Nation to mark Kashmir Solidarity Day today: February 5th

Mirwaiz asks India to eschew state of denial

NEW DELHI—Thanking people and government of Pakistan for observing Kashmir Solidarity Day on Feb. 5, APHC Chairman Mirwaiz Umer Farooq demanded India to come out of the denial mode and resolve Kashmir issue for the sake of regional and global peace.
Talking to reporters from Srinagar, Mirwaiz while referring to the forthcoming Kashmir Solidarity Day being observed in Pakistan, two parts of Kashmir and by Kashmiris all over the world, Mirwaiz said the world community has realised that the world peace can not be ensured till the resolution of thorny issues of Kashmir and Palestine.
He said Kashmiris are thankful to Pakistan and its people for playing their role in addressing the issue. Pakistan as a party to the Kashmir dispute is extending diplomatic, moral and political support to Kashmiris in their struggle for right of self-determination.
It is heartening to note that political parties and all segments of society in Pakistan have always stood with Kashmiris and Kashmir Solidarity Day will be a moral boosting for them.
The time has come to step up diplomatic efforts at international level for resolution of this issue which has made over one billion population of South Asia a hostage.
Since world peace is related to thorny issues like Kashmir dispute, he hoped the United States and other powers to play their role in addressing the issue. Asking India to come out of its denial mode on Kashmir, he said APHC as a party is ready to play its due role to address this issue. The sixty years history is testimony to the fact that the military force is not a solution to the problem. He asked both Pakistan and India to restart peace process and take Confidence Building Measures on Kashmir for the sake of peace in the region.
Stating that finance is no problem for the conglomerate, Hurriyat (M) chairman, Mirwaiz Umar Farooq Monday said the movement powered by popular sentiment cannot fall short of resources. Talking to Rising Kashmir over phone, Mirwaiz said, “Finance is no problem as the movements powered by the popular sentiment cannot fall short of the resources. We have enough resources but we will not let it go waste”.
The Hurriyat (M) chairman said that they are in a process of restructuring and rationalizing the resources. “This is not the movement of the salaries and payments. We have to be committed for a cause and voluntary effort will be appreciated and encouraged,” he said. However, Mirwaiz was quick to add that the basic needs of the fulltime workers will be taken care of. Stating that he had started a fund raising organisation ‘Darul Khairaat’ few months back, Mirwaiz said, “The response from masses has been tremendous. We are receiving getting huge donations and have the responsibility of using the peoples’ money in a judicious way.” Citing the example of the summer 2008 anti-India protests, Hurriyat (M) chairman said, “People paid voluntarily for petrol and diesel of vehicles during the TRC, Eidgah and Pampore chalo rallies.

I bet they would want to join Pakistan or independence when they have started to reap the fruit of econimic growth....

Jab pet ki bukh sataati haina, tab ye azzadi pet ni bharti....

Kashmiris have started to understand that their welfare is with India only. This was evident from the recent election polls when separatists have to bite the dust.

Well done Kashmiris. You made India proud by your participation in democratic procedure, rather than being on the path of Pakistani Kashmir which is yet to see a fair election poll.

its not 'u', mate, it is 'WE'. we fought britishers when they were treating india as a colony. but did we kill innocent britishers in london? no.

btw, all the terrorists were pakistanis(punjabi/sindhi) not kashmiris. so comparing it to OUR freedom struggle is wrong.

did i ever talk about terrorists who attacked mumbai??? dont confuse jihad with terrorism. jihad is in kashmir where freedom fighters are fightin against ur army. however when civilians get killed in bomb blasts etc that is called terrorism...

. .

Kashmir Solidarity Day observed in Malaysia
ISLAMABAD, Feb 5 (APP): Like other parts of the world Kashmir Solidarity Day was also observed in Malaysia to mark the just struggle of Kashmiris for their right to self-determination and to remember the countless sacrifices of those Kashmiris who had laid their lives for the cause. To express solidarity with people living in occupied Jammu and Kashmir a forum titled Kashmir A Human Dilemma was organized by Global Peace Mission(GPM)of Malaysia, in collaboration with the Pakistan High Commission, at a local hotel, in Kuala Lumpur, today.

