SC judge urges Article 6 proceedings against President Alvi, Imran and others

If you read the fourth last line of the para 12 of the judgement, it does mention invoking article 6, on the discretion of the parliament.

The judge nowhere 'urges' the parliament to invoke article 6.

It says that whether to invoke article 6, that decision is for the parliament.

I just have an issue with the editorialized article title.

It was a nice judgement and it addressed almost everything that needed addressing, but I don't think it said anything tantamount to urging Article 6 proceedings.

On a serious note, if they do follow up, it will lead to further chaos and years of unrest.

LAHORE (Dunya News) - Punjab Chief Minister Hamza Shahbaz Sharif on Thursday said it is the responsibility of Parliament to take action against Pakistan Tehreek e Insaf (PTI) leadership under Article 6.

Hamza Shahbaz said that the historic decision of the Supreme Court has once again buried the ideology of necessity, adding that President Arif Alvi, Imran Khan and former deputy speaker Qasim Suri have violated the constitution.

Welcoming the detailed decision of the SC, the Punjab Chief Minister said that the SC had clarified that Article 6 of the Constitution was used for violating the Constitution.

Hamza claimed that the masses of Punjab will reject the group of conspirators, adding that after violating the constitution, they have started to threat the courts.

So basically this confirms that Pakistan is NOT a democratic country. This dysfunctional democracy is nothing but a joke. Everything is run by 2/3 generals/military rulers be it Parliament, EC, bureaucracy, SC, spineless CJ and other judges. Establishment controls everything from behind and pulls strings but doesn't want to come to the foreground because the world usually deals with Civilian Govt only.

The million dollar question is, when and how these generals/military rulers will be held accountable for the sins they've committed and the corruption they've done? When any court in Pakistan will trial them for high treason cases? Not sure if it will get materialized in my lifetime.

Think tanks and talking heads all around the world have alluded to the Pakistan military having a major presence in Pakistans political landscape. I would say it's been abundantly clear now since the ouster of IK for a group of incompetent dacoits. Even the staunchest army supporters cannot deny the establishment at the very least gave its blessings.

Will people finally come together and hold the establishment accountable?? I say for this to happen the first thing is IK must openly name them. No more tip toeing around and throwing soft jabs. Expose them for the people to see.

If this wasn't the case Pakistan wouldn't be a third world shithole bending over for a few billion dollars desperate to avoid economic collapse.

On July 13, the Supreme Court of Pakistan issued the detailed verdict of the suo moto case regarding the rejection of the no-confidence motion against the then prime minister Imran Khan by the then Deputy Speaker Qasim Khan Suri.

The court declared the ruling passed by then deputy speaker Suri on April 3, 2022, to reject the vote of no-confidence, the subsequent actions of former prime minister Imran Khan and incumbent President Dr Arif Alvi as an infringement of the fundamental rights of the opposition parties and the public at large apart from overstepping jurisdictional bounds.

Justice Mazhar Alam Khan Miankhel, who retired on Wednesday, urged the parliament to determine if the acts of President Arif Alvi, Imran Khan,, former NA speaker Asad Qaiser, former deputy speaker Suri and former federal law minister Fawad Chaudhry “attract Article 6 of the Constitution” for violating the sacred trust of exercising by derailing the process of the no-confidence motion pursued against Imran Khan.


“This sacred trust was violated amongst others by the President, PM, the Speaker, the Deputy Speaker and the Law Minister as the elected representatives of the people were prevented from voting on the resolution and for such blatant transgression of the Constitution there must be consequences and the law must take its course,” Justice Miankhel observed.

“Whether the stated acts attract Article 6 of the Constitution is also left open to be determined by the Parliamentarians as to whether they leave open the doors for such unconstitutional acts or take suitable measures to stop such like mess in future,” he added.

Justice Miankhel also noted that the acts from “rejection of resolution by the Deputy Speaker till the dissolution of National Assembly by the President were not performed in the ordinary course of business but the same were result of premeditation and deliberations in order to defeat the resolution of vote of no confidence while playing fraud on the Constitution.”

Similarly, Justice Jamal Khan Mandokhel observed that “the conduct of the Deputy Speaker is evident of the fact that he had already decided to reject the resolution” which was drafted before the start of the proceedings in the House.

He noted that the ruling that Suri gave was “with the name and designation of the Speaker National Assembly, Asad Qaiser, who was even not present in the House.”

Justice Mandokhel said that the ruling of the deputy speaker was pre-planned and deprived the Parliamentarians of their constitutional right for a vote of no confidence against the PM.

“The Deputy Speaker did not provide the right to reply the allegations leveled by the Federal Minister for Law and Parliamentary Affairs, which undermined the authority and sovereignty of the Parliament, and has lowered its dignity as well. His act was, therefore, not only beyond the mandate of the Constitution, but is also based on mala fide, which cannot be termed as procedural irregularity, rather it was an act, ultra vires the Constitution.”
Pathetic judge, bet he became judge thanks to the biriyani brigade himself, no wonder our justice system is ranked beyond 120 in the world. Country had the bad reputation before now country have become a joke thanks to the generals and these judges.

I believe he's saving it as the last card (their names) and waiting for 17 July's election. If the establishment stayed neutral then he wouldn't call their names (which I don't think will happen), otherwise, the situation will deteriorate soon enough. Let see what will pan out on Sunday.

Since when? And when judgment will come to the fore? After 200 years or 2000?

Simply put, justice is delayed justice is denied.
