Indian deputy consul general arrested in US on visa fraud charges

Times now saying she was stripped ...if this is true..this is outrageous ...all military transactions with them should be canceled

It is not a crime by Indian Law, and she has diplomatic immunity from US laws. What part of that do you not understand ?
No, consular immunity is only partial: it only covers the consul's duties.

Apparently what the deputy consul applied for was an A-3 visa for her housekeeper. The application says quite clearly of the housekeeper's pay, "The rate must be the greater of the minimum wage under U.S. Federal and state law, or the prevailing wage for all working hours. Information on the prevailing wage statistics by occupation and metropolitan area is available on the Department of Labor's Online Wage Library & Data Center website. "

The deputy consul is obligated to pay the rate under U.S. law. There have been several cases like this in the past few years, notably when a Saudi princess was held in jail under a $5,000,000 bond, charged with enslaving her domestic: link

This incident just goes to show Indian blood is treated cheaper than sea water.
Quite the opposite: it shows that Indians working in the U.S. are entitled to the same treatment as American workers, regardless of the fact that their boss is a diplomat.

Being strip searched and locked up are proper legal proceedings when they arrest people in the United States. She is not above the law and I see no controversy in this matter. This is yet another humble pie that Indians are forced to eat after thinking that Bollywood, and out Sourcing some how propelled them into super power status.

You know nothing about American legal proceedings.

In an incident that happened in Houston in 2010, a chinese diplomat was chased by the police and arrested, in the process injuring the diplomat. Do you think that was legal too ?

or will you change your plate now you moron ?

Leave Raymond Davis out and I Completely agree with you. India must act tough.

Absolutely.

Next time US Diplomats are forging documents to so that they can bring maids from USA so that they can work below minimum wage while stationed India, India can use its own laws which protect the rights of Maids and prosecutes the guilty party against these American Diplomats.

Oops, I forgot no such laws exist in India and thats why India is in such an uproar.  :D

she is a consular officer and not a diplomat...so there goes the excuse of having immunity. she broke the US local laws...she deserved it.

as for Indian politicians...since the news has spread all over indian media...they have no choice but to do something.

fair enough. how will the US react if one of their diplomats was arrested in this manner ?

Will India now act against gay US diplomats? | GulfNews.com

Believe it or not they have been immune for so long.

She was consul-general.
And she should have been provided diplomatic immunity, which her counterparts in India enjoy.
She was strip serached, handcuffed, arrested and lodged with hardened criminals.
There is something called LAW OF RECIPROCITY and its in place now.

We are going around in circles. This has already been addressed.

1. The Consular chief can ONLY be arrested for GRAVE crimes. The fact that she got bail immediately and was released clearly shows that it was not a GRAVE crime under US laws.

2. It also violates the sprite of the Vienna convention that governs inter state relationship.

3. It should be and will be seen as and unfriendly act by an unfriendly nation. The repercussions will be long lasting and irreversible.

4. Only high ranking senior diplomat's get to become counsul in India's US counsulate. This same person will soon become a very senior Secretary in the Foreign Affaris office in New Delhi when she returns to India.

You can bet she will not forget this insult and you can be sure that No one in the Indian State Dept. will ever trust the US again or push extra hard for that 'special' relationship you keep talking about.

1. India was FORCED to send the Nanny on A3 visa since the US DID NOT ALLOW the Indian govt. to send her on a A2 visa that would have provided immunity to the consul general.

2. India still sent her under A3 under the assumption of GOOD FAITH. That premise has now been demolished.

3. US can now forget about expect any Indian action representing Good Faith or India as a Nation to EVERY TRUST US based on Good Faith.

1. US govt. is ALSO OBLIGATED to take criminal action against US counsular members who break the law in their host nations. US has singularly show reluctance to prosecute such criminals.

2. In absence of any such US precedence, US hot air about respecting the law has limited takers anywhere in the world. You can continue to holler and Bully, but every time a Nation stands up to your Bullying, you loose that much respect and friendship. Now that is just common sense.

3. There is nothing to indicate that the total CTC of the nanny which included stay, food, transport, medical insurance and privilege of having a diplomatic passport and her pay was below US minimum wage. Not even a primia facie case.

Quite the opposite: it shows that Indians working in the U.S. are entitled to the same treatment as American workers, regardless of the fact that their boss is a diplomat.

In fact what it really shows is that US expect special privileges for their consul members working all around the world, but is reluctant to extend the same courtesy to members of other consular missions.

This is one message that has gone out LOUD and CLEAR to all Indians.

Indian has henceforth decided to restore parity and treat the US consul members with the same amount of arrogance and disdain. All the Best.

LOL.

We shall see how much the US stand by its decision to prosecute the Indian Dy. consul General

Devyani case: No regret, but conciliatory US promises to review procedures - The Times of India

US assistant secretary of state Nisha Desai-Biswal told The Times of India in an interview that contained no regret, but was conciliatory in tone.

"While this is a law enforcement issue that needs to be worked through standard law enforcement channels, we will work India, with colleagues in the ministry of external affairs, in the spirit of partnership and cooperation that marks the broader bilateral relations while working through their concerns and questions and making sure that we are able to move forward,"

there are no ifs ands or buts. leave that to imagination.

 .............. good one.
