Pakistan And India-Water Disputes-News And Updates

China is doing the same why dont you tell her.
china don't have a treaty with you pakistan have.

International court of Justice has NO Jurisdiction over Indian policy matters.?
they have jurisdiction over illegal policy matters. every matter is a policy matter for other every country. thats how things work.
ICJ can be approached incase of treaties.

International court of Justice has NO Jurisdiction over Indian policy matters. Did you know this ?

Yes they have.

Similarly the UN security council has No jurisdiction over any bilateral treaty. Did you know that ?

Yes they have.

I encourage you to try your military option. I welcome it. India welcomes it.

IT would cost a few artillery shells and a few missiles.

You just saw what happened. IWT. It just died a quite death.

In dreams of you who is a Modi fanboy. Not in reality.

[QUOT]Well now you have admitted he IS doing something. I am glad you have hopes on Modi that he will deliver for you. Maybe you should put your hope on NS rather than Modi. But that is just my advice. [/QUOTE]

Keep feeling happy on something totally irrelevant. I would take it as an act of desperation where you want your PM to do anything to save his face.

Modi's job is to deliver for India, so from where I stand, you WILL get what you are supposed to  ....... I just don't think you are going to be too happy about it.

We would get 80% of river water. That is for sure. Other than that it is all drama by Modi.

So what you are saying that the whole IWT is useless since we anyway cannot stop your water.

Yes.

Then I think you should publicly tear up the treaty and show us. I guess that will put us in our place. How does that sound ?

Not needed. Why should we anyways?? India is doing drama over it. Let it do till it comes back to it senses.

The treaty has already died a quite death, they just have not realised yet. And there is no need to tell them either.

As for this silly matter of weather India can or can not unilaterally revoke the treaty, it is the same as asking can a spouse unilaterally seek a divorce ? The simple answer is YES.

The issue with them is that they havent read treaty and neither are ready to listen to even their own expert. In the interview even he acknowledges this..

"
In case India “revokes” the treaty, it literally means it has shunned it. The dispute resolution mechanism under article IX and Annexes F and G of the IWT will be of no use and assistance to Pakistan.

It is limited to a dispute under the treaty and not meant to provide for specific performance of the treaty itself.

Since there is no provision in the IWT about its duration or suspension, there is no avenue that Pakistan can approach for “revival” of the treaty. Nor can Pakistan approach the International Court of Justice seeking specific performance to implement the treaty because of the Indian reservation given under IC J statute that bars filing of case by Pakistan against India.

Now Modi has suspended IWT Commission. This practically means, Pakistan has almost no way of forcing India.

Like you said only time will tell. Lets wait for things to unfold ... latest update

Bhai we have been waiting for things to "unfold" since the brave leader Modi took office. Things have been unfolding on Twitter and Indian media only.

Wheat sowing season is coming up, if india regulates water flow during this season it might pose a serious threat.

Go ahead, try that. You can't fight us directly. You can't do surgical strikes. You can do jack shit other than throwing money at sellouts in Afghan government to kill innocents in Pakistan like your forces are doing in Kashmir.

Get this stupid idea out of your little vegetarian heads that Modi can do anything. He is just a cheap politician who promised you the moon and will leave you shitting in the streets same as before the elections. The only way you can help yourself is to recognize the plight of Kashmiris and stop terrorizing them. Let them decide for themselves. Otherwise you'll see a lot more Burhan Wanis and a lot more Uris. And you'll be left fighting your "war" on Twitter.

LOL.... the International court of Justice is NOT EVEN A REAL COURT.

its just a Tribunal. Its "judges" are just retired bureaucrats.

The ONLY thing it CAN do is provide advisory opinions on legal questions

So all the best for their advisory and opinions. Sounds dangerous. :P

The issue with them is that they havent read treaty and neither are ready to listen to even their own expert. In the interview even he acknowledges this..

We would go to arbitration court or world bank or UN since IWT has international guarantees.

And even if that doesn't work then military option is always ready and feasible since all your projects are in IOK and close to Pakistani territory.

It would cost a few artillery shells or a few missiles. And job is done.

So why did they stopped you from your work on Kishan Ganga Hydro Power project and why you followed their orders??

Wake up buddy. For you india might be a supa puwa but even a supa puwa like India has no choice but to follow few things in international diplomacy and politics.

if pakistan win the case there then you should forget both kashmir and water. you won't be fighting pakistan alone. it will become a muslim hindu war. india would be isolated in the world after the decision. and there is no nehru to take the issue into UNO to save you this time.

Yes they have.

Explained above.

Yes they have.

Nope. Only MULTILATERAL treaties come under UN. Bilateral treaties are the responsibility of the two member states who sign it.

IT would cost a few artillery shells and a few missiles.

Artillery is already being chucked across the LOC regularly by India. My suggestion would be to first test your missiles over the arabian sea. :P

Of course you will get the 80% of the " total river water". ...... only the "total river water" will reduce every year due to "global warming". You do not seem to understand this simple fact.

Not needed. Why should we anyways?? India is doing drama over it. Let it do till it comes back to it senses.

I was only asking you to walk the Talk. Looks like Modi is :P

In case India “revokes” the treaty, it literally means it has shunned it. The dispute resolution mechanism under article IX and Annexes F and G of the IWT will be of no use and assistance to Pakistan.