As a mark of respect to the valiant struggle of Kashmiris in occupied Jammu and Kashmir, one minute silence was observed and, messages of the President of Pakistan and Prime Minister of Pakistan on the Kashmir Solidarity Day, were read by the officials of the Pakistan High Commission. The President and Prime Minister in their separate messages exhorted the international community to play its due role in bringing an end to the repression and human rights violations being committed against the people of Indian Held Kashmir and reassured the Kashmiri brethren of Pakistan’s unflinching support to their struggle for realization of their right of self-determination.

The renowned Malaysian scholars and human right activists including Dr. Chandra Muzafar, President of International Movement for a Just World(JU’ST), Dr.Christoph W. Marcinkowski of International Institute of Advanced Islamic Studies of Malaysia (IAIS), Prof. Dr. Abdullah Ahsan of International Islamic University of Malaysia (IIUM) and Dr. Rohanas Harun, of University Kebangsaan Malaysia(UKM), addressed the selected invitees including students, teachers, business community, representatives of NGOs and cross section of civil society.

Mr. Yusri Mohammad, President of Muslim Youth Movement of Malaysia said that our presence in the seminar is an apt reflection of our solidarity with the Kashmiri brothers and sisters who are struggling to get their just right for self-determination.

Dr. Chandra Muzafar, President of International Movement for a Just World(JU’ST) said that the Muslims around the world should pool up their resources to advocate Kashmir, Palestine and other issues confronting to them in a peaceful and convincing manner.

He said that in this regard, they should engage the powerful International media to propagate their point of view to the different countries of the world, keeping in view their languages, culture and preferences. By doing so, the world opinion will change in their favor which would help in just solutions of the problems confronted by them, he added.

Dr. Christoph W. Marcinkowski of International Institute of Advanced Islamic Studies of Malaysia (IAIS) and Prof. Dr. Abdullah Ahsan of International Islamic University of Malaysia (IIUM) gave the historical perspectives of the Kashmir issue and said that the Kashmiris are peace loving people and are influence by Sufism which preaches peaceful coexistence with people of other religions and ethnicity. It is only the betrayal of Kashmiris by the British and Indian leadership that they are left with no choice than to wage struggle for attaining their inalienable right of self determination which has been denied to them, they added.

Dr. Rohanas Harun, of University Kebangsaan Malaysia(UKM) said that it was India who took the issue of Kashmir to United Nation Security Council(UNSC) and therefore was bound to honor the resultant UNSC’s resolutions on Kashmir. She said that viable solution to Kashmir issue could only be found in faithful implementation of UNSC’s various resolutions which has stressed holding of a plebiscite to let the people of Kashmir to decide their accession to India or Pakistan.

The High Commissioner of Pakistan Lt. Gen (Retd) Tahir Mahmud Qazi in his concluding remarks said that the partition treaty of British India into Pakistan and India clearly laid down the principle of accession which stated that the people of Hindu and Muslim majority princely states will decide their accession to either Pakistan and India through plebiscite. This principle was also endorsed by various Resolution passed by UNSC on Kashmir but, unfortunately this right of self determination has been denied to Kashmiri people even after sixty year of partition.

He said that Pakistan has always extended its moral, political and diplomatic support for a just and peaceful resolution of Kashmir dispute in accordance with the relevant UN resolutions and aspirations of the Kashmiris, however, the world community should play its active role in supporting people of occupied Jammu and Kashmir for attaining their inalienable right of self determination. He said Pakistan will continue extending its moral political and diplomatic support to Kashmiris for their right of self determination.

Global Peace Mission also held an exhibition at the same venue wherein various posters, brochures and other relevant material on Kashmir dispute were exhibited. The participants of the Talk expressed their keen interest in the exhibits and reference material on Kashmir dispute.

