Marines case: Govt dragging feet on special court, says SC



New Delhi: The Supreme Court on Friday questioned the government as to why it was "dragging its feet" on the issue of setting up a special court for holding trial of two Italian marines, accused of shooting dead two Indian fishermen.

The apex court also took exception to the Centre not following its January 18 direction to consult the Chief Justice of India to set up a special court to try the case.



"Why the Centre is dragging its feet? Nobody has made attempt for consultation for setting up of court," a bench headed by Chief Justice Altamas Kabir said.

The remarks were made after the bench was told that the issue of setting up a special court was under consideration.

"How long will it take? If the court would have been set up, the trial in the case could have been over. Why it is late? It would have by now decided whether they are guilty or not," the bench, also comprising justices AR Dave and Vikramajit Sen, observed during the hearing on the pleas by the two marines seeking to visit their country to cast votes for the upcoming general elections.

The apex court on January 18 had rejected the plea of the Italian government and the two accused marines that Indian courts have no jurisdiction in the case and they should be tried in an Italian court.

It had directed that the accused be shifted to Delhi and be under the 'custody' of the Supreme Court till the Centre constitutes a special court to hold their trial.

"Union of India is, therefore, directed, in consultation with the Chief Justice of India, to set up a Special Court to try this case and to dispose of the same ...," the court had said in its January 18 order.


Sonia does not want it, that way they will be sent to Italy for a trial.

Exactly , what form of law is this ? I haven't ever heard of it ... Is there provision in Indian law for foreign prisoners to return to their country to spend Christmas or cast their vote ? Never heard of any Pakistani fisherman returning to cast his vote ...

If they don't return, they will be international fugitives, and Interpol would be within their mandate to hunt them down. However, no such eventuality will take place, as the Italian authorities have assured their return, and such assurances actually matter in international law and its application. The Italian authorities will not risk severely straining their ties with India, and having all their credibility dented, all for the sake of two marines accused of murder. Also, note that this is not the first time they have gone home - they went home for Christmas, and duly returned.

Guys these men have been detainees for almost a year now. Not many nations would have withstood the poltical pressure and detained them in the first place. These are not just any prisoners so there may be special considerations for them but the fact remains they are still in Indian custody.

they are your Raymond Davis now . they will not be back :)

ROME: Italy said two naval guards on trial for murder in India would return to the country by Friday, after earlier saying they would remain in Italy in a move that had unleashed a diplomatic furore.

The two — Massimiliano Latorre and Salvatore Girone — had been granted a special leave last month by an Indian court to return to Italy to vote in elections but had skipped bail.

The government said on Thursday it had received "ample assurances" from Indian authorities "on the treatment that the naval guards will receive and the defence of their fundamental rights".

"The government decided, also in the interests of the naval guards, to maintain the commitment taken when they were granted leave to take part in the elections to return to India by March 22," it said.

"The naval guards agreed to this decision," it added.

Prime Minister Mario Monti met with defence minister Giampaolo Di Paola and Steffan de Mistura, a junior foreign minister who has taken a lead on the case, to discuss the issue on Thursday.

The government had announced on March 11 that the naval guards would not return from their leave.

The two are accused of killing two Indian fishermen they mistook for pirates off the Indian port of Kochi last year while they were serving as security guards on an Italian oil tanker.
