Islamabad, Apr 3: Shoaib Malik has found support of the Islamic scholars and Pakistani lawyers as they questioned the validity of the nikahnama, stating that marriage certificate cannot be used to stop Malik's marriage with Sania Mirza.
A renowned scholar Mufti Muhammad Naeem said that divorce was out of question as the nikah on telephone according to Islamic Shariat was invalid.
"There is no question of a divorce since a nikah without proper witnesses on telephone is not recognised in Shariat," he said.
The validity of the document has also been questioned by the leading barrister and family law expert Talib Rizvi, saying that the nikahnama cannot be considered valid unless the family produces the witnesses from both sides.
"This cannot be considered as a valid and legal nikahnama unless the witnesses are present and secondly here one party is denying the nikah ever took place," he said.
Rizvi said that Siddiqui family cannot prevent the marriage even under the Indian Muslim act.
Sania-Shoaib marriage have hit into controversies ever since Ayesha Siddique, who alleged that the Pakistani cricketer have married her, has asked for a formal divorce from Shoaib.