Then why dont you allow a plebiscite, Im sure Kashmiris would love to be Indians if they are so happy in India.
Omar,

That's exactly right. India is providing all this 'great infrastructure' , and Pakistanis still don't know what cars are. One would think then that India would have no trouble implementing her commitments under the UNSC resolutions and Instrument of Partition and hold a plebiscite - I mean really, trains like these and Pakistanis don't even have cars! Its a simple choice for Kashmiris right!

Thursday February 05, 2009

Kashmir Solidarity Day is observed on 5th February throughout Pakistan on both sides of the Line of Control and across the world to demonstrate that the entire Pakistani nation is united in its support to their Kashmiri brethren for their inalienable right of self-determination promised to them by the UN in 1948 and 1949.

As a matter of fact, due to the apathy shown by the UN and the big powers India has always refused to implement the UN Security Council resolutions for the last 60 years that gave Kashmiris the right through plebiscite to join India or Pakistan. The US and the West have double standards. Take the case of East Timor, which was carved out of the largest Muslim country of the world. A resolution was passed within months and implemented within weeks.

In 1991, when Iraq invaded Kuwait, once again UN Security Council passed the resolution to punish Iraq, which was implemented immediately because it was in the interest of the US and the West. It does not look like that they will do it because only when public protest fits into the geopolitical designs of the US and the West that they declare it a popular movement and honour it with the award of a `colour label`. The `orange revolution` of Ukraine, the `rose revolution` of Georgia, the `cidar` revolution of Lebanon and much earlier velvet revolution of Czechoslovakia would pale before the Kashmiris` movement for their freedom yet they were given colours by the colour-blind big powers. It has to be mentioned that in none of the above cases there was a UN mandate whereas Kashmiris have been given their inalienable right of self-determination by the UN in 1948 and 5th January 1949.

International community should stop India from perpetrating atrocities on the people of Kashmir and also understand the gravity of the situation, as this conflict has the potential to big conflagration that could adversely impact the region and beyond. Historical evidence suggests that Kashmiris have passed through the longest ordeal and faced death and destruction. They had faced repression even before the partition when the British had sold Kashmir to Gulab Singh, a former governor of Maharaja Ranjeet Singh, for 7.5 million rupees. Once again at the time of partition when people of Kashmir had dreamt of freedom from oppression, India accepted Lord Mountbatten as the first Governor General of India with a view to exacting undue favours from the `friend`.

The plan of annexing Kashmir was contrived and implemented by Lord Mountbatten and Nehru when Raja Hari Singh was coerced into signing the controversial document. According to another report, a fake document of annexation was prepared by them, and it was on the basis of this document that Indian forces entered the Valley and annexed Kashmir. It is an irrefutable fact that on 19th July 1947, Muslim Conference organised a convention and passed a resolution for merging with Pakistan, which stated: "This convention of Muslim Conference has reached the conclusion that geographical conditions, 80 per cent Muslim population, important rivers of Punjab passing through the state, language, cultural, ethnic and economic relations and contiguity of the state with Pakistan make it imperative to merge with Pakistan". According to the Partition of India, the accession of the State of Jammu and Kashmir was to be decided in the light of its people`s wishes.

However, India occupied the State through military force and claimed it as an integral part of India. Earlier, changes in the Radcliff Award were made through intrigue by Lord Mountbatten by giving Gurdaspur to India otherwise India had no road link with Kashmir. When volunteers from Pakistan entered Kashmir to help Kashmiris in their struggle for freedom from illegal occupation, it was India that took the matter to the UN under Chapter VI of the UN Charter dealing with Pacific Settlement of Disputes.

According to Tashkent Declaration after 1965 War and Simla Agreement after 1971 War, both India and Pakistan had agreed to resolve all disputes through bilateral dialogue. Since then, India has always taken the position that Kashmir issue is a bilateral matter, and thus refuses to accept third party mediation. Former President Musharraf had more than once expressed Pakistan`s willingness to go beyond their stated position provided reciprocated by India. But India did not respond to these gestures; hence no progress could be made towards conflict resolution. He was of the opinion that the situation after 9/11 warranted a change in the strategy to resolve the issues, as the US had come out with the doctrine of pre-emptive strike. India mistook it as a carte blanche to all the `big and mighty` and thought it could apply the same in this region.

