Italy takes India to int'l arbitration over marines

The poster actually is either high on weed or is having serious constipation issues .

If the poster actually had some sense he would know that
1. Whole Europe (except Russia) combined with Pakistan, they still can't do anything to evil India.
2.International arbitration requires both parties of dispute to agree to a proceeding in ICJ, where as India has clearly stated the incident happened in Indian waters and is an matter under India's jurisdiction.

Andfor embarrassment , if Italians even had a bit of hope of winning, they would have done it much before, when a robot controlled India. Not now.

Marine currently allowed to stay in Italian embassy like will go to jail soon . Italian tried paying off Family big lum sum and even tried bringing in local Church to mediate since Victims were Christians so were accused , big Rome connection were used to get case transferred to Italian court were they could have given not guilty verdict .

Italy tried every trick in the book to get their marines out , Church, Money power and Diplomatic tactics , Euro pressure but India stood stall

The Point that is causing an issue is India argues the killing took place in Indian Waters where as Italy insists it was under International Waters.

To solve this issue of jurisdiction, arbitration between both parties should have led to the clearing of the initial jurisdiction.
To make maters worse there is a diplomatic failure which did not start due to the failure of Government but due to the Indian Courts. This became the main point that has now forced Italy to find justice through the International Court of Justice.

International waters are protected by International Law, The Court that is going to hear the issues regarding the issues arising in these waters is the International Court of Justice.

So far the Jurisdiction issue has not been solved in the Arbitration that has taken place so it is again in the court of ICJ. Now it can be done by appointing new arbitrators or by the court itself.

So far I have to say that i am ashamed by the farce in name of justice going on in India with regards to these marines.

To be honest, Italy has given enough time to India to try this case. It's been three years since the incident and Italians unlike the Indian's can't wait for wheels of justice to turn and turn slowly. To quote a famous Indian movie " Tareeq pe Tareeq"

This diplomatic tussle b/w India and Italy has frozen India's relation with EU and led to cancellation of India-EU summit.

Time to end this, get proper compensation for the victim's family and let these marines get on with their lives.

Even if they are guilty it will be a case of involuntary manslaughter which carries a punishment 5-7 years which they can serve in Italy

What Italy says doesn't matter as there are enough evidence that they are in Indian water.
Italian politicians makes matter worse neither this issue solved without so much fuss.
ICJ applied if Italy proved that their vessel was in international water and all arbitrary efforts failed.

Is it proven that these Marines are guilty? They maintain that they didn't shoot these marines.

Lest you forget sir onus is on the prosecution to prove the guilt. That's how Indian laws work and till now after three years these Marines have not still been chargesheeted.

If the case was so clear cut then why the delay in chargesheeting these marines?
