Diana.

.
It makes no sense to hit her if they only wanted to rape her and again dumping her on a roadside instead of killing her and getting rid of the body like dumping it to the sea or a lake.
Its possible that they never intended to ram her but tried to put the car in front of her but accidentally rammed her

Actually, a lot of smoke screen.

If this is a purely Hit and Run, they wouldn't drove off somewhere else and rape her and leave her for dead, because it will increase the risk, it will make more sense just hit her and drag her somewhere secluded nearby and do the deed there, if it was me, I would not travel the 5 miles to where she was found, unless I know that place.

If this is a purely rape case, then why ram her in the first place? 3 Big guy is MORE THAN ENOUGH to overpower the girl who is 5'4 and 110 pounds. Ramming her will make things complicated for rape forensically, I meant the blood, the wounds and it also leave more forensic evidence as to given out more clues for the perpetrator.

.
@jhungary

This case cannot be solved without arresting all three or one of them and conducting further interrogation. Apparently its only these three who most probably have raped her and killed her. I will wait for 19th now. Thanks.

Under the influence of Drug & Alcohol, one can do unimaginable things - @Arsalan 's story is making more sense to me now, three guys high on drug saw a young girl, passed on indecent comments, got rejected by the girl
being teenage, they got high on emotions and rammed the vehicle into her --- as she was not very far from the residential area & kids being the local, picked her up & took her to the familiar spot

now my apologies for going this explicit, but being high on drugs it might reduce the sexual drive for the guys --- hence the deed was done quickly ( i assume swiftly from the given timeline, it has to be done fast) & got the hell out of there....... i say arrest the kids & let me grill them for a night ----- Punjab Police style (on the serious note)

Dont call them kids. Please.

.
@jhungary There should be DNA under her finger nail.(unless she was incapacitated) If the women was transported in a car, there will be blood in car. Blood trace can be easily found even if the car is wiped clean. Any investigation through that way?

This is a nightmare case. No prints, no DNA, no physical evidence. All the evidences are circumstantial.

Fred is a probable suspect, based on circumstance. He had a prior rape charge, his brother was a junky.

EXACTLY!
This is how it must have happened.

Now the problem is, if you talk about sixth sense and the "feeling" you get from the case, this instinct, THIS is the story and i strongly believe it as i told @jhungary previously as well. HOWEVER, if i work as a detective and look for hard evidence, i am certain there is not much to help me in this case. The DNA did not matched, the bite mark do not match the suspects (who i am certain are the criminals), there are no witness, there is no dent mark left on the car. NOTHING that will help me in court. Therefore, i will try not to dig too much as i already have a confession so will just close it at that.

Again, they have confessed already (may be they feared you might grill them Punjab Police style :P ). No need to grill them anymore. The suspect have already confessed to the crime. :)

CASE CLOSED
8-)

.
The suspect have already confessed to the crime.

The problem is Fred confessed in front of his brother and not police. His brother said that Fred said so, and when authorities approached him again, the brother changed his statement

Oct 19 - Truth Reviewed.

I hope you all enjoy discussing this case, for some reason, when I first hear about this case and have a look at this girl that was murdered, for some reason I cannot put down the material I have in my hand, the case detail is very much imprinted in my mind and I have a few sleepless night when I am physically in my bed but my mind was still wondering about this poor girl, maybe because what she been thru, maybe because she is just a warm person you cannot stop but thinking about? Anyway, before I review the case detail, let's remember this girl once more and pay our tribute to her

Okay, let's start

Case overview ;

Hawaii on Christmas eve, this should be the day people usually associated with joy and happiness, how many people dream about spending Christmas on the exotic island of Hawaii? For 2 parents, John and Louise, however, their dream vacation would always be remember as the day they lost their 23 years old daughter, Dana

Dana Marie "Magoo" Ireland, was found by Local Resident Ida Smith, Dana was beaten and rape on the trail over to the famous fishing spot in Hawai'i Big Island

artb.jpg
artc 1.jpg

(The circle and the statue marked the spot Ida Smith found Dana)

The location is remote, and it take a while for Ida to go back to her home and retrieve a blanket to try to cover Dana. Dana was still alive at this point, She died Christmas Day, December 25, 1991 12:07am on the operation table of Hilo Hospital

Victim

Dana M. Ireland, 23 years old when she was killed. Born in Springfield, Virginia on December 12, 1968, to John and Louise Ireland, the couple had another daughter, Sandra, which is 13 years senior than Dana, when Sandra left home for College, Dana was 5.

After Sandra graduating from College, she relocated to Vacationland, Hawaii, a place where Dana always looking forward to live one day, and since Sandra moved to Hawaii, the Ireland Family will visit their sister in Hawaii at least once a year.