No party can unilaterally legally "revoke" this treaty. Despite what Modi tells you, it just can't be done. India "revoking" this treaty unilaterally means nothing to Pakistan and the World Bank.

Now Modi has suspended IWT Commission. This practically means, Pakistan has almost no way of forcing India.

India is just doing its typical randi rona to divert attention away from this Kashmir freedom movement. When your false flag attack in Uri didn't get the desired results, despite getting your soldiers slaughtered, your genius boy duo Modi/Doval are now messing with this treaty to give you guys a lollipop till the next issue pops up on your media.

That was because India WAS A WILLING PARTY to that dispute. We ALLOWED the CoA to Visit India and kashmir.

We acted in good faith.

But all that ends now.

We are NO LONGER WILL BE A PARTY to any CoA filed by pakistan. We will no longer entertain "fact finding" visits into "sensitive Indian territories" by the CoA.

We will permit the visit ONLY when the "region is safe" and pakistan ends terrorism :azn:

You see, we will be doing it for the safety of the CoA, assuming we even agree to be part of the Arbitration.

You see, Arbitration can ONLY take place if BOTH THE PARTIES agree to it  ...... that is the Fundamental Rule of ANY Arbitration.

Can you grasp this simple concept ?

if pakistan win the case there then you should forget both kashmir and water. you won't be fighting pakistan alone. it will become a muslim hindu war. india would be isolated in the world after the decision. and there is no nehru to take the issue into UNO to save you this time.

1. There is no "case", its NOT a cort. Its an ARBITRATION COUNCIL.

2. Arbitration can take place ONLY when BOTH the parties AGREE to be a part of that Arbitration. It CANNOT be Unilateral.

3. If you are threatening "Global Jihad", Bring it on

4. This is not 1945 nor is there a 'nehru' sitting in the PMO. There is a "darinder Modi" sitting in that office.

5. For now, its pakistan who is isolated in the global stage and its our current strategy to make it worse for you.

India has no intention of revoking this treaty.

We have only indefinitely suspended the Indus water commission. The treaty itself is alive on paper. SO you have nothing to worry about.

But all that ends now.

Only in your dreams baby.

We are NO LONGER WILL BE A PARTY to any CoA filed by pakistan. We will no longer entertain "fact finding" visits into "sensitive Indian territories" by the CoA.

You have no other choice. You will allow fact finding missions no matter what you dream.

You see, Arbitration can ONLY take place if BOTH THE PARTIES agree to it  ...... that is the Fundamental Rule of ANY Arbitration.

Doesn't matter for us. We would get our water no matter how.

Can you grasp this simple concept ?

Sure. And you would follow IWT no matter what. We would utilize all peaceful options before moving to military as a last option.

.

You do know that modern dams cant be broken with few artillery shells/low yield missiles , right ?

No party can unilaterally legally "revoke" this treaty. Despite what Modi tells you, it just can't be done. India "revoking" this treaty unilaterally means nothing to Pakistan and the World Bank.

India revoking treaty may not mean anything to WB, But should matter to Pakistan because of it being lower riparian state. Revoking treaty BTW is not intention of current dispensation. At least for not another 10 years.

Rest of your post was juvenile gibberish, so not responding.

We never had anything to worry about IWT. Its your media and right wingers getting their panties in a twist over it.

And like I said earlier, you can't "suspend" a commission that has members from three different parties. At most you can stop your officials from participating in its meetings. The commission will still be there even if there is no Indian in attendance. The treaty will still be there.

Explained above.

It is just a figment of your imaginations.

Nope. Only MULTILATERAL treaties come under UN. Bilateral treaties are the responsibility of the two member states who sign it.

This so called bilateral treaty has international guarantee. So it isn't bilateral to be honest. Try again.

Artillery is already being chucked across the LOC regularly by India. My suggestion would be to first test your missiles over the arabian sea. :P

And my suggestion would be for you to learn more about military equipment. Take your head out of Modi's as$ and learn more about them. After all you are on a Pakistani defense forum. Learn something.

Modi is my servant. He is the servant of the people of India. He will do what we WANT him to do. THAT is the reality.

HE is no superman. He would be forced to act as per ground realities. No matter what his low intellect public demand from him.

For now I AM happy. Are you ?

I am enjoying your delusions.

Of course you will get the 80% of the " total river water". ...... only the "total river water" will reduce every year due to "global warming". You do not seem to understand this simple fact.

As said before. Doesn't work that way. We have latest equipment and calculations to judge any claim. Such kind of buffoonery only works in your little lalaland.

I was only asking you to walk the Talk. Looks like Modi is :P

Lol Okay.

No point in arguing with Pakistanis. Let them feel good and have faith in India's good intentions and let them have high regards about Indian govt. Let Pakal dul, sawalkot, burrsar, Kishan Ganga, Baghlihar II etc dams come up. Let each filling of these dams block the waters. After India maximize the usage as per the treaty the next phase of dams which will be the violation of the treaty.

As of now the dams in the pipeline will take atleast a year to fill. The question is not Pakistan here. The issue is the serious of the Indian govt. in construction of these dams. These will take a few years but will have a deadly impact on Pakistan.
