Slugger:
Shariah based Nizam-e-Adl was practiced in Swat, Dir, and Bajaur till 1968 when these princely States were absorbed in Pakistan. There is nothing wierd or draconian about it.
Shariah based laws ensure rapid and affordable justice to the people.
Similar judicial systems with localized flavor are practiced in India too:
1. A vast swath of territory comprising of parts of Jharkand, Bihar, Madhya Pradesh, Orissa and Talangana (Karnatka) are governed by the Naxalite Marxists. Naxalite Peoples Courts are a lot more efficient than the Indian Judicial system.
2. Nagaland, Manipur, Mizoram and parts of Arunchal Pradesh are governed by the local groups. They have a relatively fair system of internal governance.
Shariah system will apply to only about 5 Million people in Swat / Malakand divisions. By comparison the unconventional system of governance in India applies to more than 100 Million people!

Is there any independent criticism of these systems??!!
How can u say they ve relativey fair system of governance or r more efficient..Is there a system of checks n balances in the system to ensure its fair n doesnt punish the innocent.
I wish our desire to bring the indians one peg down all the time doesnt make us condone things that are not right either.

Does Sharia system has checks n balances..wat kind of Sharia will be implemented..Will there be the inhuman penalties like stoning to death n chopping of hands..I thin these r more relevant questions..If they r implemented properly n humanly most importantly with common sense than i m not sure anyone got ay problems with that..N how they r going to be implemented ought to be te debate issue.

Dear Bloodniron:
I never said there is anything wrong with having a localized favor of judiciary in accordance with the wishes of the people.
There is nothing wrong with 100 million people in India having their preferred system, or 5-6 million people in Pakistan having their own.
Shariah laws should not invoke images of stoning or hand chops; there is nothing inherently draconian about them. Shariah / Fiqah has its due processes, which appear to work far better than our standard judicial processes that favor the rich and powerful.
