I fail to understand why ISI or Gen. Pasha is being blamed for the release of Raymond Davis. It was done under the provisions of the Pakistan Qisas & Diyat Law.
Qisas & Diyat laws were introduced in 1990 upon the insistence of the Shariat Appellate Bench of the Supreme Court. The laws have since been used or misused to save to the rich & powerful many times. The most recent case being that of Shah Rukh Jatoi following his brutal murder of Shahzeb but later went scot free after acceptance of the blood money by the legal heirs of the diseased.
Are we now saying that this law, which is in line with the Sharia, is “Wrong” or should the law be applied only to Pakistanis but not on the foreigners? If a cold blooded killer like Shah Rukh Jatoi can be pardoned why not Raymond Davis? Blame the Law not the ISI.
In my opinion, primary purpose of this Law; when it was introduced at the advent of Islam; was to end tribal blood feuds that continued for generations. I agree that under provisions of this Law, Pakistanis with wealth have a licence to kill the poor & the down trodden
There is an old saying that “Justice” is blind; justice under this law is not only blind but also grossly unfair. However, as long this law remains in force, killers like the Raymond Davises and Shah Rukh Jatois will continue to go unpunished.
So it is in Sharia to hold a victim's family members at gun point and blackmail them to accept blood money?
According to RD, Gen Pasha facilitated and orchestrated his release. This could not have been without approval of Gen Kiyani. There is nothing wrong with this scenario except the part where RD writes about the family of the victims being forced at gun point by ISI agents to accept blood money. If this is not true then the Army needs to release an official statement, if it is true then we need to know the reasons behind this illegal act.
