Death penalty should only be given when the conviction is based on evidence beyond doubt i.e. eye witnesses etc, medical reports and other evidence that establish the gang rape happened. In cases where there is doubt that whether it was a rape or a consensual act, a lesser punishment should be given.

This is why I said that there needs to be a mechanism to check the effectiveness of forensic part of the investigation.

While it is still not advanced enough to reconstruct a rape scenario, it still is about 80-90% accurate.

Hence Forensics investigating rape should be anonymous and inaccessible individually to police officers, lawyers and judges.

I think laws are pretty strict in Pakistan already but the parents of the children need to take a stand. Our judicial system is a garbage. It only favours the rich and powerful.

The female/relatives etc involved in false accusations/framing of course should be punished.

But if they loaded the gun.

The investigating machinery primed it.

The judge fired it.

So asking.

Such questions always arise in capital punishment mistrials.

Uh.... this is about the death penalty.

All European countries have revoked death penalty. India retains it.

Just that for rapists the death sentence is being proposed and you have a problem with that too.
