(Reuters) - The cabinet moved to shield politicians found guilty of crimes by passing an executive order on Tuesday that could allow convicted lawmakers to continue to hold office and stand in elections, ahead of national polls due by next May.
Two ministers present at the cabinet meeting told Reuters an executive order on the matter was passed. They declined to give further details.
About 30 percent of Indian politicians across central and state assemblies have criminal charges against them, and following a Supreme Court order in July many faced being expelled from their seats, including government allies seen as important for electoral success.
The ruling Congress party had already moved a parliamentary bill to partially reverse the decision of the court that any lawmaker found guilty of a crime could no longer hold or run for elected office.
The ordinance is believed to be similar in content to the bill, which would allow lawmakers facing charges to continue to take part in parlimentary proceedings such as debates, but not to vote or receive a government salary.
The bill has not yet passed through the notoriously slow-moving parliament. Some commentators believe the government was compelled to act by the possible conviction for corruption of an electoral ally in a court case due to conclude next week.
"When it comes to saving their convicted brethren, they act with lightning speed," said Amulya Ganguli, a political analyst.
Following India's last general election in 2009, about 30 percent of the lawmakers sworn into both the federal and state assemblies had criminal charges against them, according to an analysis by the Association for Democratic Reforms, an advocacy group.
In the Lok Sabha, 162 of the 543 MPs declared there were pending criminal cases against them in affidavits that they had to file prior to contesting elections. In the state assemblies, 1,258 of the 4,032 lawmakers declared criminal charges.
It is not clear how many have since been convicted.
Before July's Supreme Court order, India's lawmakers had been able to capitalise on a loophole whereby those who filed appeals within three months of a guilty verdict could stay in office.
The ordinance must be signed by president Pranab Mukherjee in order to become law. The law must be ratified by parliament within six weeks of the start of the next parliament session, or it will lapse. It is expected to pass easily.
"There is widespread support for this among the political class," said Neerja Chowdhury, a political commentator and a former political editor of The Indian Express newspaper.
The case due to conclude next week concerns Lalu Prasad Yadav, a former chief minister of Bihar and a frequent ally of the Congress party. Yadav is one of the accused in a scam where money was allegedly taken from state coffers to provide fodder for herds of livestock that later turned out not to exist.
"Lalu Prasad's possible conviction could have prompted the cabinet to pass this ordinance," Chowdhury said. "There are some who feel that...if they get Lalu Prasad on board they can win Bihar."
Home to 104 million people, Bihar is one of India's most electorally important states.
Another influential figure, Rasheed Masood, a Congress party member of the Rajya Sabha and a former health minister, was found guilty last week in a corruption case that involved nominations for seats at medical schools. He was set to be the first lawmaker to be affected by the Supreme Court order, according to local newspaper reports.
Several politicians have been charged with serious crimes such as rape and murder. Elected office can be lucrative in a country where black markets thrive sometimes under political protection. Political parties can sometimes be open to criminal elements who bring with them campaign financing.

Government announces Seventh Pay Commission for central employees
NEW DELHI: Ahead of elections, the government on Wednesday announced constitution of the Seventh Pay Commission, which will go into the salaries, allowances and pensions of about 80 lakh of its employees and pensioners.
"Prime Minister Manmohan Singh approved the constitution of the 7th Pay Commission. Its recommendations are likely to be implemented with effect from January 1, 2016", finance minister P Chidambaram said in a statement.
The setting up of the Commission, whose recommendations will benefit about 50 lakh central government employees, including those in defence and railways, and about 30 lakh pensioners, comes ahead of the assembly elections in 5 states in November and the general elections next year.
The government constitutes Pay Commission almost every ten years to revise the pay scales of its employees and often these are adopted by states after some modification.
As the Commission takes about two years to prepare its recommendations, the award of the seventh pay panel is likely to be implemented from January 1, 2016, Chidambaram said.
The Sixth Pay Commission was implemented from January 1, 2006, fifth from January 1, 1996 and fourth from January 1, 1986.
The names of the chairperson and members of the 7th Pay Commission and its terms of reference will be finalized shortly after consultation with major stakeholders, Chidambaram said.

