Faith has nothing to do with human physiology and anatomy. ;) Humans have been procreating long before any texts came into being!

as a Muslim - The Law of Allah is above any other man-made constitution. You can declare RAPE as legal, declare mudering as legal but it does not mean it will become legal in Islam.

I ain't saying u declare these crimes as legal but even if you do, it doesn't matter to me being as a Muslim.

Yes it does, all muslim males are circumcised before teens even at birth, so there is physical diffwerance in Muslms and others.

Secondly A muslim man cannot walkaway from his first for the lust of secon wife, he has to show a compelling reason for it. be it that the lady cannot have childern and still he need her permission tio go ahead with second marriage.

What you describe is the position in Pakistan and Bangladesh under the Muslim Family Laws Ordinance, 1961, which requires an application before an Arbitration council, giving reasons and consent of the first wife.

This is not the position under Indian law. Under Indian law, a Muslim man can marry another wife without giving any reason and without any consent of the previous wife/wives.

ALLAHABAD: The Allahabad High Court has held that a Muslim man's marriage to a woman of another religion shall be considered void and against the tenets of Islam if he fails to get her converted to the religion before wedlock.


It may be some what normal practice with such conversion however fact is that if a women convert to Islam just to get legal marriage certificate, is questionable to whole conversion process. This conversion neither will make her Muslim nor legalized the marriage according to Islamic law.

I know Muslim men are allowed to marry Christian or Jewish women without compelling them to convert. This case is about a Muslim man marrying a Hindu woman. That's not permitted, it seems. Yet in the article the judge appears to expand the rule to include ALL women, no matter what the religion.

This seems unlikely. Sloppy reporting is more probable.

Quran Clearly allowes marrige to Christians and Jews and those the followers of Prophet Dawood (David).

Muslims are not allowed to marry any girl from another religion unless she herself converts to Islam without being compelled or just for the sake of that Man.

Circumcision has nothing to do with religion (FYI the Jews also circumscribe their infants). Actually, scientifically speaking, there are reports that circumcision helps prevent STDs, dont ask me how, because, mechanism wise, I dont know how!
And your talk about a physical difference is, sorry to say, very ridiculous. Dont take it personally, but with a background as mine (dont even think about asking what - I wont tell), I find that assumption highly ludicrous! Ask around about this "physical difference" to any of your physician friends - if they agree, they are surely humoring you!
And as raleigh22 put it, Pakistani laws differ form Indian laws. This side of the border, you can do pretty much anything you want till the constitution guarantees your rights.

So, tell me, do you consider all marriages before the advent of Islam as illegal/void? All that procreation which gave birth to our ancestors was a sin?

Like I said, religion has nothing to do with procreation. Indian Constitution gives all Indians the right to procreate, they be of any faith. Just to mollify certain religious elements, we have these different marriage acts!

Now regarding the topic in question, the man was trying to commit adultery by lying about his first wife (even Islam would recognize this as adultery). The judgment serves him right. Let him first get a divorce and then marry the other girl (who happens to be a Hindu), or convert the second girl to Islam. Simple.
 
Stories like these make me cringe. About time we stopped having seperate laws for different religions & have a uniform civil code. For a start, it could be voluntary excepting for marriages between people of different faiths where it must be compulsorily registered under a common civil code regardless of whether a party converts or not. That will prevent the misuse of personal laws as has happened in this case.

No my friend, I am not. I am just stating the facts. Some claims are so ridiculous that it defies logic and proven scientific facts.

Re-read the original article. The judgment was a sound decision. And the decision was based on the laws framed under the Indian constitution.
 
based on what i understand is that muslim men are only allowed to marry muslims or Ahl al-Kitāb (People of the book), who followed the true teachings of Musa and Isa, which is to beleive in one god, Allah

but i think that people should read the quran to get a better understanding at these things
 
now after going through all the post and clearly understanding Islamic and Indian laws now i know why BJP wanted to ban religion conversion in India , if that law had been passed then Hindu girls getting married to Muslim Man could have been illegal in all laws and since conversion was not allowed by law also , now i know why people from Christian and Muslim community where against this law

Not that I support any anti-conversion law, but you seem to be misinformed.
Such laws exist in a few states and even there do not ban conversion per se. They require the authorities to be informed before any conversion takes place and provide for punishment in case this is not done. So people can still convert, after informing the authorities.

So your conspiracy theory about Christians and Muslims opposing such a law because it would thwart their plans to convert Hindu girls does not hold true.
 
This will open a can of worms.

I have friends who are married to hindu / christian ladies and vice versa who follow their respective religions.

Will this mean their marriages are annulled ? This has implications on issues like property, children and so many more issues.
 
Whatever happened to marrying someone because you loved them? Placing so many restrictions, tsk, tsk...
