Even genetically, baldness will continue to multiply as out of 4, 3 are carriers....so future is bald :P

Yes and that is for the companies' own protection and not driven by any possible imperialistic pangs passed down through genes.

Patents are filed by company not only to make sure that their ideas aren't copied but also to safeguard them from any future knowledge related lawsuits. Suppose you came up with a product and didn't file a patent, someone 10 years down the line can sue your company for IP infringement if he/she comes with similar innovative product.

Now the positive for the Colgate-Palmolive company is, it's now been official acknowledged that they too have developed the formula by themselves and are safe from legal contests.

Who said anything about imperialistic pangs passed down through genes? Whose genes anyway? Several of those companies are headed by Indians/non-westerners.

The problem is these traditional medicines are NOT their (the companies claiming them) ideas that they worry that others might copy! These medicines are "traditional" simply because they have been being used in India for hundreds of years, if not thousands!

Why is it that difficult to understand that you can't pass up someone's traditional knowledge as your own idea? Not for your own profit, anyways.

I don't know about Colgate-Palmolive case exactly but I am not sure how anyone can claim "they too have developed the formula themselves" when the exact same formula is being practiced in India for far longer than Colgate's existence!

It's amazing how the same companies that are so sensitive about their own IPR and fight any infringement tooth and nail but can lay claim to anything that's not TIGHTLY NAILED DOWN!

My Cousin is a Mustache fan... although he is good amount of facial hair ... he wanted Mangal pandey style Mustache ... he started using it to increase hair density ... started using Minoxidil , lost lot of head hair and didnt have any effect of mustache either ...

after 1 year or something he stopped using it ...

Keeping a clean scalp is a good way of stopping hair loss ....... and I have heard rumors that having lot of sex stops hair loss :p:

I have made it amply clear the reason behind the decision to file a patent. The arbitrator has decided the case & everyone respects that.

I think the issue is with GI(Geographical Indications) here. As for example, Champagne or Basmati. CSIR has been working on getting GI on a number of organic products that are native to India.

THat would be a more systematic way of dealing with these run ins. The private firms cannot be trusted to always do what is morally right. A uniform body at national level should keep a track of all such traditional knowledge and work with Patent offices of other countries to safeguard the owner's interests.

In India, we have TKDL (Traditional Knowledge Digital Library). They have a horrible website.
Do you have anything similar in US ?

I don't follow these IP litigations per se. I doubt.

The US patent office has over arching powers in these matters and folks there are pretty good though considering their long history of dealing with convoluted claims and counterclaims among tonnes of private firms.

NEW DELHI: India scored an important success when it fully protected its traditional knowledge by stalling a leading UK-based laboratory's move to patent a medicinal composition containing turmeric, pine bark and green tea for treating hair loss. The move comes just days after India foiled a similar attempt by US-based consumer goods giant Colgate-Palmolive from patenting a mouthwash formula containing herbal extracts.

The vigilance of the Traditional Knowledge Digital Library (TKDL) of the Council of Scientific and Industrial Research (CSIR) helped protect the Indian products as the council in its submission to the European Patent Office managed to prove that turmeric, pine bark and green tea were being used as a treatment for hair loss in Indian systems of medicine like Ayurveda and Unani since ancient times.

The UK-based company - Pangaea Laboratories Limited - had filed the patent application in February, 2011. The CSIR-TKDL unit had, however, objected to it and filed evidence on January 13, 2014 once the patent application got published in the European Patent Office website.

Based on India's evidence, the patent application was finally "deemed to be withdrawn" by the applicant on June 29 this year.

The back-to-back victories in thwarting the attempts of the two big foreign entities (Colgate-Palmolive and Pangaea Laboratories Limited) adds another feather to the cap of TKDL's which has tasted success now in about 200 such cases without incurring any cost to the public exchequer.

Recently, it had frustrated a move by Colgate-Palmolive to patent a mouthwash formula containing herb 'Jayaphal' (Nutmeg) extract. "The Traditional Knowledge Digital Library of the Council of Scientific and Industrial Research, headed by senior scientist Archana Sharma, had submitted proof in the form of references from ancient books, which said the herb and its extracts of 'Myristica Fragrans' were used for oral diseases in Indian systems of medicine", said an official note.

The TKDL is a pioneering initiative to prevent misappropriation of country's traditional medicinal knowledge at international patent offices. It has structured and classified the Indian traditional medicine system in approximately 25,000 sub-groups for Ayurveda, Unani, Siddha and Yoga.

It is proving to be an effective deterrent against bio-piracy and is being recognized as a global leader in the area of traditional knowledge protection.
