Well what my fellow countryman said was we are treating your personal as a Military officer conducting terrorist operations in our country. And you somehow diverted the discussion to Geneva convention.
Whatever you guys will do . One thing is Crystal clear we won't be leaving Cmdr Jadav soon. So India has three options :-
1) To perform Military action to save it's personal. The effects of any Military Action will be massive Pakistani retaliation. And will be escalated in go full fledged war. We have seen it after Mumbai and Pathankot attacks India won't do that as they know the scale of disaster awaiting them.
2) Offer Pakistan specially Pakistan Army something big which will attract Pakistan Army to release Cmdr Jadav. Similar to what USA offered to ISI for Raymond Davis.
3) forget about him and go on with your happy live

ICJ haven't heard merits of this case but since there is no access to the accused we dont really know what is the evidence against him how that evidence was collected so one only has Pakistani govts word for it which itself is the party to this case.

I can give it a try only if you are willing else its all waste of time.

Lets go step by step -
1- One is not an spy unless its proven in court.
2- Unless proven, one is innocent.
3- An innocent need to be provided fair trial and his choice of defence.
4- Viena Convention safeguard his rights.
5- Even if he is a serving armed force officer and raising war on pakistan, he shall be treated as per geneva convention.

Now tell me who were the defence lawyer for him and for what specific terror act he is sentenced to death.

Infact ICJ has explained in great details in #30 of its detailed order, clearly indicating, prima facie, that Pakistan action might have violated article 36 of Viena Convention and did not considered KBY being an alleged spy as an argument of him not falling under Viena Convention ambit.

Your whole argument lies with "He is a spy and a terrorist" but was the process which declared him so fair? Lot of explanations need to be given on this front and ICJ may deep dive into the same in upcoming hearings.

good. fake passport, caught in Pakistan, confessed to his crimes, Terrorists arrested confessed their relations with kalboshan, ex indian army soldier(indian claim) using fake identity. All points towards one thing. He is a terrorist.
By the way fake passport issue is not that simple like you made it.
