Over past 15 years pakistans experience seems to suggest the need for a dedicated force which has the necessary legal and material resources and capabilities to meet the challenge. Direct involvement of the army is not desirable for many reasons. To summarize, it should have the following capabilities/ responsibilities:
a) should target corruption, organized crime, terrorism and counter insurgency. The definition of what fall in these categories should be inclusive rather than exclusive i.e. if in doubt include in its purview rather than exclude, In addition it should have the right to decide if a case is in its area of responsibility or not.
b) it should have the full range of capabilities for its task ranging from policing to investigation to prosecution. It should also have the capability of riot control and full scale counter insurgency.
Given scale of mismanagement and criminality prevailing in other parts of government, it should be under military control but clearly separate from the army. For this purpose it can be place under the Chief of Joint Staff [CJS] who will appoint its commander. The Jandarma, again like the Turkish model, should be a separate service [Army, Navy, Air Force, Jandarma].
In the beginning, while the appointment of the commander of the Jandarma and administrative control may be under the CJS, the operational control may be under the COAS but this is highly undesirable as the Jandarma needs to independent.
An independent Jandarma will protect teh regular army from contact with and possible corruption by the civilians, it will also permit army to concentrate on its main task of facing foreign militaries.
The Jandarma may begin with an initial sanctioned strength of 150,000 to be built up to 300,000 + with time.
The Jandarma is to have its own academy to train offices and schools to train the personnel. The academy may be patterned on the PMA with added subjects for its policing, detective and legal work. "Lateral entry" from other services is to strictly forbidden in all circumstances without exception; especially police, judges, magistrates etc are under no circumstance to be inducted from current employment. The Jandarma is to have its own personnel branch patterned after the Adjutant General branch of the army which will handle appointment, transfer, promotion, retirement etc. In the initial stages, highly selected personnel of the armed forces who have had experience [with rangers, FC etc] may be inducted in senior posts to set up the force but they will forfeit their status in the armed forces after transfer and will henceforth be part of the Jandarma. For subjects which have no precedence in the regular forces [e.g. law, police investigation, detective work], lecturers may be engaged by the training academy and schools but these people will be strictly contract teachers and will have no command or administrative responsibilities whatsoever. Even clerical staff will be newly recruited. For a limited time ex-servicemen, cleared by MI and ISI, who have clerical experience in the army may employed to train clerical staff for the force. It is important to bear in mind that many leaks and infiltration is carried out in the clerical staff where the orders are processed and trasnmitted. Having its own trained and screened staff will minimize penetration. Once the force has reached 150,000 personnel, cost savings may be incurred by disbanding the useless forces like the punjab constabulary, frontier constabulary and similar forces. The will be no induction of these personnel into the Jardarma whatsoever for any reason. The personnel from the disbanded forces will be inducted into the respective police forces. This can be done simply by stopping all police recruitment and using these personnel to replace attrition and for any expansion needed although the latter will be unlikely for some time as the Jandrama takes root.
The Jandarma, in the light of its proposed responsibilities may haev teh following branches:
Pakistan Prosecutorial Service [PPS] [for preparing and bringing cases to court]
Crime Investigation Service [CIS] [detectives etc for investigations etc]
Pakistan Forensic Service [PFS]
IT & Cybercrime Service [PCS]
Jandarma Intelligence Service [JIS]
Patrol Service [for regular policing role as needed to meet forces' mission; it is proposed to have at least one Jandarma station for every three normal police stations] .
Field Force [for counter insurgency roles and riot control] [this will include speical riot control battalions and conventionally armed forces for counterinsurgency to include older tanks [T59 or equiv] howitzers upto 122 elmm, other weapons and motorised uints with wheeled APCs like ZSL92 or equiv.
The Jandarma will have legal authority to operate in all the territory of pakistan and will thus not need to wait for federal or provincial government to invite them to operate. It will have its own prosecutors and detectives to investigate and prosecute cases and will not have to rely on the criminals employed by the regular police. As an independent force with its commander appointed by the CJS, it will be independent of any interference by the criminals. It sown personnel department will ensure that personnel matters are handled n merit. With its own tanks and artillery, it will be able to battle entrenched miscreants.
The Jandarma will work closely with a new legal service called the Emergency Court System ECS. ECS will again be recruited and trained from fresh personnel. selected retired Judges, screened by teh ISI and MI may be appointed set up the service. These will be independent of all other Judiciary and there will be no appeal against them in the regular courts including the supreme court. The ECS will judge cases of corruption, organized crime, terror and counterinsurgency. The have right to accept intelligence reports as basis for conviction. The courts will be Central, Provincial, District and Area Courts. Cases may be appealed from Area to district to provincial to central emergency courts but once convicted by central court, there will be no more appeals. Convictions by emergency courts will be final and as said earlier there will be no appeal to supreme or any other court.
