Panama Case - Post Verdict Discussion and Updates

The Panama Bench verdict giving the time period of six months for completion of trial court came on the 28th of July last year.

The deadline for filing references by NAB was within six weeks. The references by NAB were filed on the deadline and accepted by trial court on same date of filings, September 8th last year.

The first trial court hearing was on 19th September.

The indictment took place on the 19th and 26th of October in different references.



According to the info in my reply to @PakSword the question is;

Six months are to be counted from which date?
  1. Date of filing references by NAB i.e. 08/09/17 Six months Deadline: 08/03/18
  2. Date of first trial court hearing i.e. 19/09/17 Six months Deadline: 19/03/18
It can be either one of the above dates and just a matter of how the trial court judge interprets it or how the till now silent monitoring judge calculates it.

Then there is the matter of trial court judge Justice Bashir retiring around the same deadline date.


Just about perfect time to interfere for the monitoring judge and ensure completion of trials before the trial court judge retires.

There is gonna be a lot of room to play if the judge retires before completing the trial.

Court may miss SC deadline in Sharif cases

ISLAMABAD: A critically over-burdened Accountability Court (AC), hearing four corruption references against ex-premier Nawaz Sharif, his family and former finance minister Ishaq Dar, is likely to miss the six-month deadline set by the Supreme Court (SC) for the completion of proceedings, The News has learnt.

After his disqualification from the Supreme Court as party president on Wednesday, the next worst outcome for former premier Nawaz Sharif could be a jail-term and conviction by an the Accountability Court on corruption charges, but the fate of former prime minister may be decided by a new judge of the Accountability Court, sometime in March or April this year.

Currently, there is no judge in the Accountability Court No 2 while court No 1 judge Muhammad Bashir is set to retire on March 12, a day before the apex court’s deadline expires. According to sources, more than 90 NAB references and dozens of other cases are pending with the two courts, making it almost impossible for one judge to decide the pending cases in time.

The sources told The News that the Federal Ministry of Law has written a letter to the Islamabad High Court Registrar on Wednesday to seek nominations for the appointment of two Accountability Court judges in Islamabad. Earlier, Judge Muhammad Bashir had written a letter to the ministry seeking appointment of judge for the Accountability Court No 2.

On the directives of the Supreme Court, National Accountability Bureau (NAB) had filed four references against Nawaz Sharif and his children: Hussain, Hassan and Maryam Nawaz, as well as his son-in-law Capt (R) Muhammad Safdar and Finance Minister Ishaq Dar in the Accountability Court in September last year. The apex court had directed the Accountability Court judge to conclude the proceedings in six months. Justice Ijazul Ahsan of Supreme Court was appointed to supervise the trial court’s proceedings.

However, meeting the Supreme Court deadline has become a Herculean task for the outgoing accountability judge especially as the NAB has filed the supplementary references in Al-Azizia and Flagship Investment cases a few days ago. On the other hand, despite a number of foreign tours, the Bureau has yet to obtain evidence from the United Kingdom, UAE and Saudi Arabia where the Mutual Legal Assistance (MLA) requests were sent several months ago. According to schedule of hearing, the court has yet to hear over two dozen prosecution witnesses beside the unknown number of defence witnesses before arriving at a decision.

NAB sources said Judge Muhammad Bashir may not be able to announce the decision in Nawaz Sharif cases before March 12 and it is widely believed that the references may go to a new accountability court judge. The new judge for accountability court will be appointed by the president after receiving nominations from the Chief Justice of Islamabad High Court. According to experts, the process of appointment will take at least a couple of weeks. Under the procedure defined in the NAB Ordinance, the chief justice of the relevant high court sends nominations for the accountability court judges to the Ministry of Law and Justice which forwards the summary to the prime minister to forward to the president for appointment. According to the law, the nominated judge “shall be a serving District and Sessions Judge qualified to be appointed as Judge of the High Court”. Experts believe although the new judge is likely to use the existing record and evidence for his judgment, may take a few extra days or weeks in understanding the key points of case before announcing the final decision.

I want tht basheera retires and some other judge announces the verdict.. plus there was rumor tht NAB may file second supplementary reference in these cases.. so its better to have more evidence against sharifs, even if it means postponement for few weeks..
Cant trust basheera..so it will be better if deadline is extended and some other judge announces decision...

But i am ocnfused about one thing.. if another judge comes..will he rely on already comducted proceedings..or case will start afresh? Although this article says tht new judge is likely to use existing record and evidence for ihs judgment but i am not sure abt it.. he might start afrsh....

I have another thought.. what..if monitoring judge....extends tenure of basheera...? And ask him to continue till this case is concluded? So tht theres no more hassle...and case is not altogether postponed..in case if it has to be start afresh..if new judge is appointed? Ijazul Ahsan might give extension to basheera and ask him to conclude this case...its also a possibility...i think

Time...It is all about time...Time is what is worth its weight in gold for Sharifs...

