That's because India feels it's invincible in taking the diplomat hostage. There are consequences to its actions. If things escalated to that point, nuking India is one of the consequences.

It's not that the diplomat can do anything and run away.
He can be prosecuted if involved in false assurances,sabotage or any other damage to the host nation.
 
The French diplomat didn't have diplomatic immunity. You fool.

When receiving diplomats who formally represent the sovereign the receiving head of state grants certain privileges and immunities to ensure they may effectively carry out their duties on the understanding that these are provided on a reciprocal basis but when there wont be diplomatic relation between 2 nations no questions of immunity.

Indian courts haven't even taken legal discourse yet or broken any clauses of Geneva convention.
But in your own words ..he has already become a hostage in India for his action..so let wait and watch, how the events unfold.

indian supremer court has already issued restraining order for the diplomat. there goes the immunity i say. government has to do what judiciary decides.

1) Diplomat is not taken hostage. this is the reaction for breaking the law - braking the promise he has made to the supreme court of india

2) If he do as he committed to the court (ie producing that 2 marines) he can do what ever he can in india.

3) Since he has diplomatic immunity india wont arrest him. Listen to External affiars ministers word yest... He said we are aware of Geneva and its compulsions.

4) Please understand this issue is not going to be as what you imagine..... Even if it is get worse as you assume... India will be the last Country in the to be nuked list.... Us and Nato already has a long list.... NK,Iran etc etc....

You are wrong, you simply cannot arrest an ambassador without severe consequences. You cannot arrest diplomats unless the embassy/government waives that immunity. That is the basis of the Geneva convention.

Sir, by submitting an assurance to a court, did he willingly submit himself to the consequences and waived his immunity by becoming party to a legal matter in India? Probably not, but I don't really know much about this.

BTW can't he just say he has his daughter's birthday to attend, or the fair in his hometown and just leave??? :)

So far nothing has been implemented, merely asking the ambassador to not leave has not caused any real damage, the ambassador has not pushed it. It is grey area and one which neither the GoI nor the SC will tread into lightly.
 
so if a pakistani diplomat set up bomb in market killing 1000s in india will we care for the international law or indian law? all rights immunities have limit. and government of india did alerted all exit point for not allowing the diplomat to escape

first and foremost are the interest of indian nationals then foreigners if it comes to that is all i would say

lets keep our fingers crossed. i dont think GOI will let this diplomat go as easily. they may use some chanekya niti..lol

Could be argued that he might have caused that immunity protection to slip somewhat but would still be very dangerous for India to test that hypothesis.

That is what I was suggesting he ought to have done immediately rather than wait around for an angry SC to come after him.
 
it could be dangerous if we did not had valid reason. italian can do tit for tat but indian diplomats are already asked not to go to italy. if india stops diplomatic relations with italy we can argue he is not a diplomat anymore.

Precedence is not restricted to the country presently targeted. Other countries can cite the same.
