The case for a jandarma

Over past 15 years pakistans experience seems to suggest the need for a dedicated force which has the necessary legal and material resources and capabilities to meet the challenge. Direct involvement of the army is not desirable for many reasons. To summarize, it should have the following capabilities/ responsibilities:

a) should target corruption, organized crime, terrorism and counter insurgency. The definition of what fall in these categories should be inclusive rather than exclusive i.e. if in doubt include in its purview rather than exclude, In addition it should have the right to decide if a case is in its area of responsibility or not.

b) it should have the full range of capabilities for its task ranging from policing to investigation to prosecution. It should also have the capability of riot control and full scale counter insurgency.

Given scale of mismanagement and criminality prevailing in other parts of government, it should be under military control but clearly separate from the army. For this purpose it can be place under the Chief of Joint Staff [CJS] who will appoint its commander. The Jandarma, again like the Turkish model, should be a separate service [Army, Navy, Air Force, Jandarma].

In the beginning, while the appointment of the commander of the Jandarma and administrative control may be under the CJS, the operational control may be under the COAS but this is highly undesirable as the Jandarma needs to independent.

An independent Jandarma will protect teh regular army from contact with and possible corruption by the civilians, it will also permit army to concentrate on its main task of facing foreign militaries.

The Jandarma may begin with an initial sanctioned strength of 150,000 to be built up to 300,000 + with time.
The Jandarma is to have its own academy to train offices and schools to train the personnel. The academy may be patterned on the PMA with added subjects for its policing, detective and legal work. "Lateral entry" from other services is to strictly forbidden in all circumstances without exception; especially police, judges, magistrates etc are under no circumstance to be inducted from current employment. The Jandarma is to have its own personnel branch patterned after the Adjutant General branch of the army which will handle appointment, transfer, promotion, retirement etc. In the initial stages, highly selected personnel of the armed forces who have had experience [with rangers, FC etc] may be inducted in senior posts to set up the force but they will forfeit their status in the armed forces after transfer and will henceforth be part of the Jandarma. For subjects which have no precedence in the regular forces [e.g. law, police investigation, detective work], lecturers may be engaged by the training academy and schools but these people will be strictly contract teachers and will have no command or administrative responsibilities whatsoever. Even clerical staff will be newly recruited. For a limited time ex-servicemen, cleared by MI and ISI, who have clerical experience in the army may employed to train clerical staff for the force. It is important to bear in mind that many leaks and infiltration is carried out in the clerical staff where the orders are processed and trasnmitted. Having its own trained and screened staff will minimize penetration. Once the force has reached 150,000 personnel, cost savings may be incurred by disbanding the useless forces like the punjab constabulary, frontier constabulary and similar forces. The will be no induction of these personnel into the Jardarma whatsoever for any reason. The personnel from the disbanded forces will be inducted into the respective police forces. This can be done simply by stopping all police recruitment and using these personnel to replace attrition and for any expansion needed although the latter will be unlikely for some time as the Jandrama takes root.

The Jandarma, in the light of its proposed responsibilities may haev teh following branches:

Pakistan Prosecutorial Service [PPS] [for preparing and bringing cases to court]
Crime Investigation Service [CIS] [detectives etc for investigations etc]
Pakistan Forensic Service [PFS]
IT & Cybercrime Service [PCS]
Jandarma Intelligence Service [JIS]
Patrol Service [for regular policing role as needed to meet forces' mission; it is proposed to have at least one Jandarma station for every three normal police stations] .
Field Force [for counter insurgency roles and riot control] [this will include speical riot control battalions and conventionally armed forces for counterinsurgency to include older tanks [T59 or equiv] howitzers upto 122 elmm, other weapons and motorised uints with wheeled APCs like ZSL92 or equiv.

The Jandarma will have legal authority to operate in all the territory of pakistan and will thus not need to wait for federal or provincial government to invite them to operate. It will have its own prosecutors and detectives to investigate and prosecute cases and will not have to rely on the criminals employed by the regular police. As an independent force with its commander appointed by the CJS, it will be independent of any interference by the criminals. It sown personnel department will ensure that personnel matters are handled n merit. With its own tanks and artillery, it will be able to battle entrenched miscreants.

The Jandarma will work closely with a new legal service called the Emergency Court System ECS. ECS will again be recruited and trained from fresh personnel. selected retired Judges, screened by teh ISI and MI may be appointed set up the service. These will be independent of all other Judiciary and there will be no appeal against them in the regular courts including the supreme court. The ECS will judge cases of corruption, organized crime, terror and counterinsurgency. The have right to accept intelligence reports as basis for conviction. The courts will be Central, Provincial, District and Area Courts. Cases may be appealed from Area to district to provincial to central emergency courts but once convicted by central court, there will be no more appeals. Convictions by emergency courts will be final and as said earlier there will be no appeal to supreme or any other court.

we already have them - they are called Rangers

the rangers need the provincial or federal government to "invite" them to aid civil power....this is drama being done in sindh where the criminals raise an issue every time to "renew" rangers' powers....this why the chotu gang in punjab was able to get AA guns under the shahbaz shield.....in addition they are nominally under interior ministry I think....they work under army only because the senor ranks are manned are serving regular army officers....
in addition this removes them from their primary role of border security...
moreover the rangers don't have investigation and prosecution capability which how the criminals masquerading as politicians are screwing the rangers all over the country....40 % of documents filed by rangers for the Dr [!]Asim case in karachi have 'disappeared" before being presented to court.....
in addition the rangers are provincial forces the Jandarma will be a Federal force....