In 1991, at 23, When Sandra decided to get married to her long time boyfriend, the family was invite to come to the island for Christmas Vacation. And that is the last time Ireland family sit down with all the family member together.

The Crime

On Christmas Eve, Dana left her home on bicycle and visit her boyfriend Mark Evens house at around 3pm. Evens, a single 30-some years old father with 2 kids. Met Dana approximately a few months ago when Dana sister introduce her with Evans. Evans saw Dana leave at 4 pm, and riding off his place to go home.

At 4:40pm, police alleged that Dana was hit by a car, her bike was mangled and next to her bike, there is a strand of her hair with her broken watch and a pool of blood, and one of her shoe was found lying a block away from the crash site. But Dana body was nowhere to be found.

At or after 4:45 Ida Smith was at her home and she heard faint cries for help with a weak woman voice, she go out and follow the voice and come to the discovery of a young girl, bloodied from an assault and have oblivious sign of being raped. She venture out and call for help as there are no electricity and phone near by. And mobile phone is not popular in 1991.

Dana was taken to the hospital somewhere 7 pm and she died in hospital at 1207, Christmas Day

Timeline and location was plotted on the map below.

1.) Mark Evans house (4pm)
2.) Surf Spot (4:25pm)
3.) Location of the Crash Scene (4:40pm)
3-4) The route from Crash Scene to Dump Scene)
5.) Ida Smith House
7.) Vacationland (Dana's Home)
10.) Dana's final location (Found at 5:47pm).

The Case

The case, as explained in the discussion based on witness statement and circumstantial evidence on 3 men

Suspect 1 : Frank Pauline Jr.

wpauline.jpg

Suspect 2 and 3 : Ian and Shawn Schweitzer

wschweitzers.jpg

The case hinged on witness putting the 3 on the surf spot observing a woman on a bike rode pass and subsequently chase after the girl, also the car, a VW Beetle, that allegedly cause the accident and a large shirt that found on crime scene 2 that allegedly belong to Frank

artk.jpg

1746774_web1_Ireland_T-shirt.jpg

DNA Test result is inconclusive and none of the DNA that found on scene was matched with any of the suspect, a bitemark that found on Dana left Breast also does not match any of the 3's bite mark. So, there are 3 suspects and evidence that does not link to any of the 3, suggesting a 4th person may have been involved.

The Case, as I dropped some hints in the last 2 days, hinged on the fact that the 4th person may have exist does not mean the 3 is not guilty of what they might have done, the 4th person DNA exist does not mean anything, IF WE CAN PIN THE 3 SUSPECTS involvement.

So, what do we know that's are related to the 3 persons?

1.) The brothers car matches the damage done to Dana's Bike, although it cannot be linked by Forensic Evidence (As the brother clean up the car), the witness put the Brothers and Frank in the vicinity of the car cannot be ignore.

2.) Frank Shirt near Dana when she was found, which also indicate Frank's present on the 2nd crime scenes.

3.) Frank Alleged Confession, although it cannot be used in court, but police were able to match a few detail as to where they were and where the confession goes. As to who responsible of what, that is another issue.

So, what the Police do in this case is using Witness Testimony, Frank's Alleged confession made to his brother in 2004, and the T-Shirt that found on scene, Police arrested Frank for Second Degree Murder, Kidnapping and Sexual Assault.

After some push, however, Police dropped the charge of Second Degree Murder, Kidnapping and Sexual Assault for the Brothers.

Frank was tried on July 19, 1999, by then, Frank Pauline claim the confession is a fake plot to get his brother drug to be dropped (Which the prosecution does) and he was never in the area where the murder took place. Prosecution, however, have Frank's Brother testify on his confession, the forensic expert on Dana's Bike damage, and Frank's Girlfriend to testify on the T-shirt and witness to testify on the day, he saw Frank and the Brothers got into the VW Beetle and chase after the girl, who assumed to be Dana.

The circumstantial evidence about the first 2 charges is quite strong, and the Second Degree Murder and Kidnapping charge is basically a lock, but the sexual assault charge would probably need some convincing, even tho at no time (Even in the alleged confession) Frank acknowledge his involvement of raping Dana Ireland. But the jury have convicted him either way, because of Frank's Prior (He was convicted of second degree sexual assault in 1994, 3 years after Ireland's murder) and his Brother testimony, convicted him of Second Degree Sexual Assault charge on Dana Ireland.

1 down, 2 to go.

Since the confession is not to the Police (not the same one that implicate the brothers) the Brother charges was initially dropped, in favour of prosecution of Frank Pauline. However, by 1999, Big Brother Ian was charged with an unrelated sexual assault charge and he has openly talked to another inmate on his involvement on Ireland's Case, the prosecution have decided to put the case again with the grand jury, and grand jury this time return an indictment verdict on the charge of Second Degree Murder, Kidnapping and Sexual Assault on both Ian and Shawn.