“No He Can’t” blares the cover of the latest issue of Outlook magazine which marks the inevitable pushback to the triumphant narrative that has dominated headlines since Narendra Modi‘s anointment as BJP’s candidate for Prime Minister.
Outlook’s prediction, based on the ground “expert” predictions, is offered as a reality check to the innumerable stories on Modi’s personal popularity. The bad news for the BJP: the numbers just don’t add up to victory. The problem, according to Neelabh Mishra, is that NDA has no room to grow. They have already maximised their gains in traditional strongholds in the North and West — think MP, HP, Gujarat, Goa etc. And even large gains in other states in these regions — Rajasthan, Punjab, Delhi and Maharash*tra — will still leave NDA 90-100 seats short.
The gains the NDA may have in the north and west will be undermined by losses in Karn*ataka, till recently its only southern bastion. And with his departure from the coalition, Nitish seems to have ensured that even if the BJP gains a few seats in Bihar, the NDA would be down in that state: it had won 32 seats last time; this time it could be half or a third of that number… even in UP, the BJP can’t hope for more than 30 of the 80 seats: the electorate is fractured and the Muzaffarnagar and Ayo**dhya gambles of the BJP and SP may have caused a polarisation detrimental to both. If the BJP’s tally touches 30, that will be thrice the present number—it’s difficult to see any more accruals.
South and East India will stymie Modi’s PM aspirations in 2014, but that’s alright with the RSS which, Mishra argues, is playing the long game. Its chief pracharaks are willing to endure political isolation in the short run in order to pave the way for “a completely Hindutva dominated NDA-II” of the future.
To spell out Mishra’s somewhat vague thesis, 2014 is not an election to win but to shift Indian politics rightward. Even a strong showing with Modi at the helm will make the prospect of a unashamedly Hindutva government more palatable, perhaps even inevitable.
It’s an interesting argument except another Outlook story in the same issue argues exactly the opposite: That the BJP has sacrificed its collective tradition of leadership at the altar of personality-driven politics for immediate electoral gain.
The impending Lok Sabha polls has pushed the BJP to eclipse its entire galaxy of leaders behind the shadow of one man who the party thinks can deliver it the mandate. For long a cadre-based, ideologically oriented party, it’s now trying to transform itself into a single leader-driven, result-oriented one which will be guided by the tools of marketing.
Hand-wringing over BJP’s internal democracy aside, how does this momentous decision make sense if Modi can not — as Outlook claims — deliver the required 200+ votes? Surely, it would then mean that BJP’s own polling indicates a big Modi dividend, similar to the C-Voter poll in May which predicted that the NDA minus Modi – with Nitish Kumar in tow – will get a paltry 179, but the seat count shoots to 220 with Modi in charge.
So is Modi’s anointment short-term gain or long-term calculation? Foolhardy gamble or far-sighted investment? Nobody knows, including the divided and ambivalent BJP leadership. All India Congress Committee general secretary Digvijaya Singh on Tuesday said 10,000 burqas have been purchased from a shop in Indore ostensibly for BJPs rally, to be addressed by Narendra Modi on Wednesday, to given an impression that the saffron party has support of Muslims.
Singh told reporters at a press conference that Rs. 42 lakh has been paid to the maker of burqas by Devendra Jain, who is a director of Biltcon, a company owned by Dilip Suryavangshi, an industrialist considered close to chief minister Shivraj Singh Chouhan and accused by the Congress of being involved in illegal mining.
Singh, who displayed the receipt of the purchase, said thousands of skullcaps (topi) have been ordered from Lucknow for this convention.
Modi had recently drawn flak from a Muslim cleric who had offered him a skullcap at a public meeting, but the Gujarat chief minister had declined to wear it.
However, Salim Khan, the burqa maker, said he had only given quotation for 10,000 burqas.
Reacting to Singh's statement, BJP media in-charge for Madhya Pradesh Deepak Vijaywargia said the bill produced by the Congress leader could be a "fake" as the Congress had done similar things in the past.
Describing Singh as a person who could go to any extent, Vijaywargia said there were times when the Congress had distanced itself from his (Digvijiaya's) statements.
He said the Congress was resorting to such things as it had no answer to the development carried out by the government during the past 10 years of BJP rule in the state.