NACTA was suppose to be that force whose area of responsibilities were to be increased gradually. They way Govt is sleeping over it is prompting direct involvement of Army here.

that is why we need the Jandarma....it will be independent of the criminal politicians and will not need legislation or other nonsense and will be under military control and will have the the necessary resources inhouse to deal with the challenges...

@Saleem This is 100% wicked idea. This is one example of simpy policy decision that would have profound impact on Pakistan. This new force should be called "Jandarma". In fact since Pakistan has close relations with Turkey the Pak Jandarma should be modeled on the Turkish Jandarma.

JS DGWE DIRECTOR GENERAL WAR ECONOMY...

the state of the economy and the efforts of the anti-state elements to drive the country to bankruptcy and sell off all sate assets requires that a directorate general be established immediately in the JSHQ.

it will include a limited military staff and will rely on civilians sworn in under the official secrets act and will be responsible for, among other things, determining, planning and execution of national economic plans:

1. the economic state of the country--what is consumed in the country and how it is procured --- local production, overseas purchases, transport from sources of supply to areas of consumption....this will include foodstuff, consumer goods, military needs etc.

2. products of the country exported for profit--areas producing them and how they are transported to areas of consumption.

3. storage capacities available and desired for all essential products and material.

4. state of transport: road, rail, air, waterways, ocean etc. current availability, needs, capacity for expansion and possibilties for improvement.

5. currency and financial state--availability, reserves, expansion etc.

6. planning for dealing with a total blockage air and seas, sanctions and ways of coping...

the staff need not be large--contract employees [professors etc] can be employed provided they are claered by intelligence services.

given the total nonsense that passes for statistics currently, the JS DGWE will have to compile its own statistics and move accordingly.

the Action service will operate in complete secrecy---no revelation or acknowledgment of personnel or operations--
Legal cover will be provided by "Special Courts" which will also operate in complete secrecy---judges, cases decisions everything will remain secret---only the JSHQ senior officials will supervise and approve operations....

the service need not be very large 5-10,000 men should be sufficient. extra manpower for combing operations etc will be provided by special units of the Jandarma.

The first target will be the criminals already identified e.g. those on the NRO. not only these individuals will be targeted but their facilitators e.g. judges who let them off then hook, police who messed up the cases, ministers and counselors or bureaucrats who let them off scot free will be targeted and dealt with in a final way so the criminals can do no more mischief.

parallel with this will be the cleansing of the urban centres of crime. --the french operation in Algiers is particularly suitable.....using the Jandarma to provide manpower, the registration of households and their population will be done--the french began with municipality/ census records and then checked everyone in the house and asked about the neighbours----anyone missing was presumed a suspect until proven otherwise, anyone there who was not supposed to be there was treated similarly and hauled off for interrogation.Of course during the registratoin drives the area was under curfew. The criminals gangs will try to resist this but curfew with shoot on sight orders will take care of that. beginning with Karachi, followed by Lahore and then on down the major cities, the criminal elements will be eliminated. Masterminds, ringleaders and organized crime dons will be handed over to the Action Service and special courts for final action, petty criminals may be screened by the Jandarma emergency courts.

A marked improvement will be seen in some 6 months and concrete results are to expected by one year.....

during these operations, the regular armed forces will need to remain vigilant as the foreign sponsors of the criminals will try their level best to prevent the destruction of their proteges... this may take form of economic attacks or actual limited military operations....

REFORM OF CIVIL SERVICES:

a) all personnel matters: appointment, transfer, promotion, demotion, dismissal, rewards, reprimands should be handeled by a special personnel board;

b) members of board will be selected based recommendations by the intelligence agencies [MI,ISI, Jandarma intelligence].

c) recruitment to be under control of another board whose members will be selected as in (b).

d) each service [police, DMG, finance etc to have its own board]. only professionals of the specific specialty can be members of the board

e) periodical review of performance every 6 months. appointments for a minimum of three years and maximum of five. no exceptions.

f) no lateral entry or carryover from the old services: all recruitment to older services to be stopped immediately; the older services will be eliminated by natural attrition. IN addition, as investigation proceeds, all those found guilty of corruption, if of officer rank [grade 17 and above] to be summarily executed with confiscation of all wealth and close investigation of their associates and facilitators.

g) any attempt at influences the operations of the civil services to be dealt with ruthlessly: any minister, MPA, MNA, civil servant who contacts officials regarding any case to be tried in special [secret] courts [which wprk with the Action Service- see above] and if found guilty to be executed and his wealth confiscated with close investigation of their associates and facilitators. Only available option will be to submit written application to the department addressed to its head e.g. the IGP etc. A special department in each service will deal with the requests. Any suggestion of trying to influence the cases will result in trial in special [secret] courts and if found guilty to be executed and his wealth confiscated with close investigation of their associates and facilitators.

