In normal cases you would be right but in this case,honesty is a must in my book.And you'd be breaking the law. I wouldn't fire her, instead I would implement a strict dress code company wide, with at least a month's head notice to figure of any personal needs of employees. There is a better way to fix this issue, other than giving employees false choices.
Why not apply in the Hijab,is it because she knew that she would never get the job?
I have fired many people for being dishonest,i had to pay costs but that doesnt matter in such a case.
