Modi's war against farmers

Its not fifty years, don't just blindly believe every thing you read on the internet. Lot of it is propaganda, deliberate distortion of facts, in other words Congressi dirty tactics, you are better than that.

The land in question here were bought in 2006.
It's not propaganda. Being a Punjabi, I have been following this case closely for the last few years. I'm not a congress supporter, so there is no question of this being congress propaganda. Politicians only get the courage to do wrong when their own supporters blindly support them even when they are wrong. When the wrong doings of a politician are pointed out, then the supporters of that politician begin to cry "opposition propaganda!" to silence any sort of sincere criticism. Problem with our country is that we only condemn politicians/Mantris if they happen to belong to the opposition party. No wonder politicians get way with anything while screwing the people.

You might not be a Congressi but you are a gullible victim of Congress propaganda. Saying that the Sikh farmers have been dispossessed of the farm lands which they had owned for 50 years (half a century), when infact the land in question were bought only in 2006, is pure propaganda.

says who? did you even watch the video? and let's say if your claim of buying land in 2006 is true, then why are they still being harassed by Modi if they are now the owners of that land?

Around 5,000 Sikh farmers from the Kutch region in Gujarat have accused the Narendra Modi government of trying to evict them from the land they have been tilling since 1965 after calling them grabbers and outsiders.

According to a report in The Hindu, the farmers have now approached the Supreme Court after the state government refused to abide by a Gujarat High Court bench directive.

The newspaper quoted one farmer Lakshman Singh Brar as saying Modi met recently "threatened them with dire consequences if they did not surrender the land and leave."

The farmers were speaking a press conference in New Delhi on Thursday with the support of All India Kisan Sabha (AIKS).

The report quoted another farmer who said their families relocated from Punjab and Haryana on the assurance of then Prime Minister Lal Bahadur Shastri and tilled the arid land to grow cotton and wheat.

An AIKS leader said the Gujarat Government wanted to hand over the land for real estate.

The Kutch district collector, said the farmers, froze their land revenue accounts, alleging they were "outsiders".

The Shiromani Akali Dal too has intervened in the issue but said that according to the Gujarat government, there were only 28 Sikh farmers in the area and the rest were land grabbers.

KN Bhatt, secretary, state revenue department said the land was seized from people who did not have proper records of being farmers. Those who produced records have already got their land back, he said.

Farmers of Punjab, Haryana and other states were invited to settle down in Kutch after the 1965 war to prevent infiltration by Pakistan. In 2010, the state government froze the land holdings of nearly 1,000 farmers under the Bombay Tenancy and Agricultural Lands Act, 1948, which bans sale of agriculture land in Gujarat to people who are not traditional agriculturists. There are around 5,000 Sikh farmers in the region.

Neither the 72' nor the 48' acts were made by Modi. And the govt is bound to follow the laws. And the entire problem is that law prohibits them from ownership of the land.

If certain transactions happened, and govt failed to act that time, doesn't means that it can overlook the problem now and not do the needed. They are not being harassed by Modi, but law made by former govt which was looking after poor farmers and farmworkers in its time.

Thats where the legal part comes in. According to the amendment brought in by the Congress government of Gujarat in 1973,

" On on April 4, 1973, the Revenue Department of the GoG had passed a circular [No. TNC/1073/58184] which essentially implied that if an individual wants to buy agricultural land solely on the strength of his status as agriculturist in a State outside Gujarat, that individual will be a ‘non-agriculturist’ and will be disabled from buying the said land."

According to the Gujarat government's interpretation of the law , the people who should get to avail this facility should be agriculturists in Gujarat. The current government is merely trying to implement the law, the law which was brought in by Congress mind you. Gujarat governments argument is that the agriculture land was being made available for landless farmers and laborers, to improve their economic status and not for rich land owners from other states. It also means that you can not sell the land meant for agriculture to someone else to set up a factory or any other purpose.

The farmers in question are disputing Gujarat government's interpretation of the law, and that is why the case is in the court. I mean this is pretty much the reason why courts exist right, to settle disputes.

Be it farmers, be it industrialists, be it anyone, everyone has to follow the rule of law. Whats next if Gujarat government doesn't give clearance for some factory because it was in violation of local laws, then it becomes Modi's war against industrialists?

Modi puts record straight on Sikh farmers’ issue

In the controversy over farming land of the Sikhs in Kutch district, Gujarat Chief Minister Narendra Modi said that stories of Sikhs being harmed, targeted or terrorised in Gujarat were incorrect and misleading.

Modi had a meeting with leaders of Sikh Community in Gujarat and assured them of all possible help. He also talked with his Punjab counterpart Prakash Singh Badal on the issue.

Post 1965 India-Pak war nearly 1,000 Sikh families migrated to this bordering district and started farming. Some of them purchased the agriculture land too. The issue arouse out of a 50-year-old policy in Gujarat on agriculturist. As per the Bombay Tenancy and Agricultural Land (Vidarbha region and Kutch area) Act, 1958 agriculture land cannot be purchased or retained by a ‘non-agriculturist’. An ‘agriculturist’ defined in the Act as a person who owns and cultivates land in Gujarat.

“In pursuance of the provisions of the Act, the then Congress Government ruled by Chief Minister Ghanshyam Oza issued a circular saying that the cases of sale to any non-agriculturist in Gujarat should be examined immediately and prompt action should be taken to deal with the provisions of the relevant Acts,” said the State Government.

The Kutch District Administration seized some 784 land owning accounts which are not in consonance with the provisions of the above prevailing land laws. This includes 108 accounts of persons of Gujarat origin, 512 accounts of the people from other States and 164 accounts of the persons of Punjab and Haryana.

In fact 454 Sikh farmers were given land in Kutch for cultivation by the State Government. The exercise of freezing the accounts does not apply to them. They are bona fide cultivators authorised by the Government itself. It means Modi is ‘victimising’ Sikhs is not true,” said a senior bureaucrat adding that as per 2001 census survey, there are 45,587 Sikhs in Gujarat who are all living very peacefully, happily and harmoniously.

The State Government also clarified that the matter is sub-judice in the Supreme Court which has given an interim order that “parties shall not create any third party interest”. The next hearing is slated on August 27. Meanwhile, the Gujarat Government would try to ensure that the Sikh farmers would not be put to any undue hardship, Modi said, adding that it is imperative that everyone should wait for the verdict instead of making provocative and malicious statements.
