if you ask Subramanian Swamy he will say " diplomatic immunity means the the immunity against dragging him to the local court,law procedure in foreign country but now that he voluntarily submitted and committed himself to the Indian judiciary and law by guaranteeing the return of the marines to India, he no longer enjoys diplomatic immunity"

His diplomatic immunity is intact, even in the event of an act of criminality, felony etc..
Giving a pledge is no big deal against his immunity cover.

The Italian ambassador cannot leave means he is not sacked/ arrested-
it does not mean he is forced to stay in india-



How can you apprehend/ house arrest a certain Ambassador- or force him to stay- during peace time- -

in such case gov. takes affidavit from Ambassador , if they don't return Responsibility will be on him , he will get punishment according to law .

it's like Bank Load guaranty , if someone doesn't pay then bank rob the person who given affidavit.

Thinks don't work like local laws in case of diplomatic immunity.Diplomatic immunity is absolute and court affidavits does not negate it.

Article 29 of the Convention, which came into force in 1964 under the aegis of United Nations, says: "The person of a diplomatic agent shall be inviolable. He shall not be liable to any form of arrest or detention. Even though there are few options ranging from symbolic to suicidal......

1.Trail in absentia (Not possible,Code of criminal procedure does not have trail in absentia clause)

2. Expel Italy's ambassador and recall our's.(stupid)

3.Break relations with Italy.(moronic)

4.Arrest Italy's Ambassador.(Suicidal.All our ambassadors would lose diplomatic immunity.Had S.M. krishna not shown his lack of tact in Norway's dispute,i would not even have considered it an option.)


None of them is practical.

Nothing will happen. The current Indian government is neck deep in corruption, some of the big shots are involved in the recent Agusta Westland Scam. Italian government has all the names and details which they ll use to blackmail and leverage the corrupt Indian government and ensure that the marines are never sent to India.

All these statements by the Indian government is mere hogwash.

Diplomatic privileges and immunities guarantee that diplomatic agents or members of their immediate family:

May not be arrested or detained
May not have their residences entered and searched
May not be subpoenaed as witnesses
May not be prosecuted

The course of action to be adopted by the apex court would be clear on Thursday when Swamy is likely to file his plea for initiation of contempt proceedings against those who violated their undertakings.

Swamy had written to the Attorney General G E Vahanvati seeking his consent for initiation of contempt proceedings against the diplomat and the marines. AG is learnt to have told the Janata Party president that he would require some time to study the petition for initiation of contempt before deciding on grant of consent.
