NAB laid down condition for Nawaz Travel to the UK

mayusi gunnah hay. have faith.
In what?
Faith in government? In the justice system? In the army? In God?
None of these appear interested.
What have you seen in the last 70 odd years to induce faith.
Justice is the very least that one should expect from a state and society for which one is prepared to lay down ones life to defend.
And yes, you are right. For the first time in my life I feel, disappointed, dejected, alienated, in despair and utterly let down at seeing these thieves so blatantly being allowed to walk away from their crimes when a bullet in the head would be too good for what they have done to our country and nation.
The well of faith and hope has finally run dry. There is absolutely no hope for the poor and weak of this country.
Would an ordinary criminal be allowed to do what they are doing? If the answer is no, then it is nothing short of an outrage if NS is allowed to do it just because he is wealthy.
It's an utter piss take.
It's an outrage.

I'm not exactly a lawyer, but the collateral presented to the court was for securing bail.

This collateral is for getting his name out of the ECL.

Unless getting bail automatically means getting your name out of the ECL, then this does make logical sense. Don't know about the legal aspect of it though.

You are absolutely correct first was to secure the bail, since IK and many of the cabinet member (PTI walay not recent parachuters) know it will be a political suicide to let him go without some sort of surety thats why they agreed to conditional removal from ECL provided if a surety amount is deposited, and their usual guarantors too know he isn't coming back that's why they are not submitting anything; gongloo brothers don't want to cough up that kind of stash for daddy dear, now noora and his family could go to the court again and get the relief as usual from there. IK is not simply rolling over so ball is in the court of Lawhore/Min-Noora High Court and Maslihayat Head Quarters.

If court grants bail then the person is free to do whatever he/she wishes to do. As per majority of the legal experts opinion Government can not ask for collateral.

One thing to be remembered is that Nawaz Sharif's case is to be heard by Islamabad High Court during November within 8 weeks bails period. What if the judgement is reversed and case sent back to trial court.

Also government case is weak since the same procedure has not been adopted in any other person's case.

IK has made a political mistake. Remember Nawaz Sharif returned to country after he was sentenced so his case is strong.

IK has entered a situation where he stands to loose if Nawaz goes abroad and he stands to loose if Nawaz dies of illness inside Pakistan.

IK had a golden chance to get rid of his strongest opponent but he has made a bad decision.

Point to be remembered is that law minister was and perhaps still is the lawyer of the Pervaiz Musharaf and his judgement in any case shall be considered biased towards Nawaz Sharif.

IK should not have let him make the recommendation.

Legally case falls in Punjab Governments jurisdiction and as per their health minister Nawaz Sharifs health is critical and same has been verified by medical board. If Punjab Government does not have any objection then federal government should not make a mess of it.

Nawazu is haddi stuck in throat na baher ae na nigli jae, ready for another u turn by IK as Nawaz not in a hurry to leave Pakistan without his conditions.

It is IK who is stuck. Nawaz stands to gain whether he goes abroad or stays in Pakistan. If he goes abroad IK's entire fight against corruption slogan shall suffer and if he stays in Pakistan he shall get the sympathy of the people.

So, basically the Government has shot itself in the foot. Now if the Cabinet withdraws the conditions and lets NS travel without any surety bonds, it will be a bigger defeat than NS going out of the country without the Cabinet's juggling with the ECL.

. .
In short, the government was left out of the "deal" and was not consulted. The players of the deal thought that PTI would roll over. It didn't. And IK wants to make sure that there is no exit avenue in place for NS.
Yes agreed...

Also, the understanding I got is that problem with following the law to do plea bargain is that the amount can only be as much as involved in tgat particular case.

So under the table deal is required to get any part of the rest of billions of dollars amassed abroad.

However, the deal should not be without plea bargain on top to make it legal as well as acceptable for PTI voters.

This was an escape planned to ridicule PTI politically. Not allowing Nawaz to go abroad is violation of Khota highcourt verdict that allowed it against law.

So PTI has imposed just as extra-law condition as highcourt allowed Nawaz...

So if Nawaz does not come back then PTI can politically counter it and tell voters it had contingency amount that GOP would have got in plea bargain at least...Also, courts will have no choice but to rule against Nawaz. PTI saves itself from wrath of court now as well as when he obsconds.

The under the table deal, if not smokescreen by some elements or PMLN itself, was good for Sharifs too as they live to comeback to rule again...but this condition by IK has made absconding as good as plea bargain.if nawaz does not return...

A timely wakeup and recovery of lost political and l egal initiative just in the nick of time by IK...still lets see how it goes from here...

Sparing an ill thought for the very ill Nawaz... Did Shahbaz just doublecross is brother? LOL...

May Allah have mercy on Pakistan and guide us through troubled times towards a better future, Aameen, In sha Allah...and in the name of Allah:

Wa Makaro wa MakarAllah, waAllahu khairul Makireen.

Depends on which legal expert you ask. The former NAB prosecutor Raja Amir Abbas and Barrister Ali Zafar say that collateral can be obtained.

And he is free to do whatever he wants, as per the bail order. But it doesn't specify that his name be taken of the ECL. Both things are mutually exclusive. Why could not the court have done the same as it did with Maryam? Taking away her passport? Because the deal was that Nawaz only goes abroad, while Maryam does not.

ECL law does not allow government to obtain collateral.

Here is the law:
