Leo Tolstoy's War and Peace is in the news in India after a judge asked an activist to explain why he had a book "about war in another country".

Vernon Gonsalves had appeared in the high court in Mumbai city on Wednesday for a hearing on his bail plea.

The judge's question sparked a flurry of tweets, with users both outraged and bemused by it.

Five activists, including Mr Gonsalves, were arrested in August 2018 in connection with caste-based violence.

Police raided and searched their homes at the time and submitted a list of books, documents and other belongings to the court. The public prosecutor told the court that police had found "incriminating evidence" in Mr Gonsalves' home, including "books and CDs with objectionable titles".

"Why were you having these books and CDs at your home? You will have to explain this to the court," the judge told Mr Gonsalves.

He also pointed out a CD titled Rajya Daman Virodhi or "in protest against state oppression" saying, "The title itself suggests it has something against the state."

Police said that all five activists incited Dalits (formerly untouchables) at a large public rally on 31 December 2017, leading to violent clashes that left one person dead. They accused them of "radicalising youth" and taking part in "unlawful activities" which led to violence and showed "intolerance to the present political system".

The arrests had been criticised by many at the time who saw them as an attack on free speech, and even a "witch hunt" against those who challenged the governing Bharatiya Janata Party (BJP).

So the judge's question quickly made news and War and Peace was soon trending on Twitter.

The tweets ranged from jokes to shock over the state of India's judiciary.

From an innocuous statement, with a clarification at the end from the judge himself, how splendidly you twisted it into Nazi book burning spree, how that leap of logic came about, only the Lord knows best.

I'd bet on biases though, that and stupidity.

Thus most interesting bit - for me - in this whole article was the following:

I don't know why this issue hasn't been given attention in our country. I always wondered why the lower castes not object to being 'the lower castes' and discriminated against. These groups are, after all, the majority in India.

So it seems there are people who don't buy the idea that they are born lower than animals - that they are untouchables. One of the tweets memtioned these as being Maoists - which makes sense because communism is about this sort of thing - the class struggle and in this case the caste struggle.

This issue needs to be highlighted - and will find plenty of takers worldwide.

Fascinating stuff - this.

Question is, How this case reached to the Courts. How keeping Classic or historical books become a crime.

Police Station, FIR, and all the process and proceedings before this case reached to Judge failed. Paranoid Nation, scared, and much more.

Why were you keeping these books at your house?” The judge had also referred to a CD titled Rajya Daman Virodhi and said the title “clearly suggested” it is material against the state. “Why were you keeping this in your house?” he had asked Gonsalves.

On Thursday, Yug Chaudhary, the counsel for co-accused Sudha Bharadwaj, said the War and Peace that the court had referred to on Wednesday was a collection of essays edited by Calcutta-based journalist Biswajit Roy, titled War and Peace in Junglemahal: People, State and Maoists.

That book, according to its publishers, is a “collection of essays by well-known activists and academics, including mediators, and examines the failed peace initiatives in context of the governments’ elitist developmental policies, doublespeak of parliamentary parties and Maoists’ follies”.

The judge then said: “There were so many references to war and other titles. Before I went to War and Peace, I made a reference to Rajya Daman too. Can a judge not ask any questions in court?”

Gonsalves told the court that he owned 2,000 books and none of those, including the ones seized from his home by Pune police, was banned.