But Seeing the chance to convict is not great by hinging on the whole case to a jailhouse snitch, the prosecution decided to rattle the brothers testimony and offer a plea deal to the younger brother Shawn in order to have him spill the bean. After some consideration and possibly because of the prospect of a full conviction in court, the younger brother took the deal. And confessed to the case and implicating his own brother and Frank as the guilty party on hitting and raping Dana Ireland.

The confession made by Shawn largely collaborated with Frank's first confession to his brother. But different in key factors. Including in Frank Confession, it was the brother who drag Dana into the car, in Shawn confession, it was Frank who drag Dana inside the car, in Frank confession, it was the Brothers who rape Dana and bite on Dana breast, and Frank was there just watch. But in Shawn Confession, he point out that it was his brother and Frank whom the one raping Dana, and he watches on horrified. Of the three, only the younger brother did not have Sexual Assault conviction at that point (Frank had one in 1994 and Ian had one in 1997) and it's acceptable that Shawn version is the legitimate version of what actually happened on Dec 24, 1991. And hence, the prosecution agree to the deal and use that confession on his own Brother, Ian.

In the end, Both Ian and Frank was charged and convicted of the same charge, Second Degree Murder, Kidnapping and Second degree Sexual Assault, Frank was sentenced to 130 years jail term, Ian with 118 years jail term for the crime, while Shawn has pled guilty to kidnapping and manslaughter he was sentenced to 1 years in jail (with time served) and 5 years of probation, he was released immediately after his court date.

First I have to say, a lot of point in this discussion is quite close to the decision making on the actual detective, such as @Arsalan said he should just forget about the 4th person DNA and go straight into the prosecution process and like @Hamartia Antidote said, it just need a straight up and offer deal to one of the three and he had correctly identify the younger brother is the weakest link.

Well, the next case I am going to put up is an open case (Not yet solved) and this time, I will tell you what I know straight up, what you know is what I know and we discuss the case as per detail that emerge and hope we can spot something actual investigator missed and help them solve that case for real, please stay tune for our next case, I will put it on next week.

The Case

The case, as explained in the discussion based on witness statement and circumstantial evidence on 3 men

Suspect 1 : Frank Pauline Jr.

View attachment 431961

Suspect 2 and 3 : Ian and Shawn Schweitzer

View attachment 431962

The case hinged on witness putting the 3 on the surf spot observing a woman on a bike rode pass and subsequently chase after the girl, also the car, a VW Beetle, that allegedly cause the accident and a large shirt that found on crime scene 2 that allegedly belong to Frank

View attachment 431963

View attachment 431950

Excellent work i will have to say to the police force, detectives and the jury. This was the only possible outcome as i have been saying. Just do not dig any deep as it is all in the open anyway. Sometimes, you do not need to go into technicalities and that is what was done by the authorities.

Love and respect for the young lady. May her soul rest in peace and may the criminals rot in jail (and then then in hell).

Looking forward for the next case now. :)
@jhungary as you mentioned the next case is still not solved, can you please confirm that if we do come across some thing in our debate and discussion, will it have ANY impact on the real life events? I mean, if we do manage to form up a theory that makes some sense and can be proven are there any chances that it can be worked upon by real authorities and may be the case is solved? What are the % chances that what we decide upon here (and if it is RIGHT) can be implicated in real life by you? PLEASE DO SUGGEST.

Well, I think you will be glad to hear that Frank Pauline Jr has died in Prison in 2010 under suspicious circumstance and the big Brother is currently still incarcerated in an undetermined location due to the threat made to him from Other Prisoner in Hawaii

Sad to say little Brother Shawn copped a deal and did not serve much time in this, and he is a free man pretty much ever since.

But in the end, the victim is probably the most unfortunate, all she wanted is to go home, and I don't think what happened to her can be explained by anyone, especially the way she died she linger on quite a while and dying slowly, I think that is the worse way to go.

The next case would still be unsolved today, and if we have made any break thru, I will forward our thought about the case to the appropriate authority, whether or not they listen to us is another question. The case, all I can tell you now is that it was extremely old, it was back in the 1990s and about quarter of the century being unsolved and I would have to say there are not much evidence on the surface, but I will reveal all I know from the beginning, and hope we can find an angle or new direction for it.

Case is solved, but do we truly know what really happened? I don't think so.

I think this case is never going to be solved completely, there are too much stuff that went wrong from the beginning. The way police collect evidence and the way they treated Dana is probably one of the worse in US History, in fact, Ireland's family is so unimpressed with the authority handling the case, they actually sue the government of Hawaii and settled with an undisclosed amount of money........

If you ask me, they are lucky they can pin it on these 3 guys. As for the 4th man in this crime? Only god knows.
