They do use these tactics. Aren't they ?

AHMEDABAD: The CBI chargesheet in the Ishrat Jahan case contains the testimony of a police witness who told a magistrate that he had heard DIG of crime branch, DG Vanzara, telling his junior officer G L Singhal about having obtained permission from chief minister Narendra Modi and and then junior Gujarat home minister Amit Shah for killing her in a fake encounter.
Deputy superintendent of police in crime branch, D H Goswami, had given this statement under Section 164 of CrPC before the additional judicial magistrate, Esplanade Court, Mumbai. His statement is part of the annexures to the chargesheet submitted by CBI in the Ahmedabad court on Wednesday.

Despite this testimony, the chargesheet, according to sources does not name Modi or Shah as accused. Whether this is because the CBI did not find Goswami's testimony credible or strong enough or because it wants to investigate the issue further and might include it in a supplementary chargesheet later is not clear.

In his testimony, Goswami said he had accompanied G L Singhal to the Shahibaug office of the crime branch in Ahmedabad on June 12, 2004, two days before the encounter in which Ishrat and three other alleged LeT terrorists were killed. He said ADG P P Pandey, D G Vanzara and IB officer Rajinder Kumar were already present there.

In his testimony, Goswami said he heard them talking about some LeT operation and Rajinder Kumar asking Vanzara to talk to the chief minister about it. Goswami quotes Vanzara as saying that he would talk to 'safed dadhi' (white beard) and 'kali dadhi' (black beard) — code names for Modi and Shah.

Goswami said he accompanied Singhal to the Shahibaug office again on June 14 at around noon, a few hours before the encounter. Vanzara handed over to them a written document which also mentioned the plan to kill Ishrat, apart from the three men. When Singhal objected to the plan to kill Ishrat, Goswami said he heard Vanzara saying that he had the approval of the political bosses.

Hearsay is inadmissible evidence under Indian Law. In a way it is good that this has come out for it is now clear that CBI has reached its limits and has nothing more to go on. The charge sheet will be thrown out in the court on the first day as no mens rea is revealed. CBI cannot reveal the Mens rea because then it will have to say that the killed were terrorists. The whole episode is good for Modi - Hindus will support him for getting terrorists killed, but the courts cannot touch him

Yes, it is very interesting...Lets assume that Modi did something wrong to Indian Muslims..It is still an assumption though..there is no proof or nothing..but even if there was such an assumption, that should be an issue between local muslims and Modi..why are Pakistanis getting so excited and then show so much of hatred? Only reason I can see is that..they need to keep hating Hindus and they need a leader from Hindus who they can project as villain to justify their born hatred towards Hindus..What else could be????

When home ministry declared Ishrat Jahan and three others terrorists

Four years before the CBI filed a chargesheet declaring as fake the 2004 "encounter" in which Ishrat Jahan and three others were killed, the home ministry had filed an affidavit in the Gujarat High Court describing the four's alleged links with the Lashkar-e-Toiba. A look at what the affidavit, filed in August 2009 by R V S Mani, then undersecretary for internal security in the ministry, had to say about each of the four:

According to Mani, Javed was in regular touch with LeT operatives for carrying out terror acts in Gujarat. He was born a Hindu who later changed his name from Pranesh Pillai. Mani said Javed was of a "criminal bent of mind" and concluded he was a rowdy. The conclusion was based on four criminal cases against Javed lodged in Thane district between 1992 and 1998, a period when he stayed in Mumbra and met Ishrat. Mani's affidavit claims that despite having converted to Islam, he procured a passport under his previous Hindu name in 2003 and went to Dubai. "It is suspected that while working in Dubai, he was subverted to the cause of LeT," the affidavit says.

"Javed and Ishrat were activists of terrorist organisation LeT," the affidavit says. "Neither Pillai (Javed's father) nor Kauser (Ishrat's mother) have chosen to disclose correct facts relating to occupation, activities and movements of Javed and Ishrat on account of the fact that both Javed and Ishrat were involved in such activities, disclosure of which would result in reflection of the bona fide of the police action against these four persons ..." It adds, "Ishrat was actively associated with LeT, and the apology by an LeT mouthpiece [this was issued to her family] is tactical, to discredit Indian security agencies and police and aimed at misleading the court". Another LeT mouthpiece had hailed Ishrat as "female martyr of LeT."