KARACHI SITUATION:
this clearly shows the urgent need for the Jandarma [with its prosecutors and courts] as well as the Action Service and its special courts.....try them in secret and eliminate them and confiscate all their wealth. If anyone resits blow them up with heavy weaponry....

ADDENDUM
THe JS DGWE will also have to have a directorate monitoring the factors having an effect on the finances of the country i.e. the budget, the deals with international financial and economic institutions and organizations e.g. IMF etc and loans taken by the government.

The DGWE will also be incharge of the CPEC. it will control the following organizations:
1. the security division guarding it.

2. the construction organization will be under the a new engineering/ construction division and while civilian contractors may be employed, they will be under military supervision and discipline. for this a civil courts including the supreme court will have no jurisdiction.

3. a maximum effort will be made to develop indigenous capability to builf construction machinery and equipment in Pakistan e.g. graders scrapers, dozers cranes etc. for this HEC Taxila will be employed.

4. the Pakistan Steel Mill will be placed under the JS DGWE. It will have soel discretion in running it. The DGWE orders will be monitored and audited by the JSHQ and civilian courts including supreme court will have no jurisdiction. All policies and factors that may affect the viability and profitability of the PSM will be determined by the orders issued by DGWE subject only to the supervision of the JSHQ. All government and non government entities will have to obey these orders.

MILITARY DISTRICTS

1. Central & Eastern Europe and then the communist countries have long used the Military Districts. Given the increased size of the PAkistan Army it is now time for Pakistan Army to adopt this concept. The Corps Commanders as heads of Log Areas and DHAs just doesnt make sense anymore.With hybrid warfare and the rapidly changing real-time situations the field commanders just cannot afford any distractions.

2. The Field Army and its commanders must be training and exercising constantly to meet the regular armies it might be called upon to face. For this purpose the the Field Army, Commands [central south north etc], corps divs etc ust be focused on combat operations only. Only such administrative and logistic tasks should be assigned them as are necessary for them to retain necessary operational and tactical independence. All other functions should be assigned to the Military Districts MD.

3. It might even be advisable to have a Home Army [The Germans called it ersatzheer or replacement army] HQ to control all functions not needed by the field army.

4. the MDs will be responsible for:
a. all static installations [station HQ etc]
b. all base level logistic establishments [central workshops, warehouses, central hospitals etc]
c. all recruitment and training establishments, schools and academies.
d. static and local defense units [garrison security and guard units]
e. internal security operations [see 5 below]

5. This brings the issues to the Jandarma [post #1] as delineated earlier. If this is established as noted above, under command of the JSHQ with its own investigations, prosecution, policing units working with the the emergency courts and backe dup by its heavy units [2nd line armoured [T59/AlZarrar, M113, wheeled armored cars, artillery {older 105 mm, 122 mm howitzers, engineer & construction units], it should be able to handle all internal security issues that may arise leaving the army free for its mission of facing other states attacking Pakistan. It will aslo minimize the itneraction of regular army with civilians and thus exposure to corruption and the friction resulting from it.

6. the MDs will for district boundaries of administrative districts. This does not need entirely new HQs: the existing Log Araa HQs can be reorganized as MD HQs. The Corps HQs can be given an additional staff to coordinate log matters with MDs and supervise log matters for corps troops.

7. Given this, a HQ Home Command or Replacement Army is highly desirable. It will coordinate nationwide internal security operations, logistic operations and other such matters leaving GHQ to deal with military operations with minimal distraction.

DG TRANSPORTATION UNDER JSHQ

in any conflict sitiutation transportation will be a major issues. JS needs to establish adirectotrate whcih has at the very least a core staff oftrained professionals for planning and operations and lay the groundwork for rapid expansion in caase of need. basically it may be divided into the three modes of trasnportation: air, water ad land.

air trasnport should include long range air transport, support of operational and strategic airborne operations and economic air operations of national importance [disaster relief etc] .

water transport should include ocean/ sea transport, inland water transport [lakes, rivers etc], economic transport [trade, merchant marine etc]

land transport should include rail, road, porter/animal transport. rail transport should include operations, repair and construction of railnetworks, repair andmanufacture of railway engines, railcars and other equipment, road transort should include road construction and repair, heavy duty truks [semis etc], a network of workshops and transit stations. animal atranspor should be incljuded for strategic econimic and sustenance operatoins in speicla terrain eg NAs etc.

Regarding Jandarma, I think it is an excellent idea and will go a long way in improving the law and order situation in the country but I have a question if you can clear it out.

A 300k strong force equipped with armor(although old) and working totally independent of the army, how would such a force react in case there is another coup in the country and the whole military is backing that(unlike the recent Turkish failed coup). We might have a civil war at our hands.
