The court has the power given by constitution to check for any anomalies. The police filed a report that the girl is incapable of making decision on her own. Hence the court decided based on the evidence provided by the police and the anomalies in the affidavit.
Neither the police filed the case of her being incapable, nor any Medical Institute has been contacted to check it. This is the most foolish mistake of the Kerala Court where it itself declared her incapable of taking decision. It is simply a case of Hindu Extremist Judge who is killing the justice for his prejudice.
Supreme court don't take witness account directly. She needs to file an affidavit. Since she is incable of filing such, the court wants to see the investigation happen.
Again a lame excuse. Supreme court neither asked her to appear in person, nor asked for any affidavit from her, but simply ignored her totally and simply linked her individual case to the terrorism and delayed her the justice.
Justice delayed, is the justice denied. And Indian Supreme Court is the culprit here for delaying the justice.
Being in a whatsapp group is not reason for arrest. They need evidence and they can't investigate based on their own thoughts. So, there should be an authority to direct such an investigation.
What a false excuse. NIA has the full rights to investigate and arrest in case of any suspicion. So the question remains there why didn't the NIA has not yet independently investigated the case, although this marriage took place in 2016 and then even after the high court decision?

Let the investigation go on. If the guy is found innocent, he can marry her if she accepts him again. But the women should go through proper counseling. I don't think she is stable. I've seen enough news about her. She is not acting like a normal person.

Kerala High Court neither sent her to any medical center for the check up, nor presented any other reason for their decision for rejecting her direct witness.
Regarding the investigations, firstly they should have been done even without her case, and secondly her case should not be linked to the investigations, but to her own testimony as an adult.
But both the Kerala hight court and the Indian Supreme Court denied her the basic human right of her personal choice and her witness and thus robbed her off from her right of decision. This has nothing to do with the investigations, and thus very shameful act by these courts which are unprecedented in the history of judiciary.