India has been harbouring the idea of limited war up to 2002 when it moved its forces close to the Pakistan`s borders. It was a war of attrition. And when India felt that Pakistan would not be cowed down, it ultimately withdrew its forces to the original positions. It was in view of post-9/11 scenario that Pakistan had hinted that both countries should go beyond their stated positions with a view to finding a solution of the Kashmir dispute, which was acceptable to India, Pakistan and the people of Kashmir.

There is no doubt that People on both sides of the Control Line want peace and wish that Kashmir dispute be resolved through dialogue, as they do not wish to live in trepidation and fear. The US and the West should, however, realise that India has been using bilateralism only as a ploy to retain its illegal occupation of the disputed territory. But with a view to appeasing India because of its size and population, they do not force India to implement the UN resolutions or resolve the Kashmir dispute through bilateral talks. It should, however, be borne in mind that if larger and stronger countries continued to turn a blind eye to their cohorts` hegemonic ambitions, the dream to make the world a safer place to live would never come true.

In an article published in the Asian Age - an Indian daily, the writer had discussed the possibility of resolving the Kashmir issue on the lines of an agreement reached over Andorra in 1993 between France and Spain. Andorra is a co-principality situated on the border of Spain and France in the Pyrenees Mountains, and co-princes are Bishop of Urgel (Spain) and the French President. It joined the United Nations as a member state in 1993, and is recognized as a parliamentary democracy. The other proposal was to make Kashmir Valley an independent state, Jammu and Ladakh to remain under India`s control whereas Azad Kashmir and northern areas to remain under Pakistan`s control. But the problem is that whenever in Indo-Pak dialogue the point of resolution of Kashmir dispute came, India did something to foil the dialogue, as it happened after Mumbai terror attacks in November 2008.

In case, India continues to balk at resolving the Kashmir dispute, and does not reciprocate with Pakistan to reach a solution acceptable to India, Pakistan and the people of Kashmir the only way out for Pakistan would be to invoke the UN Security Council resolutions. The international community has to understand that Tashkant and Simla agreements were signed by Pakistan under duress. One should not ignore the fact that Article 103 of Chapter XVI of the UN Charter clearly states: "In the event of a conflict between the obligations of the members of the United Nations under the present Charter and any other international agreement, their obligation under the present charter shall prevail".

India is focusing on confidence building measures to enhance people-to-people contact, cultural exchanges and economic cooperation, but these are not alternatives to the resolution of the Kashmir dispute over which both countries had three wars. International community should, therefore, help resolve the Kashmir dispute to avert the impending disaster.

What happened to the ban? Was it a temp ban like the ones on defence.pk? :D

Your country is suffering more, frankly. If you're fine with Jehadis addressing public rallies then what can anyone say about it.

The leaders are arrested, assets seized and the organization is banned. The GoP cannot go around arresting everyone who claims to be a member of the organization. That is more than enough. A bunch of people getting together and rallying under a JuD placard is no violation of that ban IMO. Now if they were to start raising funds, then they would start operating as an organization again, and the GoP would have to take notice and shut down such fund raising activities.

Seriously, under Indian laws, if you claim to be a member of a banned organization, do you automatically get roughed up and thrown in jail for twenty years? Or do you have to commit a crime and have an 'official banned organization membership card'?

Sir i was not being sarcastic. They can compare their standard of living against the Kashmiris in Pakistani Kashmir. They know the difference.

And India has no need to hold a plebiscite of any sought inside it's own territory. Why don't Pakistan hold a plebiscite in Balochistan then.

And rest was proved by the recent elections when voter turnout was higher than states like Delhi, Rajhastan, etc. This tells how eager Kashmiris are to participate in Indian democratic system.

I have personally met Kashmiris as I live in Jammu, joining Pakistan is the last of three options for them. Independence of Kashmir was not a part of solution in the UNSC resolutions, so for them better choice is to be with India, and thats what they are doing and will be doing.

And for Pakistan, you can try and keep spending your valuable resources on kashmir issue. Best of luck
