A Japanese court ruled that extramarital affairs are alright, so long as they’re done for business purposes.

According to the Japan Times, the Tokyo District Court ruled on a case where a man’s wife was seeking compensation from a night-club hostess who had a sexual relationship with the husband.

The court ruled the wife should not receive compensation because the hostess was engaging in the affair for business reasons: to retain the husband as a customer. This precedent could also apply to prostitution, a more direct type of sexual business transaction.

Some legal and judicial experts worry that this case will justify extramarital affairs under what the judge called “makura eigyo,” which loosely translates to “pillow sales tactic.”

The decision was handed down in April 2014, but is discussed in the current issue of legal magazine Hanrei Times. The wife did not appeal the ruling so the case has been finalized.

Not that I condone it but just to be the Devil's advocate, why is it okay to lie(hurt emotionally) for greater good but it's immoral to cheat(hurt emotionally) on your significant other for greater good(assuming business purposes mean more
employments or any activity which would facilitate both, the owner and general populace)?

basically encourage japanese women to prostitute themselves.

the japanese economy is in bad shape despite abe's money printing stimulus. many japanese are working low paying jobs. also in japanese culture women dont work after marriage so basically life is getting very tough.

a lot of japanese women are selling themselves to earn more money for the family because they dont want find proper work. japanese culture look down on japanese and their families if his wife works.

So those wife that Japanese Men got from North east of China can also take part of this law which cheating their Japanese husband for money, file the divorce and flight back to China...it's after all business :rofl:

And thus we have an idea why birthrate in Japan is much lower... and I thought it was because naked, hand-drawn girls and PC dating-simulation games distract males that they would prefer these so-called "2D women" than real women.:o:

The woman sue for compensation. And the Supreme Court of Japan rejected the Woman case and the case is final in 2014. That is the nutshell

First of all, most people do not know that is Adultery is not a crime in Japan, infact, Adultery is not a crime is many parts of the world, it is an moral issue, NOT A LEGAL ISSUE.

Court of law can be use to prosecute legal issue only, if this case is trial in other part of the world, say Hong Kong, US or France. The outcome would be the same. You can file a divorce on ground of unfaithfulness, but nothing is wrong (on the legal standpoint) about Adultery, even when that is a business transaction (Say prostitution) if said thing is not illegal in term of court of law, and in Japan, prostitution is not defined, and hence the Adultery act committed under business transaction is also not defined. So they were neither legal nor illegal.

In fact, for what it worth, the article suggested this is actually a precedent for legalising prostitution in japan

Tbh I see nothing wrong with an extramarital affair for both partners, as long as they have agreed to accepting fluidity in a relationship and agree not to talk about the people they have an affair with.

Yes, What law did a person who committed an adultery act had broke in Japan?? Or in China even?

It's one thing to be okay with, should you do it is another question. It's Ok to do something does not always mean you should do it. It's ok for you to dig your hand inside someone else toilet, does that mean you should do it?

what you are saying is an "open" relationship, it's quite popular in Europe, I once in an open relationship with a German Girl. Basically it's purely sexual.

They even have open marriage too, but let's not get into that