An accusation by Digvijaya Singh, that a construction company linked to the Bharatiya Janata Party (BJP) has sponsored 10,000 burqas for the party's Karyakarta Mahakumbh in Bhopal has made Muslims the cynosure of the rally to be addressed by Gujarat Chief Minister Narendra Modi on Wednesday.
Congress General Secretary Digvijaya Singh, who is known for raking up controversies with his statements, on Tuesday said that 10,000 burqas were ordered by BJP from Indore in order to increase the presence to fake Muslims at Narendra Modi's rally.
"In the entire country, it is being said that BJP has the support of Muslims... Now, as proof, I have a bill which shows that 10,000 burqas have been bought from Indore. The same number of topis could not be found here, but were ordered from Lucknow. I will put that bill before you as well," Singh said.
These clothing items have been bought to show greater Muslim presence at Modi's rally, he said.
"Around 10,000 burqas worth Rs.44.60 lakh were purchased.
The bills have been made in the name of Dilip Builcon's director Devendra Jain, a partner of Dilip Suryavanshi. Suryavanshi is known to have close relationship with MP CM Shivraj Singh Chouhan," he added.

The Bharatiya Janata Party (BJP) rally is expected to witness its prime ministerial candidate Narendra Modi sharing the stage with party patriarch LK Advani. This is the first public appearance of the two leaders after the BJP patriarch openly opposed and skipped the event where Modi was chosen as BJP's PM candidate.

An accusation by Digvijaya Singh, that a construction company linked to the Bharatiya Janata Party (BJP) has sponsored 10,000 burqas for the party's Karyakarta Mahakumbh in Bhopal has made Muslims the cynosure of the rally to be addressed by Gujarat Chief Minister Narendra Modi on Wednesday.
Congress General Secretary Digvijaya Singh, who is known for raking up controversies with his statements, on Tuesday said that 10,000 burqas were ordered by BJP from Indore in order to increase the presence to fake Muslims at Narendra Modi's rally.
"In the entire country, it is being said that BJP has the support of Muslims... Now, as proof, I have a bill which shows that 10,000 burqas have been bought from Indore. The same number of topis could not be found here, but were ordered from Lucknow. I will put that bill before you as well," Singh said.
These clothing items have been bought to show greater Muslim presence at Modi's rally, he said.
"Around 10,000 burqas worth Rs.44.60 lakh were purchased.
The bills have been made in the name of Dilip Builcon's director Devendra Jain, a partner of Dilip Suryavanshi. Suryavanshi is known to have close relationship with MP CM Shivraj Singh Chouhan," he added.

Ishrat Jahan case: CBI questions Gujarat Law Minister Bhupendrasinh Chudasama
Gujarat Law Minister Bhupendrasinh Chudasama was on Wednesday questioned by CBI in connection with the Ishrat Jahan encounter case, agency sources said.
They said Chudasama was allegedly present during the purported meeting that discussed strategies to protect police personnel involved in the fake encounter which were recorded by an accused police official.
The sources said the agency is trying to ascertain the authenticity of the discussions in the tape which was handed over to the trial court along with the charge sheet.
CBI has already questioned Minister of State for Law Pradeepsinh Jadeja and other actors presented during the purported meeting.
The sources said the agency would first compare the voices in the tapes and gather material evidence which corroborates the discussions in the meeting in its attempt to prove the authenticity of the tapes.
Suspended IPS officer G L Singhal, who was among the nine persons who attended the meeting, had submitted two pen drives to investigators containing the recorded conversation of the meeting.
Singhal is now out on bail as the agency failed to file the charge sheet against him in the stipulated 90 days.
Ishrat Jahan was not a terrorist: CBI
The nine people who were present in the meeting held in private chamber of Advocate General Trivedi were Singhal, Singhal's lawyer friend Rohit Verma, G C Murmu, A K Sharma, then MoS (home) Praful Patel, Jadeja, Chudasama and another accused in the Ishrat case, Tarun Barot.
CBI has also grilled Murmu, secretary to Chief Minister Narendra Modi, and Crime Branch Joint Commissioner A K Sharma.
The agency also examined suspended IPS officer D G Vanzara last week regarding his resignation letter in which he had hit out at the Narendra Modi government for failing to protect the jailed police officers on fake encounter cases.
CBI has named Singhal, Vanzara, suspended IPS officers P P Pandey and Tarun Barot, N K Amin, retired DSP J G Parmar and commando Anaju Chaudhary in the chargesheet, accusing them of murder and criminal conspiracy with regard to the encounter killing of 19-year-old Ishrat, Javed Sheikh alias Pranesh Pillai, Zeeshan Johar and Amjad Ali Rana on the outskirts of Ahmedabad in June 2004.
CBI's probe in the case was still on, it had said when filing the charge sheet in July.