If the cases are postponed then who knows which judge gets the nod from PMLN Government...

They have been manoeuvring trial court judge appointment from day one...we remember that justice Bashir is the judge who acquitted Zardari. While the services of second judge were returned to high court by law ministry so that NAB references had to fall in Justice Bashir's court.

That's why no judge was appointed in NAB court 2...Burden on one judge who was to retire in March...

There is always a lot going on than meets the eye in these appointments and for obvious reasons too; To try and manage whatever can be managed.

There is no certainty that the coming judge shall be better than the outgoing and may even be worst and more time can be easily wasted to get as close to next elections as possible.

I don't think that monitoring judge has the authority to extend the retiring judge's tenure anyway.

The biggest question that comes to mind is that why we heard no voice to demand appointment of the missing second accountability judge from any opponents of PMLN???

And more specifically...
Why was so much burden left to just one NAB trial court judge by the law ministry and why there was total silence from "wait and watch PTI" on the matter???

Land Registry documents show that these four properties are owned by two companies registered in the BVI: Nescoll Limited and Nielsen Limited. According to information published as part of the Panama Papers, these companies were controlled by the former Prime Minister of Pakistan, Nawaz Sharif. In 2017, Pakistani authorities initiated an investigation into these assets, which found that they were purchased without a mortgage between 1993 and 1995, just after Sharif reported a growth in wealth without any plausible declared source of income. *In July 2017, Sharif was removed from office after the investigation found that he had failed to disclose these properties on his official asset declaration.

Someone did some research on law firm and the lawyer who witnessed the deed.. and here is his explanation:

The law firm that verified this deed is called Freeman Box and the lawyer is Jeremy Freeman. This is printed on the trust deed Maryam tweeted.

But Freeman Box is far from being a "highly reputable law firm"

In the UK, all info about companies are held at Companies House, and anyone can search it.

So here is this Law firms's data on companies house:

Makes interesting reading.

The firm was started in 1991, so it is somewhat old. But it has been dormant since 1991! This means it has not been trading. And around 2005,2006 it was definitely not trading. So makes you wonder, why would sharif's use a law firm that was not even trading. The trust deed is stamped with the firm's stamp, so you can't even say that the lawyer acted on his own.

Secondly, as the firm has never traded, it does not have any profits....in fact the total investment in this firm is £3 - thats less then 500 rupees. (download some of the accounts - most are free). So are we expected to believe that a firm, that was not trading, owned no assets (computers, furniture, etc) - decided to download a beta version of Windows Vista, just so they could use the calibri font for all letters, etc that they are not doing in the first place. I've heard some odd things in my life, but this takes the cake!

He's been involved in 19 companies - one law firm - Freeman Box, which never did any business...and 18 other companies - that deal in real estate. Who else do we know that deals in real estate? Ah yes..Hassan and Hussein Sharif. I'm wondering now if this Jeremy guy is even a real lawyer - or just a business partner of the sharif kids

So why doesn't someone sue this firm? Well apart from the fact that it would be too much effort to get the £3 that the company is worth, the company itself was actually struck off (forcefully dissolved) on 30 May 2017 - (this just gets better and better!)

I know yesterday I said it seems like a Mickey Mouse firm....but I want to apologise.....to mickey mouse.

Honestly, anyone who believes that this deed is real and has been verified by this "reputable" firm, needs their head examining. Unless they know it's not real but will still defend it - for them there is no hope....

It's easier to find a needle in a haystack then anyone in sharif family who doesn't lie

Basheeray ne agar jail bheja tu zuroor uss ke sarr par koi danda para hoga.. tab hi bhejay ga.. yaad hia..kuch days pehle CJ ne speech ki thee..for special court judges? Aur us main bhi basheeray ko special message diya tha...
Aisa hi koi danda hoga...jis ki wajah se basheera jail bhej sakta hai..

Waisay NAB buhat acha kaam kar rahi hai.. tigni ka naach nacha diya hai.. poori Punjab government ko.. abb suna hai ke presidential ordinance ke zareeyay NAB ki jurisdiction ko limit karne walay hain..

This I quoted in October last year when we were hopeless about NAB and even the new Chairman NAB.. based on credible information...

Waisay quite possible that we see Javed Iqbal taking the right steps in the right direction.. quite possible.. :)

NAB didn't only rely on JIT information. They gathered much more info later on. We have heard that the investigators have visited UK several times in the past few days.. Whenever they come back, a new supplementary reference is filed.. lolll

Hopefully these supplementary references are legally strong with strong evidences...against sharifs..

Waisy..statement by Robert Radley is the best thing.. ab baji ke jail janay ke bohatt chances hain.. bas basheeray ko dandaa parr jaye kahin se..ya basheeray ki jagah koi better judge aajaye..

Will that not be classed as an obstruction of justice, with Godfathers case which is currently being heard in NAB on request of SC, I'm certain SC can exercise certain powers if it deems the cases being obstructed.
