Sheesh... It's never late to castrate someone, the pain will probably put the guy in a coma till he dies; see: "eye for an eye".:-)

Well ayesha if you consider the state of victim and the life she had to spend (on support of others), (sorry for wrong choice of words), but she was no better than a dead person. She lost her dream, life and everything else, and for her medical condition, Hospital management should've known, that she has nothing to loose.
In these circumstances, Rape charges should've been pressed and strictest punishment meted out to the beast who led to her condition.
It wouldn't have made any difference to Aruna, but atleast made out an example for others than such a wrong doing and ruining an innocent life will lead to harshest possible punishment.

Yes, I know, and wish that had happened. (Rape charges being brought against the rapist.) But do note that the maximum punishment for rape was also ten years, until recently. Besides, since she was not vaginally penetrated but anally, he would have gotten away with the lesser charge of "unnatural offence". Suffice to say, the punishment in India for such crimes are not proportionate to the severity of the crimes.

In any case, when she was known to have suffered such severe brain damage, social stigma should have been the last of her concerns. The director of the hospital should have known that it was more important to bring the rapist to justice, than worry about social stigma, which the victim couldn't feel anyway.

Re-opened how? The man served his sentence, what's the point now after 42 years?

Getting emotional now is what I question, this case could & should have been dealt with strictly when the crime happened, What is the point now when that poor woman has been in a vegetative state for so long.

Justice? Vengeance? What is the point of punishing any criminal? Either deterrence, or vengeance, right?

The rapist was never prosecuted for rape - so whether or not 42 years have elapsed, he still remains unpunished for that crime.

Note: I know that it cannot and will not happen. I am simply answering in the abstract, your question of what the point is. The purpose is the same as it is for any case of retributive justice.

My point was that 42 years ago was when the case should have been prosecuted fully. There is absolutely no chance of a reasonable prosecution now with such a tampered case. Quite a lot of people were involved in acts of covering up which pretty much qualifies as obstruction of justice. Where is the evidence now? On what basis can a prosecution be launched? Substituting emotional arguments for reality is simply not helpful.

If so, they should also be prosecuted for obstruction of justice. OoJ is itself a crime, not a defence.

I'm sure there is evidence for anal penetration - that can be established even from her corpse. Besides, since then, many people have spoken up about what really happened to her. Their testimonies, and physical evidence of rape can surely form the basis for reopening the case, can it not?

Nope. Not after so much time. People speaking is not enough, introducing new evidence after so many years is itself troubling but with just talk, the case can never go anywhere.

We absorbed different provision in different democratic countries for our Constitution.

I was talking about some aspects about Sharia law for punishment cases like this.
